Here's my story to the fray (I was thinking about submitting this to BBB, but wasn't sure to which ones I should be directing it to):

I got a Sony GRZ660 laptop from my mom in the summer of 2003, and have sent it for repairs to GE Zurich twice through Circuit City under an extended 4-year warranty (exp. 2007).

The initial problem with the laptop was that it wasn't turning on. After sending out for repairs, I got the laptop back only to find that the problem was still there and hadn't been fixed. And, although I'd sent the item intact, I received it with a "foot" (a small hinge that props up the computer) missing, apparently broken off. I also received a claim notice from GE Zurich indicating that it would not be repaired under warranty because of "physical damage."

During the second time the computer was sent, I was a little more careful in checking the computer for any additional physical damage before sending it in for additional repairs (besides minor dust, there was none). This time after receiving the item, I turned the laptop on in the store to make sure it worked.

However, after getting home, I noticed a hole that had been punched in the corner of the computer. Additionally, as the computer's motherboard and BIOS had been changed, there are a number of functions and programs that are now irrecoverable.

I've attempted to take this to Circuit City again for repairs, but the store manager now claims that laptop repairs should not be sent out from the store, and that they are handled exclusively by GE Zurich. But after talking with GE Zurich, they have claimed that they are not liable for servicing the computer because I had received it as a gift, and although I've sent the item twice for repairs, the no-lemon policy doesn't apply.

Couple questions:

Has anyone filed in a small claims court, and what was the result? Did you get your full money back/what happened? The possibility of a class action lawsuit seems to be getting smaller, as all the websites/groups are being systematically taken down.

Hey Albert, I hear yah! I went through the same thing with my Toshiba. It was an obvious lemon and went through a hard drive at 11 months. It then went through a hard drive on average of every couple of weeks. After the 4th hard drive (using NOTHING but their software) they refused to do anything more. They claimed since the last hard drive failed at 31 days it was out of warranty! Buying a new hard drive from them would give me a 1 year warranty, buying a used one would give me a 90 day warranty... but if they replaced my hard drive under warranty it would only be good for 30 days! They tried to tell me it was software that I was using on the laptop... or a virus. My desktop used the same software except for the operating system which was Toshiba's set up disks. I talked to their supervisor and she wouldn't even say anything but "No." No explaination concerning the discrepency between the warranties of repairs versus buying a new or "reconditioned" hard drive. I could send my laptop in and pay a $450 minimum to have my laptop "repaired." When I asked her how they could possibly repair something that she said wasn't broke she said I was being abusive! The problem is, I have over 30 years of electronics back ground. Including 4 years of h.s. electronics, 10 years in the USAF and college electronics courses. I also worked as a product safety engineer for 4 years... testing new computer systems for UL and CE safety standards complaince. I also taught myself computer programming. So, since they weren't able to confuse me with their regular reasons they switched tactics to say that they didn't have to give a reason. Snail mail to their corporate didn't help either... I never heard back from them. Nothing you are going to do is going to change their mind I am afraid. I wish you luch and hope that I am wrong. I reformatted the hard drive with DOS 5.0 and loaded WinXP (not from their restore disk) and the hard drive lasted the past 2 years. Which tells me that there was something seriously wrong with their software... and their heat dissipation (which finally killed the last hard drive). I suggest you do as I have done... tell everyone! Because of my experience the college students I go to school listen to me when I tell them not to buy a Toshiba. Also, as a teacher I suggest to all students that ask me to buy something else. I guestimate that I have cost them anywhere from 10 to 20 purchases at the least. It ain't much but I feel better each time I talk someone out of buying a Toshiba. If nothing else, this post on the website here is a start. Good luck!
