To all Drive Financial People... Please support me in the class action law-suit I am filing against Drive Financial. I am convinced that there are enough of us who have been lied to, cheated, and/or harrassed. I have been with the company since 01/04 and every since it has been hell. I have paid car payments in advance, they have "lost" payments, and I have paid additional fees that were "hidden." It has been a nightmare. I have spoken to an attorney who says with enough of us, we can win.

I am not the lawsuit type, but this company has pushed me to another level. I am an educated indiviual, who has had a series of unfortunate events occur in my life. I am a Special Education Teacher in Birmingham, AL. I teach children identified as being Autistic and Mentally Retardation. I love my job, and my students. I also have a high level of patience... until I started dealing with Drive Financial... it is utterly ridiculas.

I got a call from them last night.  Apparently, a due date is not a valid thing to go by with them.  I have a week according to the due date but they stated to complete the loan application they required the loan payment immediately.  I called the dealership and they stated if I did not make the payment as requested then they would take the vehicle and I would not get my trade or deposit back!!!  What scammers!!!  They still do not have the loan processed, but they are already calling to harrass me!!!  Count me in!!!  Apparently they need to be taught a lesson!!!!!

Does not apply to original creditors. Just bill collectors. These rules to not apply to drive time if they are the original creditor.

All of you that have problems that violate debt collection laws go to the Attorney General's website and look at debt collection laws if they are harrassing you in any way they are violating the law, you don't have to file a lawsuit, the Texas Attorney General will sue them for deceptive trade practices he does it all the time to companies that take advantage of consumers or contact the Consumer Credit Commissioner 1-800-538-1579. If they get enough complaints they will have to look into them. Stop talking about a lawsuit and report them!!!! Also read the list of lawsuits the AG has already completed.

I am a resident of Alabama and have had for the past year, "issues" with Drive Financial and their hellacious attempts to get money out of me. I paid my payments, on time, regularly all of last year. When I got a job transfer near the end of the year, they said that they would tag two months of payments to the end of my lease, so I could have these 2 months to catch up and afford moving expenses etc. A few months later I get calls from family and friends saying Drive has been 'blowing up their phone lines' looking for me! I call to see what the hell is going on, and they 'claim' that NO, my payments did not get moved to the end of my lease and that I owe them (plus interest and late fees now) approximately 2k! LMAO!!! Are you kidding me>!? The person I talked to was all nonchalant as well.....like 'Yes, so If you could just mail us that check by Friday...'....I'm like ...WHAT?! Are you crazy!? EVER SINCE THEN, Drive has been a pain in my @$$. They call non-stop. Make threats to tamper with if not hender my MILITARY CAREER. Who ever is behind the regulating of the 'Fair Debt Collection Acts' of this company needs to be FIRED PRONTO! This company is OUT OF CONTROL> VERY RUDE. Absolutely NO customer service skills. RIP offs! LIES! DO NOT get a loan out through this company! You will be SORRY!!! Tell any and EVERYONE you know that needs a car...RUN when you hear DRIVE FINANCIAL as an option!! If I knew I was going to have to put up with the insanity from this loan company...........I would have GLADLY just gotten a BICYCLE!!!

I made what I thought was the last payment then was told there is still 2,500+ in fees outsanding. While I'm researching what the charges are I continue to make the regular payment on the normal due date and have told them i DON'T agree with the charges as I don't know where they came from. I've requested a detailed history of th account to audit and until I cn review I will not pay the whole balance. In the meantime they are reporting the account 90 days past due even though I make the regular payment because they want all the fees at once. They also call my work and my command cell phone at least 5 or more times a day. Everyday. I've asked that the calls be stopped; but they won't until the fees are paid and they will continue to report the account past due. I'm a financial analyst/accountant so I work with finace and I have never came across a company like this one. This account is in my husband's name only and I have explained that he is currently deployed but they still call and harass me at work. My husband and myself would be more than willing to join your law suit. I have had it with these people.

i have been with drive financial for one and a half years. since that time they have called my manager and told him that my car was going to repoed if they could not get in touch with me. then just a month ago, they called my place of employment and told the manager that i said that she (the person from drive) was to speak only to me about her drycleaning. (i work in a drycleaners). they have told my business, called my son's girlfriend, whose number i have not used, and harassed her. i have even told them they are not to call anyone that i do have voicemail and they can leave a message. so if sheila from birmingham reads this i am willing to go in on the class action lawsuit. just let me know what i need to do.

TO Hooseier08... Believe me they are there in the wings, I wont say they are all white, because my store did have some minority managers. Who else is gonna do the work while they play golf? As a former CSR for a large home imporvement retailer, I have been in this position on numerous occasions. These managers (Black, White, Hispanic and otherwise), hide out in the background and feed the CSR information to give to the customers. Their rule is to never let them speak to a manager unless they are overly irate or threatening. Then reluctantly, the higher ups will speak to the customer. When they do, they coo and coddle the customer like the initial CSR was some kind of idiot and they have no idea what the CSR was talking about or why they were giving misinformation, which they were coached by the manager to give in the first place. However, unlike Drive, our company usually tried to please the customer and they had credit accounts with limits and balances equaling as much as car loans. Drive is just a bunch of crooks taking advantage of our country's high unemployment rate and people's desire to earn an honest and legal living. While actually they are turning a legal living into an illegal living because they are making these people break all kinds of laws. They are just probably not educated enough to realize it. On top of all of this, I guarantee you that at least 80% of these CSRs have collectors calling them daily as well. Isnt that ironic!

I agree that this company needs to be reprimanded for the harassing customer service agents and the money they are ripping off from people but you say that it is all White people in management...Well I have dealt with this company for almost four years and I have never spoken to a white person... I either get a Hispanic or Black person and that includes the times I DEMAND to be put through to management.. So I question where all the "WHITE" people are you speak of????

You know what is so funny? is why would someone who does not have a problem with Drive even be on this site defending them, unless they were actual employees of Drive. There are more people who have a problem with them than people who do not. Even though there are some people on here who could be telling a poor me story, I am sure there are many more people on here who are really getting taking for a loop. I am one of the people on here who feels like I am being taken for a loop, but I am actually doing something about it. I am not sueing anyone at this moment, but if any of you would like to know what I am doing please feel free to contact me via email. My plan calls for everyone who is going to do this with me, that we all do it at the same time.. One person may not make a difference, but if we can get as many people as possible to do this then that will make the impact even more. So please email me.. We may even exchange phone numbers if you feel that what I have planned will work. P.S. this is very legal, I work in the field of law enforcement, and will not do anything to put my career at risk. To you ROR aficionados out there, take this thread as an example of how serious the crybaby, whining 'class action lawsuit' drumbeat really is. These morons have been blathering on about a fictional lawsuit for three years, and all they have won is lost time posting meaningless rebuttals and giving each other high fives. People, get a lawyer and file a suit or shut up about it. Your drivel has made the leap beyond pathetic at this point.

Sat, May 10, 2008

Everyone wants to file a Class Action Law Suit against Drive Financial, but no one has said who to contact or where to begin. I typed in Drive Financial Law Suits into the search bar and I came up with 2 lawyers so far. Here is their contact information: Richard Tomlinson Phone: 713-627-2100 ext. 219 and Brennan Wiener Phone: 888-453-6665. It would help if we could contact one another not to complain, rather to ban together and see what we can do. I will ask my attorney who won the Phen Fen class action suit if he would be interested in this case as he has handled many consumer class action suits. I am willing to give an email address...NOT FOR COMPLAINTS...BUT FOR CONTACT INFO SO THAT WE CAN GET THIS LAW SUIT GOING!!! JUST GIVE YOUR NAME, EMAIL ADDRESS AND PHONE NUMBER AND THE BEST TIME TO REACH YOU...THIS IS FOR THE SERIOUS ONLY...AGAIN...NO COMPLAINTS, JUST ME ORGANIZING TO FINALLY REALLY DO SOMETHING ABOUT A LAW SUIT AGAINST THE PREDITOR DRIVE FINANCIAL, DRIVE TIME OR ANY OTHER NAME THEY GO BY. Please contact me if you are serious about a class action suit against Drive Let's give these suckers a taste of their own medicine!!! Thank you

First I would like to clarify something, not everyone who finances with drive has poor credit. I purchased my vehicle in May 2006 from Adamson Ford: Birmingham, AL, and since I never had any high credit on my CBR I financed with Drive so I would not have to find a co-signer. Since then, not only am I paying $882 per month on a $30,000 loan, I have had several problems with my vehicle. This past Dec., the motor went out on my drivers-side window, my VDC (vehicle dynamics controls) had sliped, and both front brakes had to be replaced which cost me around $1500. The problem with this is, besides the obvious that I had only had the car 6 months, 1. I was informed by the service department that if the car had been thoroughly prepped before it was sold, then the brakes would have shown signs of severe wear and should have been replaced before the car was sold and 2. the extended warranty in which the dealership sold me and told me would cover everything bumper to bumper for 2 yrs wasnt so, hence why I had to pay the service amount myself. Not only that, this past Mar, which is 3 months after the Dec repairs, my check and service engine light came on. Not only did I go to Adamson Ford with my grievances, where I was told they would do nothing for me, I made Drive aware of the situation, in which they have done nothing either. I then filed a report with the BBB, only to find out that in the state of Alabama, a consumer cannot go after the selling dealership with a lemmon law complaint, the consumer has to file a complaint with the manufacturer of the car; and its not their fault Adamson sold me a $30,000 piece of crap. Nor have I been reimbursed the amount for the extended warranty which was sold under false pretenses. And yes I have too been a day or two late with a pmt and have had rude calls made to me and my refs. They will ring your phone off of the hook for their $$, but when you have an issue or complaint they just ignore it. Not only that, my bill says I still owe like $31,000 and some change for a car that was financed @ $30,064 and I have been paying dang near $900 per month for a year. They are getting away with highway robbery and it needs to be stopped.

We bought a Dodge Grand Caravan SE and we had good credit and they took us not sure why though. But since Oct. 2006 we have made all the payments through Western Union Quick Collect that adds up to make sure that get the payment and that way there is not late charges. Well let that payment be due on the 26th they will call on the 24th my cell phone 8 times and then call my husband on his cell phone more than mine for sure in one day we counted 21 calls in 1 day. Well I just discovered the other day pulling a carfax that my van had been wrecked not once but twice and I was sold this in North Carolina the dealer knew this Griffin Suzuki in Rockingham, N.C. well I am looking for another car because there is alot of mechanical failures with this van such as ABS is going out van fails to stop, lossing a gallon of water every other day and can't figure out where it is going because it never overheats, gas smell and we can't figure that out, skips all the time cuts off in the middle of the road almost got me killed the other night, rattling sound can't seem to find that it is the kind of rattling that when you are driving down the road it gets louder. I took it to the dealership and they act like I am stupid and say there is nothing wrong with this knowing that they SOLD ME JUNK $18,000 worth of JUNK! I have contacted Drive they act like they could careless about the issues and the van being wrecked they are like SO and talk to the dealership OH YEAH RIGHT already have. I am tired of the harassing calls the nasty remarks they make and calling 21 times in 1 day that is a record. I am in the class action suit count me in.

I will take these emails to an attorney, because this has been going on for too long. Lets stop typing and lets get the names of the dealerships, mine was Edwards Chevorlet in Birmingham alabama. I have had my loan for less then one year with Drive .. I have paid them approximately 1500.00 and they say I still owe them over 1K. I received a call from a Ms.Lewis , a "June", Mr. Nathan Jones, Natalie Killgore, and now a Sherrie who says that she is the branch manager. They told me that I still have to pay 160.00 that I paid this morning using my debit card or they would come and pick up my car. I told them that I gave my payment to a rep this morning. They claim once again they didn't get it and i have 15 minutes to give them a call back with an additional payment of 160.00. I asked them why my balance keeps going up each time I make a payment and no one at the company can answer me. They gave me the run around and tried to change the subject on what I was asking. I don't know any finance company that didn't know the balance of an account and where it came from. I am in with your lawsuit. They need to be stopped.

I am a customer of Drive as well as a collector of over 10 yrs. I sent them a payment in Dec. 2006 by way of money gram they claimed to have never recived it. I faxed over a copy of the reciept, again they claimed to have never received it. So I contacted Money Gram and confirmed that the transaction was complete and the transfer was completed. I advised Drive that this was an error on there part and they needed to correct the issue. They replied by sending a repo man to my house. However they were not able to obtain the car. Lucky for me I had worked for the repo company in the past. I refused to make another payment on the car untill the payment that I made was located. They continued to contact all my reffrences asking them if they would make a payment on the car. Now FDCPA does not apply to them (they are the lender not third party) however there are things of ethics that should apply. It has been almost 4 mths now I still have the car and somewhere around 42 messages that have been saved not only from me but my reffrences as well. They even told one of my reffrences (also recored) that if they did not give the location of the car up that they would sue them for not disclosing information. So to who ever is interested I would be more then happy to be apart of your lawsuit. Christina

Drive Financial was a creditor listed on my Chapter 7 Bankruptcy and it was discharged on July 2005. They were in contempt of court by continuing to report to ALL of the credit companies that I still owed them money. I think NOT. As one of the creditors listed, my debt with them was wiped out. They have ruined my credit even after my bankruptcy. Yes, count me in, I have documentation to prove this. They owe me for damages for ruining my credit after Chapter 7 Bankruptcy discharge date of July 2005.

I was also a Drive customer. I am still having problems with them, even though my vehicle is paid for in full. I called the Attorney General's office in Texas. They referred me to Mark Baker at the Office of Consumer Credit Commissioner-1-800-538-1579. He instructed me how to handle my situation and also had me go online and print out a Consumer Complaint Form which I filled out and faxed to Mark with other proof of Drive's illegal activities. I also did the same thing in the state where I live only this time, I was instructed by the Attorney General's office here to contact the Department of Commerce. They watch over consumers problems with Financial institutions and lending companies. Again, I downloaded the Complaint Form and faxed it in with the additional info regarding Drive. Don't get MAD...Get EVEN! They do illegal things and they must be turned in immediately. And yes, I will also help in a lawsuit. Good luck to everyone and take action on your own now.

I have been dealing with Drive Finacial since 2001. I got behind on my payments and have had the same issues were you talk to one representative and set up a payment plan and then someone else calls and says that there is no record of that and the amount needs to be paid either over the phone or western union by before they closed that day. They have also left messages that I would answer the phone and hang up on them to avoid talking to them. They make payment arrangements with you and then the next day start making threating calls. I thought I had an arrangement set up with them when I had to be hospitalized for sugery and later on that month they repossed my car. So, I am all for a lawsuit because I only had like 6 payments left and had made arrangements and they still picked up my car.

Class Action

#52Consumer Comment

Sun, December 17, 2006

I have been reading rip off report for many many months now, from the first few weeks that my nightmare with Drive Financial began. I was diagnosed with thyroid cancer in may of 06 and have gone thru the gamit with Drive. They have gone so far as to tell me that if I made my payments over the phone with a check that I would not be charged the 10.95 per payment only to find that they have taken it anyway and when I asked why they said that it was a one time thing and refused to give me the money back knowing that it was part of the funds that I need to pay for medication. There seems to be no hope, I have looked on Ripoff report everyday hoping to find a class action suit underway or a notice of one in progress but there is nothing all I see are more and more people being taken advantage of while the powers that be sit back and let it happen. We can all keep posting our stories here and hoping that someone will do something but I really don,t think that there is going to be any stopping this company, if by a miracle there is a class action I will be right there in the front If I am around to do so. And ya know the sad thing is that If something happens to me my estate would pay the car off but who's to say that my family would not have to endure the nightmare that I have gone thru allover again. A company that would promise someone something and take it away knowing that it might mean life or death for that sick person with no feeling what soever is a company that needs to be stopped

I bought a new car in 2002. I got behind one payment, but kept making payments after the missed one so even though for years I was continually making payments, it was showing that I was behind because of the missed payment. Drive was not willing to bring my account current. that is until I threatened a lawsuit. I got an attorney because Drive was contacting people who they had absolutely no knowledge of me even knowing EXCEPT through my cell phone records. They were accessing my cell phone call log using my phone number and social security number (and informing the people that they contacted that they were looking for me because I didn't pay my bills!). PLEASE BEWARE OF THIS. Make sure this has not happened to you. I had a lawyer send them a letter calling them out on it and all phone calls immediately stopped AND they brought my account current. At that time, I did not have the money to proceed with my suit but my situation is wholly different now so I can very well sue them (and probably will have to because my car is supposed to be paid off in April, I was going to pay off the principle or the balance if possible in January, but when I called today to get that amount, it is off by over $2,500!). I WILL NOT be a victim of drive. Once I think I'm done paying this car off, I will get my title or sue. So if anyone has already started a lawsuit I would be more than happy to join. And to the lady who said our credit sucked and blah blah blah, I am now a law student and regardless of how bad your credit is a company cannot legally treat you the way Drive treats its customers. Just like you assume everyone who uses them has bad credit. they are even more aware than you as to who really has bad credit or not (not going off of an assumption as you are) therefore, they assumed the risk of not getting payments when they decided to approve the loans in the first place. But as I said, they STILL, no matter what, have no right to be downright illegal in their tactics for collecting whatever payments they are owed (or think they are owed).

Here is what I did: I read the Web site for Drive and these postings. I found out that Drive is held by Bank of Scotland in NYC. I called and asked for the Legal Dept. I spoke to Frank Tericino who refered me to Craig Smith who was sent there by Bank of Scotland because of all of the internal and external problems. I have also experienced the lies, belitting remarks, excessive phone calls all hours of the day and night 7 days a week and also on holidays. If any of you have delt with "Trey" and his crew you know what I mean. He even went so far as to call me from his home phone on his days off!!! One time I was calling in a payment and Trey took the phone from the rep and started to call me all sorts of names and telling me to make a payment. The people in the office were in the background cheering and whistling and clapping as he belittled me then when I told him I was calling to make my payment, he hung up on me and since our numbers are programed to go to the rep, no one picked up. A month or so later, Trey called once again and I told him that I was on the phone with the doctor because my daughter was very ill and would have to be hospitalized and I would call him in 5 minutes. He told me that I need to decide what was more important, my daughter or keeping my car. I hung up and called back 5 minutes later. He acted like a JILTED SUITOR and told me I had my chance and blew it and hung up on me without taking my payment. I continued to call and he would not pick up the phone. I called my son and asked him to make the payment for me. Trey refused the payment once again. The next day, Trey called my son's cell phone and started to question his relationship to me and what type of a relationship it is. My son...a future lawyer told him it was none of his business and not to call him again. Then, on Christmas Day, at 6 PM, when the office was suppositly closed, I got a phone call from a female rep and I could hear the laughter in the background at what she was saying while she was also laughing as she was saying derogitory remarks. As for the lady who said that all of us are with Drive because our credit sucks and it is not the lender's place to have sympathy for us when life throws a curve must be a Drive Collection Rep. As for me, I didn't have bad credit, but when my husband died, all of his debt went on to my credit report and I was resposible even though we had not lived together in almost 10 years...so, not all of us are deadbeats...some of us have been hit hard by life...it doesn't make us bad, it makes us cash poor, but not irresponsible. She said that she lost her job, home and car...I wonder what she was doing to fall on such hard times...would it be fair to judge her and think that she must have been strung out or drunk??? That would be unfair just as it is unfair of her to ASSUME anything about the others with complaints...if she had read carefully, she would have noticed that most of us were paying on time...unlike her. Again, let's get the information about these attorneys out here. There are enough of us that we can put them out of business...after all, if you read their web page, you will see that Drive is a 5 BILLION a year company and growing.

My boyfriend bought his car through Drive Financial and when he lost his job and fell behind I made a couple of payments for him. Since then they call me 2 or 3 times a day while I am at work if he is late. Each time I tell them to call him since I have nothing to do with it. Today I called to let them know he will be making a payment once he gets his first paycheck and they told me it wasn't good enough and that he will have to call to make arrangements. I asked why she couldn't just talk to me since he has authorized them to talk to me and she said she "just couldn't". I asked what the buyout is and she told me she didn't know and hung up on me. Since that I have gotten 2 more phone calls today from them looking for the payment. This harassment is unacceptable and we want to be a part of anything that can be done to this company.

I am currently financed with drive financial and have done something none of you seem to have thought of to avoid these problems. I pay my bills. On time, every time. It is not your finance company's job to feel sorry for you because you got sick or lost your job. I lost my home last year. Am I screaming about the money I still owe them? No- I didn't pay them, so I owe it! You can mail Drive a check for free. You can send it certified, return receipt for a couple dollars and have proof that the payment was delivered and accepted. You can have it come out of your bank account for free. If you want it to stop coming out of your bank account, you can stop the draft with your bank and then there won't be any overdraft charges! Wow, I must be a genius to think of this. Come on people, get it together. We are all financed with Drive because our credit sucks. If you want a beter company in the future, you have to pay drive. I don't like my interest, but I have to pay them for a while to establish a good payment history and then move on to a standard finance company. Quit whining!

Is it too late to add myself to the law suit? After nearly 2 years of paying my payments exactly on time, maintaining current insurance and doing everything I was supposed to do for my 21% interest loan I fell behind! I was laid off from my nanny job, am a single mom and also got hospitalized with no health insurance and nearly lost my apartment because I had NO money. When the nasty b*tch from Drive called me she went OFF on me telling me that I was a horrible mom and I must not love my daughter at all because I'm going to lose my car and then how will I take care of her? She went on to say that I'm an irresponsible, bad person and I should "do whatever it takes to make the money that day!!!!" as if implying I should go walk the streets as a hooker or sell some drugs so long as they get their petty $900!!!!! They've had more than 5 different "account managers" blowing my phone up day and night, leaving me threatening messages and attacking my character as if this is something I planned on. I told them I would be able to pay as soon as I got a check 10 days from now but the awful woman hung up on me and told me since "I'm not trying very hard she's going to take this further"!!!! This company has called not 1, not 2, not 3, not 4 but 14 FAMILY MEMBERS,FORMER CO-WORKERS AND OLD FRIENDS OF MINE!!! They call my mom and my dad at least 3-4 times per day as well as old friends I haven't spoken to in over 3 years after I've explicitly told them we do not even speak anymore! I don't know where they get their information but it's absurd. They've also threatened to have me arrested on a FELONY charge if I don't turn my car in to them! I've never had any problems with the law and am infact a model citizen who works with children for a living. I have never been so humiliated, frusterated and insulted by a company of ignorant apes trying to ruin my life! I would love to share more details of my story. Please contact me about the suit!

I bought a car and had it financed through Drive in June of 2002. I have made all of my payments on time and 20 of those i paid over $100 to pay off early. According to my accountant and Bankrate.com my car shoudl have been paid off at that rate in March 2006. i called them and they said no you still owe $1500. i went ahead and paid that and sent a letter along with it that stated that when this check is cashed I expect my Title in 60 days (as I know it takes a llittle while being in a nother state and all). Well it has been 6 months and now they say I owe $4000 more to get my title. The total amount of the loan including interest was $22000. I have paid almost $24,000. I will be more than happy to join a lawsuit as I have spoken to a lawyer already and they made the same suggestion. They owe a lot of us money and I have already put calls into the dealership where I bought my car and they stated they will never use them again because they have had numerous issues as well as Drive telling them that they haven't received their payments. They need to be stopped. Please contact me via e-mail today so that we can get the process going.

Your vehicles at least the nicer ones were most likely sold at auction to Tom Browers ex old buddies from his used car salesman day's with his knowledge. They also were V.P's and Presidents of department that gave them, all access to your accounts LOSS PREVENTION the cars that they repo'd from supposed delinquent and deliquent accounts, at least the nicer cars were supposed to be sold at auctions.Well they had inside people at some of the auctions that would sell hahaha them back the vehicles for hardly anything and the charges for the repo and the transport to the auction were charged to written off accounts and then they take you to court for the remaining balance which should have been what the auction would have recvd from a legitimate buyer and they sue you for the the difference.I have seen a Mercedes turn into a Honda overnight and was told I was crazy and then let go. I tried to tell them in the Cypress, California office and they laid me off.And ,shortly after they sent the rest of the employees home after returning from lunch. I have information if anyone does file against them. They honestly lined their pockets and the Bank Of Scotland Paid alot of Money to the CEO and several other Loss Prevention Principal employees as well as a V.P.in California's Loss Prevention Department she actually had her employees steal and cheat for her without their knowledge and some knew better but were forced. I am sure of this. This needs to be addressed by the people that had cars repo'd the nice ones and then told they got only a meager amount after settlement. Yes, cars do sell for cheaper at the auctions but they were sold for merely nothing to the above people and you are responsible for all of that difference. And that vehicle was resold by them, to someone, for the actual worth and they kept the difference. That you will end up paying. They also bought massive quantities of flood cars back in 2002 and then resold them and never told anyone these cars most of them had been completely under water for days they dried them out, put in new upholstery and carpet and then sold them. We had massive calls coming in regarding problems from electrical to complete mechanical failure and the response was 'you still gotta pay that bill'

Drive Financial

My husband and I have a joint loan with Drive Financial since 02/04. In Feb 2005 I made a payment through their automated system. I waited 7 business days and called Drive Financial a representative stated they updated the system and my payment was lost. I made a payment with the representative over the phone. Approximately 3-4 business days later both payments posted to account which caused me to be overdrawn in my account. I am interested in a class action suit!

DRIVE RIP OFF

Fri, February 10, 2006

I have been with Drive for a little over a year now and have had numerous calls from them (I was late due to the fact that I was injured at work 3/05 and was and still am off work)however, my payments are now current and they are STILL calling me, last night they called and wanted to know when I was going to send them $1029.XX for the toyota corolla that i have financed through them! I DONT HAVE (NOR HAVE I EVER) A TOYOTA COROLLA!!! Not to mention that I saw in another posting that they called "references" and told them how bills arent being paid and gave personal information, they did the same thing to me, WITH MY 84 YEAR OLD GRANDMOTHER,who stressed about the call so badly (the payments were already caught up)she almost had another heartattack from the stress, and that was one of the several calls they made to her. I will gladly participate in a class action suit against these people. That is why we have laws to govern these types of activities!! Please let me know how I can help!!!

I have been with drive since august of 04'. when i bought my car in august of last year, i was a primary on the application and my mother was the co-buyer, drive put just my mother on the loan. i have been back and forth with them for almost a year now about this and they even pull up the title which has my name on the primary and they still keep messing around with me and tell me to do something different everytime. they do harass me at home everyday and have taken double payments at times. They are not willing to resolve this so i am definately in for this lawsuit.

The shortened version is "ditto" each and everything I have read here has happened to me, the most receint being illegally trying to take money from my checking accoutn w/o permission, and now they refuse to disclose payoff information to allow another car company to buy me out of the loan. I have been lied to, yelled at, hung up on, double teamed by two reps one pretending to be a supervisor, I have been told at least 10 different times that someone was my "account manager" only to make arrangements with them and have someone else then call me the next day and tell me they were "no body" and the arrangement is now changed because...they said so. What they did w/my account it fraud. I have ordered papers from the attny general, and am filing a report with the better business bureau also. The worst part is, I also am a debt collector..I had to learn all of the FDCPA rules before being hired. I see them break them each and every time they call me. But so far I have felt it is me fighting alone, until I found this site...

Count me in too! This company is excessive in their collection techniques

#82Consumer Suggestion

Wed, June 22, 2005

Please contact me if you file a lawsuit. This company is excessive in their collection techniques, harassing phone calls every 15 minutes to an hour all day long. Compounding interest daily even if you've made arrangments. Yesterday i talked to a representative (a different one every time) 3 times. I explained that I had requested a deferment to get the 1 payment I was behind put off so that I would be current, they claim not to have received my fax, even though i confirmed with my account manager Mr. Tramel that they had received it. GRRRRR. I just want to change companies.

Count me in on class action suit This company is the worst

#90Consumer Suggestion

Mon, May 09, 2005

This company is the worst, I do not think they have a clue about the Fair Debt and Collection laws. I wish I never would have dealt with them. I think they must have stock in Money Gram and Western Union because that is the only way they would take a payment. I set up my payment to come out on April 30 and they said it was a invalid account, I know what my bank account is and they entered it incorrecly I am sure. If they would get with the times and do online payments or take credit card payments. I take care of all my other bills this way. My bank is still in Texas and I can only pull out 400.00 per day with ATM and I told Drive that because money gram will only take cash or the ATM up to my daily cash limit. Those jerks want me to Money gram my limit today and then do it again tomorrow each time costing an additional 10.95 fee.

Count me into your class action suit against them. they have fumbled my account and it took a year to get a statement of my account, through email no doubt. they have tricked me into this outragous interest charge also daily compounded interest and are applying my payments majorly to interst. one payment made only credited .59 to my principle. they will not send me a proper statement of my account. they continuously call me about my payment being late stating i have to pay an additional fee when in fact fees don't accrue for 10 days after late date. i have never had a late payment and found out today that they don't have a license to refinance??? i have been spoken to in manners of which are unacceptable and can't get them to send me a copy of the contract that i have with them.

Willing to cooperate for Class Action Lawsuit

#93Consumer Comment

Sun, February 13, 2005

I am very willing to cooperate in a class action lawsuit against drive. I paid my car off at the beginning of 2004 and I am so happy that I dont have to deal with the treatment they dish out any longer. I was told however that I overpaid my loan by two payments and I am still waiting for a refund. I asked for copies of my payment history several times and was told it was in the mail and never received it. Now since the loan is paid off they can't tell me anything in regards to the payment history...So they say. Please contact me thru this site for any help that is needed with this lawsuit.
