We lost our business a few years ago and fell behind on payments with Countrywide. We entered into a modification agreement in May 2006 that was to add all deficiencies to the principal amount and we would basically start over and make payments from there. Less than 30 days after our first payment they notified us our payment was going up nearly $400 per month due to our escrow suddenly being nearly $3000 deficient.

When the modification was figured about $2800 was added to the principal to bring the escrow account to a positve $1200. When we asked how our escrow could possibly be a negative $3000 dollars, the answer was always something like "your taxes or insurance must have gone up." Knowing our taxes could not have made this difference(our taxes were $1200 every 6 months) we asked for a definite answer but nobody at Countrywide could do that.

We made a 2 month payment that went totally to escrow and none to principal or interest. We told them we wanted this resolved right away. We would always be referred to a different department or person. Nobody could give us a solid answer. It took one representative 45 days to simply find our file! They would not call us back or respond to any of our letters.

Our foreclosure sale date is now set for Sept 15. My fiance is subject to lose her job because of this credit hit. We want to sue, but need a great attorney. It seems everybody we talk to is "scared" of Countrywide. We are open to any type of recourse against Countrywide because they have ruined our lives as well.

Are not afraid of Countrywide, they are afraid of losing cases due to no legal leg to stand on. Contracts were signed such as your mortgage loan and what they are doing may seem illegal it isn't, like every business that creates a loan they are protecting their interest. Lawyers do not want to take no win cases that would commit them to numerous hours ending in failure even with a retainer.

Lawyers are not afraid of Countrywide Mortgage.If come to the table with a retainer lawyers will jump all over Countrywide Mortgage.
