Countrywide mailed a letter stating that I was one month behind on my mortgage and that I need to send $1,102 or that I might be subject to other default related actions such as returning payments that are less than what is owed. I have never missed a payment and after reviewing my transaction history on-line at their website I noticed that a due date adjustment was arbitrarily made on my account back in March 2004 and what appears to be a double posting for the month of March.

This due date adjustment is what caused my payments to be late. I contacted them in writing and at their on-line message center asking for an explanation and I only received a reply (with no name) that they will be researching and get back with me. They stated I would have an answer within 10 days. 43 days have passed and still no letter. I wrote them again on 10/13/04 and also filed a complaint with the FTC and the Georgia Department of Banking and Finance. I also spoke with an investigator working for a Florida law firm who has filed a class action law suit against Countrywide for them purchasing insurance without authorization when home owners had actually purchased their own private insurance.

This company has rip-off written all over them. I went ahead and sent them the $1,102.00 just so they want proceed with other default related actions. When I receive feedback from the GDBF and FTC I will update. If anyone else has had similar problems like I have please let me know.

I wrote the Georgia Banking and Finance Commission and they contacted Countrywide and gave them 15 days to respond or they would be subject to having their real estate license revoked. Countrywide did adhere to all of my demands, which was a refund of all late fees assessed and a letter to all of the credit reporting agencies requesting that any derogoatory comments be removed.
