Clay McGonagill Background Clay McGonagill does business under the name CMC Construction. He advertises through Thumbtack.com to do contractor work like roofing, decks, and fencing. This year alone he has conned multiple victims by starting work, collecting the final payment for the contracted job, then never showing up again to finish the work.

Victims Name: Brian Resident of: Del Valle, TX Crime Occurred: Del Valle, TX Source: Thumbtack Timeline/Story: Clay stole money from Brian’s deaf parents by taking her insurance checks from damage to her property. She has copies of everything from Clay to the insurance company. Clay got the first half of the check to start the work and wasn't supposed to get the second half until the work was done. Brian’s parents were satisfied with the results by seeing pictures of the completed work sent from Clay. They gave Clay the other check based on those pictures of a finished house. It turns out that the pictures Clay sent them were of a completely different house.

Clay also disconnected the AC unit and removed it to put in a new one, however he never returned to the house. Brian’s parents had to bear the heat all summer long and won't have heat this coming winter. His parents are disabled due to the fact they are both deaf. Funds stolen: $14,849.02 (two insurance checks made out to Rosyln Rawlins) and damage done to HVAC units Name: Keith Resident of: Bulverde, TX Crime Occurred: June 2017 Source: Thumbtack Timeline/Story: In late May 2017 I used Thumbtack to obtain bids for a new fence around our house. The bid/contractor we selected was from Clay McGonagill (CMC Construction), and we received a contract from him on 1 June 2017.

During the process of building the fence my wife and I also got estimates from Clay and his foreman, David (?) for the replacement of a sliding glass door with French doors. Clay originally estimate the cost of the door replacement, including labor, at $750. My wife provided Clay a check in that amount which Clay was to use to purchase the door on 2 June 2017. Subsequently Clay revised the price of the door by $439; this amount was paid as part of the final payment for the construction of the fence. After the payments were made and the fence was completed my wife and I repeatedly tried to contact Clay (phone and text) to find out the status of the door replacement and were told the door had been order through Lowes, but was on back order.

Eventually Clay stopped answering our calls or responding to texts, however, when called from a phone other than our personal phones he would immediately answer and provide various excuses. My wife ultimately called Lowes to find out if in fact an order had been placed for the door and was told no such order existed. I texted Clay on 27 June 2017 telling him he needed to refund the money provided for the door and labor ($1189); he responded shortly after "yes sir”, however we have not received that refund and Clay continues to ignore calls and texts from my wife and I. Funds stolen: $1,189 Name: Mary Resident of: Houston, TX Crime Occurred: McQueeney, TX Source: Thumbtack Timeline/Story: Found Clay on Thumbtack March 3, 2017. Contracted with him April 26, 2017.

Made first, second, and third payments early May as Clay quickly finished the first 25% of the work, assured us the rest would be finished 2 days later and that he needed final payment for roofing materials. After final payment of $5,000 Clay never showed again. Kept making promises to show the next day/week, and that dragged on for months until he just stopped responding. Funds stolen: $16,000 and damage done to roof. Name: Greg Resident of: Helotes, TX Crime Occurred: June 15, 2017 Source: Thumbtack Timeline/Story: Got a quote in June for privacy fence on acre lot for $9000. Clay took materials money, Started on project, asked for final payment, never showed again and never paid equipment rental company who had to come pick up equipment. Funds stolen: $9,000. Name: Linda Resident of: Universal City, TX Crime Occurred: Last month Source: HOA Scam Timeline/Story: Clay was putting up a big fence for a Homeowners Association. He passed out flyers to residents saying he would fix their Hurricane Damage to their individual fences at a discount. He took deposit money and then never came out to do any work. Funds stolen: $1300
