I went to Dublin Honda with my mother on 12/26/2015 and she purchased a 2016 Honda Accord. The General Manager added my name to the contract. The General Manger also slammed my elderly mother with extra fees and products that were erroneous for the general purpose of purchasing the vehicle. A $22,000 car became a $39,900 loan with all the extra products He placed against the loan. Basically my mother got slammed into signing for this vehicle. The only way the general manager could get this loan approved was to put my social security number on the contract.

My mother explained to him that the payments were too high and she could not afford this type of payment since she only makes $1,000 month in social security benefits. He stated that all the extra products and services was the only way that this contract could be approved. He also stated that don't worry just pay on the loan for 12 months and I will refinance the loan or place you into a cheaper car. So she purchased the vehicle and later went back to Dublin Honda to get the refinance or the cheaper payment. He came out of his office arms folded and twisted and pretended to have multiple sclerosis and spoke like he had a speech impediment. He was basically insinuating that my mother was disabled. He did not honor the cheaper payment, the cheaper car or the refinance.

I called him at his office and his secretary explained over 15 times that he was not available for a phone call he was avoiding me at all costs. When I finally did get a chance to speak to him he started yelling at me "GO AHEAD AND SUE ME! I HAVE A WIFE AND KIDS TO SUPPORT!" He then started screaming profanity at me. He placed me on speaker phone with another manager and this other manager denied there was any deal made for a refinance or a cheaper car so that my mother would sign the contract. Dublin Honda secured the loan with his personal friend at Honda Financial telling the representative at Honda Financial that my mother was his sister. Neither my mother nor I qualified for this time of vehicle loan.

He got it pushed through using criminal methods. Obviously my mother was slammed and there was nothing she could do about it. The following month my mother had to voluntarily surrender the vehicle because of the situation. Now my credit report is showing a $20,000 charge off and a note stating the loan was transferred to recovery. I am a victim. This should not have happened I have an identity theft on my credit bureau and he should not have been able to access my credit much less put a $39,900 loan against me. This derogatory information has kept me from renting an apartment and has made me homeless. I am severely damaged over his actions.

Jennifer, it is very apparent that you haven't done your research into vehicle buying and financing.  Dealerships count on your lack of experience and knowledge and for that they are handsomely rewarded financially at your expense. It pays to learn before you shop (or your Mother shops).

I am not here to defend the dealership whatsoever. The tactics you and your Mother experienced are very common in the industry. Does it make it okay? No. The vehicle dealerships make a ton of money off consumers in the financing portion of the purchase contract as well as adding in all those extra products.  Those products are not required, no matter what the finance person says verbally.  The finance person and the dealership make hefty commission on those extra products.  

The other two common tactics that were used on you: 1) telling you something verbally knowing full well it doesn't override the written contract and 2) the old line 'come back in a year and we will refi or trade you into something with a lower payment'.  Doesn't ever happen unless you have a huge downpayment on the original purchase and then they do their best to eat up the equity in the next trade.  Dealers don't refinance. Auto lenders refi, not dealerships. 

As to the interest rate, I don't know where you get the idea that the rate can't be increased to the consumer over the lender's rate.  It is common practice for dealerships to mark up the interest rate to the consumer in order to boost the dealerships' commission. It is referred to as a 'premium par rate'. 

The only way to proctect yourself is to get outside financing before you ever enter a dealership and don't allow the dealer to compete on the financing. Don't provide your SS to the dealership. Get your financing at a trusted credit union and only handle the financial side through the CU. The finance person at the dealer will tell you they can do better, but would be extremely rare that they can beat the credit union.  

I will say this for dealer finance people:  it is not discrimination IMO because they take advantage of everyone that will allow it. It is up to each of us as consumers to just say NO and walk away when it is a bad deal. 

As to you being a co-signer: yes, when you gave them your SS and signed the paperwork, you were permitting the dealer to use you as a co-signer. It won't cost you 10 years on your credit. It will be there for 7 years plus 180 days unless you have a judgment against you for the balance. Then it will be there longer. Please fix this now. It will take time and effort and money to fix. 

Do your research before you attempt to finance anything in the future. Look up the legitimate credit forums to see how to handle this negative event on your credit file.

The General Manager said just sign and bring the car back for a cheaper payment, a refinance or a cheaper car in 1 year.

- Once again if you knew your mom couldn't afford the payment, and according to your post you couldn't either.  Then why would you even consider signing an agreement taking responsibility for the loan.?   Even if you did refi in a year..you would still have 12 payments that you couldn't afford.

I am ruined for at least 10 years and cannot even rent an apartment over it.

- Not to be too blut but I somehow think you not having a job or income probably plays a big part of not being able to get an apartment.

You contradicted yourself and your claims that it is hard to take anything you stated as fact.   You said the manager pushed through the loan because he stated that your mom was his sister.  If that is the case then again 1)Why would they still need you in this case, and 2)If you heard him lie why didn't you turn around and walk out.

Yes in the end the blame does fall on you, because based on the circumstances you claim there is no logical way you should have signed the loan agreement.  To state again as the other poster did about your day in court. What you signed is what the courts will go off of, if it isn't in writing it doesn't override the written contract.  If you have some proof other than your thought(or wishful thinking) that this was some "backroom" deal they judge may hear it, but in the end it still comes down to YOU taking responsibility for what you made a legal agreement to do.

You knew she could not afford the payments yet you agreed to cosign the loan. Now you are expected to fulfill your obligation as a cosigner.

About your day in court… A written contract supersedes a verbal agreement. A written contract cannot be modified by a verbal agreement; therefore, the agreement does not extend beyond the four corners of the written contract.

I want to add more information to this rip off report I had no job which meant no income! My mother makes $1,000 on social security per month. The General Manager said just sign and bring the car back for a cheaper payment, a refinance or a cheaper car in 1 year. I said your positive she can trade the vehicle in the general manager said sure. This was all lies!!!!! The payment was $737 per month and the interest was 11% There was absolutely no way in the world this vehicle could have been traded in much less refinanced without an enormous down payment. The general manager pushed this loan through by calling Honda Financial Services and talking to his "buddy" telling his "buddy" to push the loan through because my mother was his sister.

 

To the persons writing rebuttals placing blame on me is not the solution. I was badly victimized in this situation. I am ruined for at least 10 years and cannot even rent an apartment over it. The General Manager and finance managers at Dublin Honda are ruthless. I pray that I will have my day in court with them.

Nobody Cares About Your Oppression

Seriously - nobody.  What happened to you has nothing to do with whether you are an oppressed person.  Believe me, I understand oppression.  I used to live under oppression.  You know nothing about oppression the way I do - but that's another subject.

 

So let's focus in on the real issue - your credit union.

 

Last year I was triple charged by Avis and called your credit card department to open up a dispute and was told it was done.   Disputes like this are done in writing and often online.  You have to complete a form indicating the reason for the dispute.  If you provided the information over the phone, without it being in writing, chances are the CU will not act upon it.  These disputes MUST be done in writing.

 

Just to find out months later that your customer service rep never actually opened the claim or chargeback.  A chargeback requires the CU to send you something in writing indicating they started the dispute process, AFTER you filled out paperwork.  If they didn't mail you (or e-mail you) a notice, then it didn't happen.  This should have been something you should have followed up less than 2 weeks later - not months later.  You have 30 days to file a claim, and then the window closes.  You were fortunate they reversed one of the charges.

 

Now that I’m back in Austin I can’t pay my phone bill or get any gas to get to work or to go up your branch to close out my account.  You are correct and that stinks.  But you have to do it, otherwise I guarantee you will lose far more in the process.  If you knew long ago your CU stinks, you should have closed your account long ago.

 

Do I agree with you that you were ripped off?  Yes.  Does it have anything to do with being a member of an oppressed race?  NO.  When you called, did they know you were an oppressed person?  NO.  Perhaps the person who took your information over the phone is also oppressed?  Clearly Carlos sounds like an oppressed person.  The truth is - they don't know what you are.

If I read this report correctly, YOU were a co-signer on the loan since they used your financial information to get approved.  So why didn't YOU put the brakes on the deal BEFORE you and your mom signed..after all you state you were there with her.

They didn't get the loan approved with her information alone, they didn't push it through some back room deal...they added you as a Co-Signer to get it approved.  If you knew she couldn't afford the payment, why would you allow her to accept that payment..even for a year?  If you were not willing to accept responsibility why did YOU sign?

You stated there was nothing she could do about it. Sure there was, there were two big things that she could have done that would have been very easy.  She could have gotten up and WALKED out without signing. She could have told them to remove all of the "extras". If they refused stating that was the only way to get approved then she should have left. YOU should have told her to leave.

The only reason you have a repo on your credit is because as the co-signer you FAILED to make the payments you legally had agreed to do when they put you on the loan.

- It happened because YOU let it happened. YOU gave them your information and permision to access your credit report. YOU signed the documents making you responsible for your mom's loan.
