Published: May 05, 2006 11:53 pm Court awaiting evaluation to sentence man on sex charge By Matthew Hill Register-Herald reporter An Oak Hill man pleaded guilty in March to one count of third-degree sexual abuse, but his sentencing has been continued until a psychological evaluation is completed, according to Fayette County Prosecutor Carl Harris. Elby Franklin Lilly, 41, entered his guilty plea March 29 before Circuit Judge John Hatcher and he was originally scheduled for an April 28 sentencing, Harris explained. A new sentencing date had not been scheduled as of Friday as those involved with the case await the evaluation results. Lilly's arrest last July 12 came on the heels of an alleged incident that occurred shortly beforehand involving a 14-year-old girl. He was released two days later on $25,000 bond, Harris said. Lilly, 40, of Whipple, was sent to prison for one to five years on a third-degree sexual assault conviction and assessed all court costs. Lilly pleaded guilty March 29, and the state moved to dismiss a separate felony charge. As part of his sentence, Lilly is required upon release to register with the State Police as a sex offender. Lilly was accused of engaging in sexual intercourse with a 14-year-old girl on July 5, 2005. Harris deemed the offense a ?heinous? act. While Lilly vowed to clean up his act if given the chance, Hatcher would have none of it. ?He (Lilly) has minimized his entire behavior. For a 40-year-old father of five to say that a 14-year-old girl is to blame for this sex act is ridiculous beyond description,? Hatcher declared. I guess now I know why he hasn't been paying child support he is too busy chasing after little girls. What a sick perverted man I was once married to.
