I have a 2001 black ford explorer that I have had for about two years. About a year ago, I got into some financial strain and started paying them one to two weeks late. They were calling all of my references, which I knew they would do but then they called Tammy, one of my references, and Tracey and told them both why they were calling. You know my thought was...yes, I am late and so I let it go. At that time I spoke to a representative from their office and I told her to stop calling Tracey because she was a supervisor where I worked and that could get me fired. She continued to call her or at least that is what Tracey told me.

Well, then they started sending me emails and I asked them at that time in writing to not call my place of employment and they continued twice after to do this. I then called the corporate office and asked them to not call my office and the representative said he would make a note of this and make sure they do not call my job again. Well, don't you know I have a message that I have saved to my phone where they called me again.

At this point, I have decided to get an attorney because something has to be done. I have only ever been late by one to two weeks at the most. I don't think this constitutes breaking the law.

I know that you are sick and tired of Drive Time and the way they do business. I am cooperating with the Attorney General here in AZ. You all will have to contact you states Attorney Generals office to file a complaint; if you are serious about your complaints! I am revealing the entire call center's email with one address. You can send them anonymous emails to [email protected]. (be sure to use the underscore before _allmesausers) Say whatever you want.:)

First of all just from what you have written no laws have been broken. Getting an attorney would just be a waste of money that you could put to other uses. The law you are probably thinking of is the Fair Debt Collection Practices Act(FDCPA). The FDCPA requires the Collection Agency to stop calling if you notify them. However, that covers ONLY 3rd party collection agencies and not the original creditor(which Drive is considered). So why it is anoying it is not illegal. In fact they want it to be anoying. After all there is an old saying that "the squeeky wheel gets the oil". Also, you have to consider another item. If you are in default on the loan they can reposess the car. It does not matter if it is Drive or any other bank. The car is the security for the loan and if the loan is not paid it can be resposessed. Yes, even at a couple of weeks late.
