Horse Transport Review   Double HH Ranch Transport (Vicki Henderson) located in SW Michigan. I have had Vicki on my friends list following her for awhile and keeping up with her transportation posts. I figured she would be a good candidate if I ever needed a hauler. Well, in June I adopted a gentled yearling gelding from The Mantle Ranch. I contacted a few people about pick up prior to adopting but their quotes were too high. I settled on Vicki and thought he'd be in good hands. We discussed it, she agreed and said she would pick him up in her 2 horse trailer. I was told he'd be available in approximately 6-8 weeks to pick up at Ewing Holding Facility in IL. Mid July Kayla Mantle told me that he would be shipped July 31st. He

arrived at Ewing on August 3rd. I filled out a contract on July 16th for Vicki's services. I put the date of pick up July 31st as it said on or about that day. First, she was not up front with me about all the extra fees she charged (if it took more than 20 minutes to load she charged an extra $40/hr; difficult load $50/hr., $30 fee on top of paying tolls). Second, I tried to keep her informed with updates and she was very curt about "only needing to know what date to pick him up" but ignored what I told her. I said multiple times that Ewing was open T-TH 9-4pm for pickup and she wanted me to get Marty to meet her on Sunday. Third, I never received a copy of the contract with her signature as well.   When I contacted her that he was

available, her truck was in the shop. So I contacted another hauler to see if he was available. I didn't want my young, very small gentled gelding out with untouched horses. I tried explaining this to her and she just said, "he'll be fine." Though when I told her I was going to look into using another hauler she said that was fine with her. After she still didn't have a difinitive answer about her truck the following week I said I was going to see if the other hauler was available. He had mentioned that his trip to TN might fall through. Turns out he was so I told her I was going to use him because he could get my yearling out

of holding rather than waiting for at least another week. She said that was ok again. Then when I asked for my deposit back she said she wouldn't refund me. I was supposed to put half down but accidentally paid more than half. She also had me send the money via PayPal as a gift (which I didn't realize at first) to avoid fees and making it impossible to file a dispute against her.   -The contract wasn't legally binding to begin with because she never signed it or sent me a copy of it.   --The horse was not picked up and delivered within the time period given. She originally said the first week of August would work.   --The contract stated that if the horse wasn't able to be picked up on or about the date noted (July 31st) the hauler and owner could

renegotiate. We discussed using another hauler due to scheduling conflicts and then because her truck was broke down, but she refused to issue me a refund of my deposit.   --The contract did state no refunds were given except for special circumstances like mechanical failure (her truck was in the shop) and that at this time the owner and hauler could discuss the horse's well being. I mentioned several times I was concerned with leaving him out with untouched horses being as small as he was and that I paid for a gentled horse, but didn't want to wait weeks to get him only to have him no longer be gentle. She agreed to me using another hauler but again when I asked for my deposit back she refused and said I breeched contract.   --Refer to the first section...she never even signed the contract! And according to how it was written our discussion of the issues

would should warrant a full refund.   --She said she overnighted a part for her truck costing her $250 specifically to go pick up my horse (which she wasn't even going to pick up for at least another week and a half), but more than once said she had other horses she was picking up on the route! Something she also did not discuss with me as we had discussed her using the 2 horse and going to get him! So essentially she was making it sound like getting MY horse was the reason for her paying so much for her part when 1) she was picking up more than one horse on the trip and 2) considering that is her livelihood, I imagine she'd want it back on the road ASAP, 3) when I questioned her about the refund she mentions having a vacation

scheduled like again picking up MY horse didn't allow her to go on vacation when in fact she just got back from vacation when he arrived.   --She complained repeatedly about the wait to pick up the horse after I asked for my deposit back when she knew going in that the dates weren't going to be exact. I told her 6-8 weeks before he would be available. That was pretty accurate. I told her he would ship on the 31st, accurate. I told her he would likely be at Ewing the first week of August, accurate.   VERY POOR COMMUNICATION. SHE REFUSED TO RETURN MY DEPOSIT SO I HAD TO CALL PAYPAL WHICH IS WHEN I FOUND OUT SHE HAD ME SEND THE MONEY AS A GIFT SO I WASN'T ELIGIBLE FOR BUYER PROTECTION, I HAVE TO CALL MY BANK AND TRY TO GET MY DEPOSIT BACK. HERE IS OUR CONVO AFTER ASKING FOR MY DEPOSIT BACK. Earlier in

the day she said she could try to pick him up Wed. or Thurs. (14 & 15) but it wasn't guaranteed because she still didn't have a truck....   Megan The trainer said he can pick him up tomorrow so he isn’t in holding another week. His trip to TN was rescheduled. Can I get a refund on the deposit so I can pay him? I will still leave u a positive review Megan I realize it wasn’t your fault about the truck but I paid for a gentled horse and I don’t want him out with untouched ones for another week. I have 10 mustangs here I know how quickly they revert back to acting wild. I’m not on Facebook anymore but my mom will leave a positive review for you and I am happy to recommend you to anyone needing a hauler I paid $350, not $325. It would have said from Real RocknRolla Vicki Henderson There are no refunds per contract. But you can have your friend pick up. Thats fine Megan He isn’t my friend. And there were stipulations to refunds. I paid more than half for the deposit. Vicki

Henderson And it's my birthday today and I'm not doing any business   You told me that you would be available this week for pick up and you weren’t. Because your truck broke down. I paid for a trained horse and didn’t want it left in holding with untrained horses when you weren’t going to able to pick him up for at least another week and you can’t just refund me? Vicki Henderson I have got other clients on the route this has been month-long plus wait for the horse to even get here. I had a vacation scheduled just paid 250 for part to be over nighted. Megan again I’m not in charge of their schedule! And you shouldn’t have made me pay weeks ago to “hold his spot” then act like u were ok for me to use another hauler if your schedule wasn’t working out! Then keep my $350 Vicki Henderson Schedule works just fine an hour ago I'm not going to

argue with you Megan Yea and I told you that the other hauler could also pick him up a week sooner more than likely Vicki Henderson You didn't know when the horse was coming in so you can't say that the other hauler could pick up a week earlier Megan Yes I did. I told u a couple weeks ago at least that he was being shipped out on the 31st of July and would be to Ewing by the first week of August which he was. I just spoke to my uncle who is a judge. He said unless the contract is notarized it is not legally binding. If you don’t give me a refund I will take you to court. Megan Because I do have our conversations stating that u were fine with me using another hauler. It being your truck that broke down that he didn’t get picked up on time and I told you when he would be available, when he arrived and that you didn’t pick him up as agreed to originally that is why I

went with another hauler Vicki Henderson Lawyer has approved contract, that is not true Megan I am not working with you. The contract does have stipulations about a refund. You did not pick up the horse as discussed and you also said it was ok if I went with another hauler both in the past when it seemed like it was going to be a scheduling problem for you and when I’ve been discussing it with you since I told you arrived at Ewing and you truck was in the shop. There is NO reason for you to not give me a refund especially when it is YOUR truck that is delaying him being picked up. Now it would have been one thing if you said “ok, $50 for the inconvenience” is doable or something” but you weren’t even willing to work with me. You just taking my money for NOTHING to pay for your truck to be fixed. Megan And it was extremely shady of you to have me send it as a

gift, which I didn’t realize at the time because usually create invoices for all my transactions so that I couldn’t file a dispute with PayPal however I will be contacting my bank first thing in the morning about reversing the charge on my card and if something isn’t done about it I will take you to court. Megan Lawyer approved is NOT the same thing as being notarized. I think my uncle who is a judge knows a little more about the law than you. You have in the contract that there are special circumstances for processing returns. I think the fact that you can’t deliver the horse on time because your truck is broken down and you agreed it was ok for me to use a different hauler constitutes as a special circumstance. Megan I tried keeping you in the loop from the get go and you have repeatedly not been up front with me. When I first asked you prior to adopting

the horse, you never mentioned anything about a health certificate or the extra fees in your contract. I tried keeping you in the loop about the BLM schedule being behind because it is unpredictable and you kept telling me you just wanted to know the date he could be picked up. I let you know it is usually 6-8 weeks after the auction ends before the horses are shipped. I let you know at least a few weeks ago that he we would be shipped on the 31st of July and expected the first week of August at which time you said that would just be returning from vacation then, but it was doable. That you would go get in him a two horse and now you are saying that you have other horses to pick up on that route? You told me a few weeks ago when it was apparent the BLM was behind and it was going to be cutting into your schedule that you were ok with me using another

hauler. I had found another in case something came up. I told you that it was important he get picked up and not left in holding with untouched horses. There is a difference. That the other hauler may be able to pick him up sooner and when I contacted you about the refund on the deposit, of which I accidentally overpaid, I told you he was able to pick up the horse tomorrow morning. You knew that I was disabled and living on fixed income so taking $350 of mine and refusing to refund me when I decided to go with a hauler who was available sooner is just WRONG.   Vicki Henderson Look your the one in breach of contract you were the one fine with me using a different hauler weeks ago when you figured it was going to be a scheduling conflict and again when I said I had another hauler that was able to pick him up. I told you multiple times that the holding

facility was only open tuesday through thursday 9am-4pm and you were the one wanting the facility manager to meet you on a Sunday, when you didn’t even have your truck out of the shop yet. And you said it was ok that I use another hauler a second time after being delayed because your truck was in the shop. If you aren’t willing to give me a refund I will sort it out with the bank tomorrow morning or I will be taking you to court. This is ridiculous. I am NOT in breech of contract because you did NOT pick up the horse as scheduled. It says on the contract the week of the 31st. He arrived the week of July 31st (Sunday). He arrived on the August 3rd (Friday) and you did not pick him up that weekend even though they were open Friday and Saturday for an adoption event or the following week because your truck was still in the shop. You said today i

would be Tuesday or Wednesday August 14th or 15th before you could get down there and even that was a guesstimate because your truck is STILL in the shop. So YOU are the one in breech of contract, not me. Megan Also at no time when I mentioned using a different hauler because of scheduling conflicts or your truck being in the shop did you mention that I wouldn’t get my deposit (which I over paid) back if I went with another hauler. All you said was “ok” and “it was ok if I wanted to go with a different hauler”. You didn’t say anything about not getting a refund until after I directly asked for a refund of the deposit. You knew this earlier this afternoon that I had spoke with Marty about possibly having another hauler pick him up sooner because you couldn’t guarantee your availability. Furthermore, you are supposed to be a professional hauler. Your contract mentions the horses needs being met accordingly. Well when it is a young gentled horse left out with untouched older

horses for weeks because you aren’t available, that also isn’t keeping in line with the agreed upon contract is it? I expressed my concern about his well being more than once. I have 10 wild horses and I am well aware how they behave with each. So your nonchalant “he’ll be fine, they are taken care of” is not for you to decide. So when I was open with you about my concerns and this other hauler’s availability and you say it’s ok, as the client I think that is, in fact, ok to go ahead and use another hauler to pull him from holding as soon as possible and that you would do the right thing and refund me my deposit for not being able to fulfill the contract on time. Megan Client, at Client’s expense, shall tender all necessary travel and veterinarian documentation to Henderson at the Pickup Point on or about the _ 31st _ day of _ July _ , 2018 (“Schedule

Date”). Client recognizes and acknowledges that circumstances inherent in road travel may arise (including but not limited to weather, highway hazards, ,mechanical failures and road closures may force delays, and welfare considerations of all horses in transit) that would preclude arrival of transport accommodations at a precise date and hour; however, both parties agree to utilize utmost diligence in adherence to said Schedule Date and to cooperate in subsequent delivery with communications given at regular intervals. Even the contract says if there are delays that the horse’s welfare should be taken into account. Megan Refunds only if mechanical issues, transportation can not be done on timely matter, unless reschedule is agreeable with both parties. Megan I also stressed on more than one occasion my concern for his welfare being left in holding having already

been trained. So again, I said I found a hauler who could pick him up sooner, and you said ok, you are agreeing to me using another hauler due to delays because your truck was in the shop. Megan There is absolutely no reason that I shouldn’t be giving me a full refund of my deposit. Which is $350, not $325. Since I made the mistake of actually overpaying on the deposit and did not witness you signing the document or have a copy of the contract signed by you in my possession then we really don’t have a contract and I do believe a court would agree with me. Megan You did not send me a copy of having signed the contract. Therefore, we have no binding contract. Megan And I am NOT responsible for the care and upkeep of your vehicle you use for your business especially when you admitted you had other clients on this route. One could easily say that

you paid $250 to overnight the part just so you could get your truck back on the road and making money again. But by claiming that it specifically had to do with MY horse is ludicrous especially since you weren’t even planning on picking him up until the Wednesday or Thursday of the following week! Vicki Henderson Look you can make up stories all you want, told you a fuel line qas being fixed on truck 2, as i do things safely. You order ppl to get you horse right away. There ia routing that needs to be done!! Cant go empty all the qay down and only you horse. Or are you just that type of person you would rather have a truck catch on fire with your truck and trailer with your horse in it cuz this is what you sound like nd you want to put about mechanical issues that's if the truck cannot be moved say the engine the transmission went out and I couldn't possibly

get to your horse it's a simple gas line special order part that is not in stores we found a place instead of four to six days for delivery found a place that I could get it overnighted, due to needing it asap.. your the one that was fine, then hour or so later change up again..you got someone else like you have for a month.. you have breached contract Megan As far as I’m concerned we have no contract that I am in breech of, for the number one being that you never sent me a signed copy of it. It would be thrown out in court. I’m not telling stories. I’m telling you facts. I’m calling the bank in the morning and having the charge reversed since you are unwilling to refund my deposit. Vicki you breech contract. All done. You have someone else to do now.
