Bazar/McBean of Okville, Ontario with offices in Ohio,were given the simple task to file the last and final tax return for deceased school teacher David A. Jones's estate of Oakville,Ont,Canada. All documents necessary to complete such task were delivered to Bazar/McBean at their office in Oakville, Ontario. David Bazar is also licenced in the state of Ohio.

After the tax return was completed David Bazar contacted Donald Hawley / executor of estate, and was asked by David Bazar to send him the sum of $40,00000 to pay any overdue taxes or penalties if required due to the untimely death of David Jones. The Canadian officials receied an undetermined amount from David Bazar provided by the Estate of David Jones. Several months later Donald Hawley contacted David Bazar to inquire the status of the return.

A few months later David Bazar reported to Donald Hawley that the 2006 Canadian Personal Tax return for David A. Jones had return to the office of David Bazar of Bazar/McBean. David Bazar forwared from his trust account a refund check in the amount of $17,196.09 along wth the return? For his fee's Ddavid Bazar charged the sum of $5,995.00?

That means the Canadian government kept $16,808.91? David Bazar claims that he is highly qualified and highly paid Chartered Account? Then why did he insist the sum of $40,000.00 be sent to settle the tax affairs of a deceased public school teacher that had been retired since the early 1980's.

If David Bazar is great why didn't he ask for $20,000.00? I can see a Canadian or American corporation paying an accounting firm the sum of $6,000.00 for doing their taxes...but not a retired school teacher.

When David Bazar was challenged about his fee's schedule by Donald and I he denied any wrong doing.

After several calls to Bazar / McBean we got no satisfaction. Later that week we contacted Tatiana Rabinovitch of "The Institute of Chartered Accountants" of Ontario. After verbal and written complaints by us, David Bazar denied any wrong doing. He claims that his fee's of $6,000.00 is typical, and that all his clients of simular status will experience that amount for a tax return. Last year my accountant charged me $500.00 to file my 2007 tax return and I'm the president of a Corporation located here in Tennessee and make a six figure income.

Ms. Tatiana Rabinovitch of the "Chartered Accountants of Ontario" reccommended that all parties involved partisipate in a Fee's Dispute Mediation service held by members of the Chartred Accountats of Ontario. David Bazar's own peers! But believe it or not David Bazar refused. What is David Bazar afraid of. If all retire senior citizes of Canada pay $6,000.00 for a tax return, what is David Bazar afraid of. My only recourse now is to seek legal procedures. And as for "The Chartered Accountants of Ontario they are just Paper Tigers.

The complaint is about the Cost of work done for the Estate of a Canadian who died in the US and the executors of the Estate are Americans. As one might imagine, the cross-border implications are anything but simple. I am a well known international tax specialist with over 30 years of experience. Relatively few tax specialists have the training and experience to deal with this kind of situation and I regularly am referred clients by other tax specialists for that very reason. The continuing professional development time required to keep current with Canadian AND US tax law is significant and, frankly, not everyone is willing or able to do it and do it well. For that reason, my hourly rates are somewhat higher than average. Currently, my hourly rate is $400.00 per hour and, unfortunately, most of the work that I do cannot be delegated to junior staff. Only clerical assembly is delegated. My hourly rate is very competitive with hourly rates for other international tax specialists in Toronto. I know that Partners with similar knowledge and experience to mine at the international firms charge up to $950.00 per hour and more for their time. The fact is that I am very cost competitive and regularly have to turn away work. In this case, the executors called me often and asked me to explain my work in detail and repeatedly. The consequence was that more time was spent and more time was consequently billed. A complaint was filed with the Ontario Institute of Chartered Accountants, which performed a thorough investigation and determined that there had been no breach of their rules. Their rules are strict and Chartered Accountants are routinely disciplined, as can be seen on their WEB site. They are no paper tiger. Rest assured that if any of the complaints were valid, I would have been sanctioned. I am sorry that the complainant was unhappy with the cost of my work; however, I do not believe that they were unhappy with the quality of the work done. As they say, the sour taste of a bad job is remembered long after the sweet taste of cheap price is forgotten.
