We had a fire August 15th 2008, contacted Countrywide Homes who issued a insurance policy to [ as they say to protect their interest in the property.

When the restoration started the city of Chesapeake , State of Virginia , and the United States building Code states that in order for the house to be occupied again, it must be brought up to code. When the house was built it was up to code 15-20 yrs earlier. The codes changed over the years. The house was brought up to code. When we were told by Countrywide for us to do the restoration on the house, we did just that nothing extra, only the bare minimums to make the home liveable again and to comply with state and federal Mandated codes.

Well now that all is said and done, Balboa Insurance comapany which is owned by Countrywide Homes inform me [ the contractor that they do not cover for Code upgrades.

how can it be considered an upgrade if this is the bare minimum that federal law say a home must have in order for it to be lived in. An upgrade to me is if the homeowner said hey i want you to install a fireplace for me even though i never had one.

So here we are Countrywide Homes says they are not paying it, Balboa Insurance company [ remember they are owned by Countrywide ] says they are not Paying for it, the homeowner doesn't have the extra 28,000.00 it took to repair this home but yet Countrywide says we took out the policy because because homeowner didn't have insurance on home and we had to protect our property, in case homeowner defaults on property we can go into fore-closure and take our property back and resale it.

it is against federal and state law to sale a place that you know is un inhabatibable.

so i am now left with the options

1] take a 28,000.00 loss for my employer - don't think so i don't think i will keep my job long like that

2 ] refuse to get a final release on the home from the city so homeowner can move back in until my money is paid.

3 ] if i do this homeowner will surley refuse to pay a mortgage for a property that she can't live in, thus forcing fore-closure, meaning Countrywide takes back their home meaning i still do not have my employers 28,000.00 with Countrywide and their Sister company refusing to pay for repairs.
