We hired DM Pools & Sons, LLC to perform a swimming pool restoration in April 2016.  Prior to allowing a worker on the property, we instructed Damon McIntosh of DM Pools to send a Certificate of Insurance for General Liability and Workers Compensation.

Ed's Insurance Agency sent us a certificate of insurance via Fax.  We called the Agency on 04/06/2016 to confirm, and spoke to Felicia.  She assured us that there is coverage.

The information sent to us was a Fake and Fraudulent Certificate of Insurance.  However, we never would have known...

More bad Luck...

DM Pools and Sons, LLC did substandard work that dragged on for two months.  The entire job should have taken two weeks.  He did $2,000.00 in work, and kept the $6,000.00 balance of the $8,000.00 deposit.  At this point, we contacted the insurance carrier LLoyd's of London.  They informed us that the policy was cancelled in 2015.  We hired another pool company to complete the work.

More bad news.  The State of Florida informed us that Damon McIntosh of DM Pools is under investigation for Unlicensed Activity for another case.  We are sending a complaint against him as well.

We called Ed Fabere of Ed's Insurance Agency.  He was not concerned that his error cost us time and money.

We filed a complaint with State of Florida Chief Financial Officer Jeff Atwater.  DFS Case # MC 2343674 as the insurance code has been violated.

Special Investigator Raphael Montero was assigned to the case.

Although Ed Fabere did inform the investigator that he made an "error", he  has not provided us with his errors and omissions policy.  Furthermore, Ed Fabere of Ed's Insurance Agency does not feel that he is financially responsible for our loss, even though his error is a a Proximate Cause.  We hired a lawyer, and Ed Fabere seems to be unconcerned!

For those reading this...  Ask yourself.

1) The Insurance Agency gets paid $$$ commission.  So.....  How did they not know the policy was cancelled?

2) DM Pools knew that they Did NOT have active insurance.   So..... How could they expect the Insurance agency to send a      certificate of insurance?  Weird, no?

3) Ed Fabere somehow forgot to verify that the policy was Active prior to sending the certificate of insurance.  How    convenient for DM Pools!

This seems like a CLEAR case of purposeful Fraud!!!  Either, Ed's Insurance Agency sent a Fake document to help a buddy get a job --- or, we have Terrible Luck with an unlicensed pool company doing substandard work and abandoning the job, while keeping the deposit; and an Insurance Agent who made an Error by not checking the Active status on a policy????

Moreover, isn't it a bit Ironic?  The Insurance Agency is refusing to provide us with the name of his E&O insurance policy carrrier!!!  You would this an Insurance Agent would be the 1st to provide his insurance prior to a lawsuit!!!  Not.

We attempted to perform Due Diligence --- and Fraud got in the way!  Sad.  Very Sad.  They are both Crooks...

It took close to one year.  After being investigated by the State of Florida Financial Division, Ed's Insurance Agency made a settlement with my lawyer.
