My wife went to Don herring to BUY a car. We wanted Something for us and four children. We saw the advertisement zero down. When we decided on the Montero we wasn't qualified. I called my mother and she agreed to co-sign for us to get whatever we wanted. So we decided on the Diamente.

The salesman told us that we didn't qualify for that car either. We told him that my mother was going to co-sign for us. We told him that she didn't live here in Texas. He said that he had to talk with the finance department. So he came back with the okay and we called her on the phone. He talked with her and he asked her for her social security number and driver license number to run a credit check. He saw that she had A-1 credit he ask her could she fax in a copy of her information.

Talking with her he told that she would be co-signing for us to buy a 2002 Diamente. She agreed to fax the information. He told her that since she wasn't here in Texas he could Fed-ex her the contract and he will high the area she would have to sign. He told her that the Guy will bring the contract to her and all she has to do is sign and give it back to the guy. He lied because we all thought we was buying this car. Now we are stuck with this car and a big family of 7 now. We can't trade because We will be upside down and 23,000 still owe and they are reporting us late. What Can I do. Is there a Class Action Lawsuit Against Mitsubishi. Can I get some Help!!!!!!!!!!

#2Consumer Suggestion

Greg, I understand the frustrations one can go through when purchasing a vehicle. It is sometimes more trying than buying a home! As a matter of fact, purchasing a vehicle is the 2nd largest investment that almost every American will make in their lifetime. It is a very big deal! Based upon the post that you made, I cannot understand what your complaint is, other than the amount that you owe on the car, and the fact they "they are reporting you late" on your credit report. The only reason it will be reported to your credit report is if you DONT PAY FOR IT!!! You also have to be 30 days late for it to be reflected on your credit report. That means avoiding a LOT of phone calls from your creditor (you know, the finance company that let you borrow the money in order to obtain the vehicle). Here's what you made clear in your post: You wanted a Montero, but didn't qualify. You wanted zero down, but didn't qualify. You switched to a Diamante, but didn't qualify. At that point, you should have either left to find something that you were going to be happy with, or sat down with your wife to discuss what was more important for your family; an appropriate vehicle to suit your needs AND that you could afford, or a car that looked cool but couldn't really pay for. I fail to see how the dealer was at fault for getting your mother to co-sign with you so that you could satisfy your personal gluttonous desires, and now for you not making the payments on the vehicle. Dealers do not wish for their customers to default on their loans because this reflects poorly on the dealer's portfolio with each lender that they do business with. If the dealer sticks the lender with a lot of underperforming loans that go into default, then the lender will cut the dealer off from doing business with them. This in turn takes away from the dealer's profitability and hurts their business. I hope this isn't too much to understand, but it appears to me as an outsider that there was no common sense applied here by yourself, your wife, or your mother. You had to have what you wanted, and now you are paying the consequenses. As for the last rediculous comment regarding a class action suit? You have GOT to be kidding me.... sue the manufacturer of a vehicle that you purchased, which wasn't even new at the time of sale, for the rash decision making of yourself and your family? That's the American way I suppose, isn't it Greg? Give me something for nothing? Is that what it says on Liberty island? Please. Skylar Dallas, TX

As a three time purchasing customer from Don Herring, there has never been an unclear moment in what I was buying and I will continue to purchase from Don Herring. I have found the sales, service and management staff to be very friendly, courteous and forthright in their dealings with me, my family, and friends I have referred. I do not live in the area, and when purchasing a vehicle; I have driven over 8 hours just to deal with Don Herring sales. I have only had one complaint, one year after the purchase of a used vehicle, and that was taken care of with a phone call, and the problem was solved at no cost to me. It would seem from you original complaint, you have not made your stance clear to the right people at Don Herring. I am not sure how a person does not realize what they are buying, especially when they get their mother involved, but I guess anything is possible. None the less, you have yourself in a pickle of a situation, and my suggestion is to sit down calmly with the General Manager at Don Herring to see what your options are. It worked for me with just a phone call, and I believe it will work for you. If not, the Texas Attorney General, has a Consumer Protection Unit right there in Dallas who deal with situations like this. However, they do not cure bad financial decisions made on the part of the consumer.

This is a straw purchase

Well here is a classic catch 22 case. You could call mmca and tell them that you have the vehicle and you mother purchased the vehicle. but when you do this will alert mmca to fraud and then. mmca try to come after your mother. So you mean to tell us that you had no idea you were purchasing this other vehicle? if this is true. I would contact mmca. and tell them exactly what happened. In case I have lost you. A straw purchase is when a consumer uses someone elses credit rating to outright purchase a vehicle. this is fraud to a bank.. basically the dealership told you to lie and use your mothers credit to buy a car. this is illegal. it is up to you on what the next step is.. me personally I would get the payments caught up. and keep them caught up until this is resolved. hope this helps
