The parties can get legal advice before Small Claims court, but attorneys are not allowed to represent the parties. Likely, the attorney is his regular attorney and as a favor to his client, wrote a letter for him, etc., mainly for the purpose of intimidating you into dropping the case. I would also put pressure on your bank to do a chargeback, being that you returned the merchandise and are getting no cooperation on the refund due. Before they get a chance to tell you "no", have your documentation in hand.
