This complaint/report is written on behalf of my parents.

Citifinancial Mortgage wants to foreclose on their property and they have no legal right to do so. I'll explain it this way when my parents' nightmare began.

On December 29, 1994, my parents needed to refinance their existing loan with Ford Consumer Finance because they had to make a $2,000.00 repair on their big rig.

Ford Consumer Finance said that they would add it to the existing loan in which they only owed a little over $14,000.00 on. Instead of doing this, Ford wrote it up as a second mortgage. They said this was the only way that they could loan my parents the money. They also added that the money could be used to pay-off the first mortgage. So, they reluctantly agreed and the second mortgage cancelled out the first. Thus bringing the new mortgage to a little over $20,000.00.

So, my parents started making payments on the second mortgage in January of 1995. Throughout this whole entire time they thought that the money was placed towards the second mortgage. In fact, the bills with the second mortgage reflected that or so they thought.

After Associates Home Equity took the mortgage over in 1997, my parents made the payments to Associates. Then on July 19, 1999, they received by mail a Promissory Note stating the loan had been paid-off and satisfied. A letter from Hope Munoz said that if we ever needed their financial help in the future to give them a call. They thought that the loan had finally been paid off. Right? Wrong!

The next month came around and they received another bill from them. So, my parents called up Hope Munoz and asked her why they were still receiving mortgage bills if the mortgage had been paid off. She told them to give her a month and that so would see what was going on and that they shouldn't do anything yet until they heard back from her.

After a month past, they received a past due amount from Associates. So, they called up Hope and she said that after a review of the records they still owed on the mortgage. I got on the phone this time and asked her why they sent the Promissory Note cancelling the mortgage. She told me that they just had paid-off the first mortgage and that they still owed on the second mortgage. I was outraged over this because the first mortgage had been paid-off since 1994. I even explained it to this to her and she told me that they have no record of the first mortgage being paid-off and cancelled. I was enraged even more by this especially when she hung up on me.

So, I decided to go to the Surry County Registry of Deeds Office to find out what was going on. I searched through the records going back to 1987 the date of the first mortgage. I checked through all of the indexes by with anything under my parents' names. Here is what I found.

1987-First Mortgage

1994-Second Mortgage

1995-Promissory Note cancelling out the first mortgage

1999-Second Promissory Note cancelling out the first mortgage again

When I saw the First Promissory Note cancelling out the First Mortgage on April 17, 1995, I was more then ticked off. I was pissed! The First Promissory Note was signed by Ford and Associates and the property had been released on December 29, 1999. In fact, the Second Promissory was filed as well and dated August 2, 1999. This one cancelled out the mortgage too. Both had the First Mortgage amount on them too.

It turns out they had my parents paying on the first mortgage twice and only putting very little towards the second mortgage. I showed both Promissory Notes (after photocopying them of course) to the a Mr. Cameron, the one who is in charge of the Registry of Deeds Office and the one who stamped both notes. I asked him to explain the fact that the first mortgage had been cancelled twice and had been paid-off twice in two different years. I couldn't explain it to me after checking both out for a few minutes. Instead he told me to get a lawyer.

So, I spoke with an attorney who advised us to keep paying on the second mortgage and to get an Account Payment History going back to 1987 and up until the present date. So, my parents continued to pay their mortgage sometimes paying a month ahead while I gathered up all of the old bills, Western Union receipts, and cancelled checks. This took a year to do and Associates refused to send me an Account Payment History. So a year later, we discovered that Associates had been bought out by Citifinancial Mortgage and no one told them that the load had changed hands either. They didn't know until a very rude CitiFinancial employee, Larry Hudson, called them up during dinner and told them that they hadn't paid on the mortgage since January and they had better pay up or else. This was around the spring of the year when we got this news.

After straightening him out and proving that the loan had been paid on, he stopped all calls. So, around 2003, I got on the phone to CitiFinancial and asked Customer Service for an Account Payment History. I told them that the IRS needed it for their records. Yes, I lied to them! They said that their records couldn't go back that far to 1987 and that they would send me what they had.

So, in July 2003, I received three payment histories from them going back to the 90s, but convinently not going to 1995. I did see how they misapplied payments, held Western Union payments long enough to make the interest more than the principle, split payments up into small amounts, and reversed payments. I was ticked off by this, but I couldn't see where the dirty dealings was at until I received another Payment History. However, this one went back to 1989. I was thrilled to get this one in the mail.

I began to add up the interest charges on the history and discovered the dirty part. The July Promissory Note stated that my parents paid out over $25,000.00 in interest charges, but the Payment History states that $13,544.25 had been paid in interest. A DIFFERENCE IN OVER $12,000.00!! WHERE DID THEY GET THIS EXTRA $12,000.00 FIGURE AT?!

I took my case to Citifinancial Mortgage and they tried to foreclose on my parents' home. They said that they would cancel the foreclosure if we paid them over $600.00 and forget about ever suing them because they would win in court. I spoke with another attorney who was having his own headache with them. He said to do what they say and when he can he'll help us out in the case.

So, they paid them and left off suing them for now.

Now, it's a different story. Like everyone else my parents fell on hard times and they became behind by a few months and tried to catch up by making two payments at one time.

On December 13, 2005, my parents was sent a foreclosure notice stating that they would foreclose on their house. My parents decided during this time to get a mortgage with another company something that they tried to do in the past, but Citifinancial always refused to allow a pay-off from someone else.

While my parents were speaking with a mortgage relief company to get a new mortgage with someone else, Citifinancial's attorney sent them 17 harassment letters which all say the something dated December 13, but sent to us on December 23 at the same time.

At the beginning of January Citifinancial sent to them, a Deed-In-Lieu of Foreclosure letter with a different date on it wanting $250.00 for the deed. Then, they sent them a letter stating options. Then they sent out a reinstatement letter.

This was something that they should have sent out first by my calculations. During this time, my parents still wanted to make payments on the loan, but Citifinancial refused any payments. They wanted it all in one lump sum.

So, after the final paperwork was settled with the new mortgage company, Citifinancial's attorney told my parents that the Foreclosuring hearing was called off. They thought nightmare over.

On February 2, 2006, my parents received 9 letters from their attorney stating that the house would be sold on February 15. It turns out that they held the trial without renotifying my parents and refused the pay-off from the mortgage company. The ltter that they sent to us was dated on January 26 and wasn't sent out until February 1. Time in which we could have done something.

I will not let CitiFinancial get away with this. The property had been released three times, there is $12,000.00 more on the interest from the first mortgage then what was paid out, and they screwed up by sending us those letters including their attorney who sent us all those harassment letters. My parents may now have to file for Chapter 13 in order to stall them until a court date can be given.

I will take them to Federal Court if I have to, but I will not let them get away with this scam!

I have all the evidence and I have the paperwork!

We will be speaking with an attorney tomorrow along with the mortgage relief company. I will present them with the evidence and we'll put an end to them once and for all! I have contacted the Federal Reserve Bureau and the NC Commissioner of Banks! By the end, they'll end up owing my parents money!

By the way, I want cash from them and no checks!

Thanks for all of your help and suggestions. I have contacted everyone that I can think of about this, but I will hold off on the news media for right now. I went to the Clerk of Court's office and found where they filed the Foreclosure proceedings under Notice of Relief From Bankruptcy. Basically, they were saying that my parents' couldn't pay the bankruptcy court and they were discharged from bankruptcy because of it. For one thing, the bankruptcy court told them that they were paid off and to cancel the Deed of Trust and ordered them to do so. They refused to do so. The Notice that they filed with the Clerk of Court was a proceeding that they had infront of the Clerk and submitted on 10/30/2013 and filed on 11/4/2013. The Notice of Foreclosure Sale was posted and filed on 11/6/2013. My parents' bankruptcy attorney, who sues them three times a year, was pissed off over this especially, when he looked into it and got the same papers from the Clerk. He faxed them all the paperwork from Bankruptcy, the order to Cancel the Deed of Trust, the one where they said it was paid off, etc, along with the printout of the Foreclosure Sale Notice on Brock and Scott's website. He also told him that he was suing them for damages as well. Brock and Scott's response was to send my parents' four letters on Friday telling them that they are still saleing the house along with a Foreclosure Notice and today they received 7 more of the same letters. I will be taking them to the lawyer's office on Monday after I get off from work. I also contacted NC Policy Watch and they wanted to know more about my parents' case and I told them. I will be filing two complaints with the NC Bar on both attorneys who filed the paperwork with the Clerk of Court.

What Happened After Filing and Getting Out of Bankruptcy Because of Citi

My parent's are now out of Bankruptcy and according to the Trustee of the Bankruptcy Court the mortgage has been paid off since February of 2013. This would be a cause for celebration because now we won't have to deal with Citi any more, right.? Wrong! Citi never closed out the mortgage account nor have they cancelled the Deed of Trust. After numerous attempts by the bankruptcy court to contact them and the hearings and court orders to cancel the Deed of Trust. They have responded to nothing. Then, we got at least 3 phone calls from them in which they hung up on us. So, I registered on their website to find out what is going on and discovered that the account was never closed out, they kept it open to the point to where there is $4009.99 still owed due to interest and fees. Amongst the fees are the Broker drivebys (which I am calling "stalking") and the foreclosure costs. Then, I checked on their attorney's website, Brock and Scott, and looked under foreclosure sales. They have my parents' property listed and will be auctioning it off 12/17/2013 at 10:00am. They give a case number and everything. Then, I checked with a few foreclosure websites and found that the property has been listed under preforeclosure since Nov 1, 2013. Same case number and auction date, however, they also have a Buy It Now feature on one of the websites.

They never sent my parents any foreclosure notices or auction notices in the mail. They never said that there was any more money owed on the mortgage. It was get the money from bankruptcy and foreclose and sell the property immediately after bankruptcy signed off.

I will be going to the courthouse on Monday and finding out what is going on and to see if there is any notices filed with the clerk of court's office. We will be suing not only Citi, but also, Brock and Scott, all 4 of Foreclosure.com websites, and anyone who buys this property.

Hello. I just wanted to respond to your parents situation. I just today did a rip off report about Citigroup, Citifinancial Mortgage. I filed my report under Finance. We have been dealing with Citifinancial Mortgage, Citigroup, Citicorp, Cititrust Bank and Primerica (division of Citi) since we signed a contract with the enemy or should I say Citi of Hell In Sept. 2005. The problem actually started in august 2005, however, in July 2006 we finally got a copy of signed closing documents and it has been a ride every since. I wanted to offer some advice from our experience. Any statements or reports received write the date on the envelope. If you are told they have sent Certified mail to your parents go to the local post office and fill out a request asking when the letter was sent and when it showed deliver. Take the certified tracking number with you. We have the same problem with Citi who dates a letter and than mails it out a week or so later. In our case they filed foreclosure with the courts and the documents they filed are fraudulent. They knowingly foreclosed without sending the letter of default, yet they still filed a copy of the unmailed default notice with the courts. I guess they figured no one was smart enough to check with the post office. The postal service in Washington DC sent us a letter stating they have no tracking or information on the letter Citifinancial supposedly mailed to us. Citifinancial also has sent letters that our insurance was cancelled, which it was not and they knew it. All this information is being sent to the Inspector General's office and Federal Trade Commission. If the government can prove intention, continual false mailings than they will go after Citifinancial, Citigroup. So the more everyone sends them eventually they will have to look into the accusations. We sent a general response of denial to the court's about Citi Financial filings We are waiting for a court date. The problem is right now I don't think Citi will file for a court date because they would have to go to court and answer the mail fraud and everything else they did to foreclose and hopefully the whole loan document mess. So our situation may go on for awhile. Here is the phone number for the general counsel (attorney)for Cititrust Bank, if he can't help you maybe he can direct you to the right attorney for the division of citi you need. I would like to do a filing to Congress, Senate and the House about Citifinancial. I also want to contact Dateline NBC and see if they might do a story about all the problems people have with Citi and all it's divisions. Meanwhile you can send your parents complaints and fight with Citi to the Office of Thrift Supervision, Office of Consumer Complaints, Federal Trade Commission, your state attorney general's office. I know it's overwhelming and it gets so old but maybe if we get everyone to complain someone will do something. It seems only the rich gets justice in this world! Hang in there and keep fighting the good fight!

My update posting is rather late due to illness and computer problems, but here is the update on my parents' case. After contacting the NC Commissioner of Banks on behalf of my parents, Tom, the bankruptacy attorney working their case, give us some surprising news. He received countless records from Citifinancial Mortgage belonging to my parents' account. He said that it was so volumious that he couldn't even mail us what he received or photocopy it all. He even had to get another attorney who deals with mortgage law to help him go through everything. Tom even told us that he will be contacting the FTC and the state's Attorney General to try and get more information from them. Both attorney's have dealt with Citifinancial before in both bankruptcy and in lawsuits against them. However, this is the first time that they received anything from Citi regarding anyone's account. So, contact and file complaints through your state's Commissioner of Banks. It works! I hope to be starting a blog about my parents' case soon on myspace.com. dear dude i am a mortgage broker. citi, nor any lender, can REFUSE a consumer to pay off his mortgage. It is none of Citi's business where your parents get the money. It is federal law that homeowners have the right to pay the lender any principal they want - but the lender may have assigned a 'pre payment penalty ' that cannot exceed 5% of the current balance. They also cannot have the prempayment penalty longer than 5 years after signing the note. Also, the borrower must sign the pre payment 'rider' at closing. The lender cant just slide it in their afterwords. If CITI refused to issue a payoff, it is against the banking charter . Even if they found every exuse in the book to DENY they ever got one, you should have had a title company or broker or lender try to get it for you, as a 3rd party who could also vouch for the effort. There has been some noise about the apparent 'non compete' clause that some lenders have. However, it wont stand up in court as a way to refuse a homeowner to pay off his mortgage with another banks funds.

Dear Candy - Dobson, North Carolina, Source One is a Title/Property Valuation company. The 5 fees that you see with different dates are for 5 different BPO values of your parent's property. A BPO is a Broker Price Option, or an appraisal of the property's market value. In order for decisions to be made on what action to take for an account, CitiFinancial has to have a current idea of what the value of the property in questions is. They usually like to have a value no older than 6 months. This is especially true with the fact that the real estate market has seen property values increase by double digits annually over each of the last several years. Your parents have paid for 5 appraisals of their property, over the years. Hope this helps, I will keep watching this case. Good Luck,

Citifinancial's Response to Everything

Citifinancial Mortgage responded to my parents' complaint that they sent to the NC Commissioner of Banks. Here is what Citifinancial's Response is to the complaint and this is from their Executive Communications Liaison, Nancy Hurley in O Fallon, MO. First off, they apologize for any frustations that my parents had while working with the servicing area of their organization. That their goal is providing excellent customer service. Then, she says that she is unable to locate a previous request for a Payoff Statment and that it is never their goal to foreclose on a property. Instead, they offer numerous options in an attempt to bring the account current. Then, she goes on to saying that any reference to predatory lending is taken very seriously. Then, it goes on to say that their commitment is reflected in their practices to assist their customers beyond their compliance with the law. Yeah, right! Basically, she lied in her little letter to the Commissioner of Banks. First off, First Liberty asked them several times for a Payoff Statement and they refused to give it to them. Second, they sent us the Foreclosure notice first in December. Then, they sent all the other options letters last. As far as the Payoff Statement goes, there are several statements, but with different amounts to them. They are as followed: Foreclosure Notice-over $12,000.00 Second Notice-Over $20,000.00 The one to the Commissioner of Banks-Over $17,000.00 The one to the Bankruptcy Court-over $15,000.00 Now, I ask you which is the correct amount?! My parents' Bankruptcy Attorney had asked for a whole laundry list of items from Citifinancial Mortgage (which they had to send him or be heavily fined). One of the things that they sent was An Account Payment History. There are two other types of information that they included with this history. The paperwork tells about a few of the services and fees that they charged my parents without their knowledge. The first five charges have left me a little puzzled because they are to a Source One Services Corp. With each fee, there are several different dates listed as while as different invoice numbers. I would love to know what this company is and why my parents were charged these fees. Now, for another little update which is Citifinancial's response to the Bankruptcy Court. My parents received in the mail yesterday a little something from them. This little something was in the form of a bill for $269.61. By the way, this is the amount that my parents agreed to at the beginning of the mortgage years ago. In their little Mortgage Account Statement at the top of the bill, it states that this is not an attempt to collect, recover, or offset the mortgage indebtedness against them personally. However, their records reflect that they hold a security interest in the property. In addition to any pending Chapter 13 cases, the plan status and terms may not be reflected on the account statement. In other words, they want to double dip on what they will be receiving from the Bankruptcy Court. Also, they are not calling this a "Regular Payment", but instead they are calling it a "Voluntary Payment". Basically, what they are telling my parents is to "Voluntarily" pay them what they want under the table or else they will Foreclose again. My parents are not taking this lightly. They said that they will be taking their little "Voluntary Payment Bill" and showing it to their attorney and the Bankruptcy Court on Friday at one of their meetings.

They are as followed: Foreclosure Notice-over $12,000.00 Second Notice-Over $20,000.00 The one to the Commissioner of Banks-Over $17,000.00 The one to the Bankruptcy Court-over $15,000.00 Now, I ask you which is the correct amount?! My parents' Bankruptcy Attorney had asked for a whole laundry list of items from Citifinancial Mortgage (which they had to send him or be heavily fined). One of the things that they sent was An Account Payment History. There are two other types of information that they included with this history. The paperwork tells about a few of the services and fees that they charged my parents without their knowledge. The first five charges have left me a little puzzled because they are to a Source One Services Corp. With each fee, there are several different dates listed as while as different invoice numbers. I would love to know what this company is and why my parents were charged these fees. Now, for another little update which is Citifinancial's response to the Bankruptcy Court. My parents received in the mail yesterday a little something from them. This little something was in the form of a bill for $269.61. By the way, this is the amount that my parents agreed to at the beginning of the mortgage years ago. In their little Mortgage Account Statement at the top of the bill, it states that this is not an attempt to collect, recover, or offset the mortgage indebtedness against them personally. However, their records reflect that they hold a security interest in the property. In addition to any pending Chapter 13 cases, the plan status and terms may not be reflected on the account statement. In other words, they want to double dip on what they will be receiving from the Bankruptcy Court. Also, they are not calling this a "Regular Payment", but instead they are calling it a "Voluntary Payment". Basically, what they are telling my parents is to "Voluntarily" pay them what they want under the table or else they will Foreclose again. My parents are not taking this lightly. They said that they will be taking their little "Voluntary Payment Bill" and showing it to their attorney and the Bankruptcy Court on Friday at one of their meetings.

Citifinancial Mortgage responded to my parents' complaint that they sent to the NC Commissioner of Banks. Here is what Citifinancial's Response is to the complaint and this is from their Executive Communications Liaison, Nancy Hurley in O Fallon, MO. Then, she says that she is unable to locate a previous request for a Payoff Statment and that it is never their goal to foreclose on a property. Instead, they offer numerous options in an attempt to bring the account current. Then, she goes on to saying that any reference to predatory lending is taken very seriously. NC Commissioner of Banks Giving Citifinancial Mortgage Until 2/27/2006 to Respond!

My dad sent in a complaint to the NC Commissioner of Banks about Citifinancial Mortgage. Well, he received a letter today from the Commissioner of Banks. It is a copy of the letter that they sent to Mr. Seeley of Citifinancial Mortgage. Basically, the letter is giving them until February 27, 2006 to respond to the complaint. I bet that they don't respond and they just ignore the letter like they do to every complaint sent in to the BBB.
