Rip off alert Dvl Group /Liebert Corporation.

On May 24, 2012, as the President of Dowd's Heating & Air Conditioning, Inc. I, Joseph F Dowd, purchased a Liebert Challenger3000 from DLV Group located at 115 Sinclair Rd. Bristol, PA 19007. 

The sales representative is Bill Highlands.

This order was placed over the telephone and there were two employees present when I placed the order.  Telephone orders are standard procedure and performed frequently.  The equipment was delivered to my warehouse.  At that time I contacted a private service to deliver the unit to the location where it was to be installed. The unit was left in packaging to prevent any damage, the price for this service is $850.00.  After uncrating the unit on location I found the wrong unit was delivered.  I then had to pay an additional $850.00 to have the unit returned to my warehouse.

I contacted Bill Highlands and was told that the unit delivered was the unit listed in the contract, not the unit I ordered over
the phone and that, "It's a popular model and I am sure I can resell it."  I was also informed that there is a 60% restocking fee.  The contract does not state a percentage or a dollar amount.  Nor is this an industry standard.  Sixty percent, that is absurd, $6750.00 I have to pay because the wrong equipment was sent to me.

After several phone calls and emails I met with Gary Hill, President and Bill Highlands.  Mr. Hill stated that he did not want Bill Highlands to lose his commission but he would try to decrease the restocking charge. 

Bill Highlands informed me that Mr. Hill spoke to Liebert Corporation and that the sixty percent return fee would not be reduced.

 The equipment was returned on August 13, 2012.  As of this date I have not received a refund, and my emails to Bill Highlands have gone unanswered.

During the fifteen years that I have purchased equipment from various companies I have never paid a restocking or return fee.

If this notice prevents another contractor from paying an absurd 60% return fee I will have helped a fellow contractor.
