The Hotel Occupancy Tax collected by the city DOES NOT belong to the EDC Of Coffee City Texas.
There was never a contract with an approved ordinance delegating the EDC to administer those funds for the States EIGHT Approved functions for this tax money. The City is the authorized entity to collect and administer these tax funds, and must administer them for the EIGHT ELIGIBLE functions. (we have the open records to PROVE that there is no contract with an approving ordinance, We have proof that not one cent of the Hotel Occupancy Tax has been for any of the 8 State approved projects).
The TRUTH is all the Hotel Occupancy Tax the EDC has taken, must be returned to the city and the city MUST use those funds for the EIGHT eligible uses of this money. Failing this the Hotel owners (or any citizen) can bring suit for fraudulent use of the Occupancy Tax.
Revenue from the municipal hotel occupancy tax may be used only to promote tourism and the convention and hotel industry, and that use is limited to the following:
(1) convention center facilities or visitor information centers
(2) facilities, personnel, materials for convention registrants
(3) advertising to attract tourists and convention delegates
(4) the arts
(5) historical restoration and preservation projects
(6) sporting event that increase business at hotels and motels
(7) upgrading of existing sports facilities or fields
(8) the construction of a recreational venue

Here is a copy of last weeks newspaper article by the Mayor Of Coffee City admitting they are in severe financial trouble. I wonder why ?? Sales tax revenue is down yes but they were already in this situation before the decline in sales tax. Due to poor leadership by the Mayor and the Mayor Pro Tem . But as you see he fails to mention that.

Update : Received letter from Texas State Board of Public Accountancy. December 6 th 2011
They are investigating the audit in full due to suspicious activity listed on the audit.
