Tory recently hired me to clean windows for him and refused to pay me once the work was complete.  He lives in mexico and works in the US, so he is hard to track down to get paid.  I am not the only one that he has ripped off, he owes money to several other local window cleaners too.

#2REBUTTAL Owner of company

Fri, December 07, 2012

My name is Tory Marino, and since the person who will remain without a name because I don't wish to damage his or his company's reputation.

However; I would like to shed some light on this since this person wants to damage my companys' and my reputation.

My company is one that services large commercial exterior cleaning services. Primarily window cleaning.
The person who wrote this complaint (which by the way, I don't understand why an anonymous ID is allowed to post anything they wish without giving their name on this site) did in fact subcontract for my company on a large project for the interior cleaning of the glass.

I was given a 5 day deadline to complete the interiors by the General Contractor, which by the way-
we've missed a deadline only one time in 7 years. The person who wrote this report is the owner of a small residential outfit, that has done sub work for me once before and it turned out okay and all went without much of any problems.

However, after terms were ironed out and the scope of work was clear to all parties at the end of day 1, this person already fell behind schedule. When asked what his plan of action would be to get back on schedule, him and I both agreed that the newness of the site and the environment around them might have been a factor and I was assured that the next day they would get on schedule.

Meanwhile, the General wants updates on the timeline. This is common for the first day, unknown property, unfamiliar peers...it happens. It always takes longer the first time until a system is created for efficiency.

That doesn't mean that I will let my jobsite be trusted to ANY other company unless it is headed by one of my men. The next morning, when a status report was requested it was clear that we would not make our deadline.

When he was told that since the scope of work has changed, so have the terms; he asked me if I can give him two of my men to help him complete it. My answer was no. If he didn't complete what was supposed to be done by day 2 he would be removed from the job and we would take over.

The same day on day 2, when I went to walk what they have done already which was supposedly one complete floor, and a half of another floor; what I seen was shocking.

Photos and videos were taken to back up my words. Short version is; windows were NOT clean. It was as though they didn't care and thought that since it was a large building that nobody would see their mistakes.

When I called him and asked him if he would come down and take a look at this he told me that he was on his way to play basketball at the gym! He wanted to come by on Monday instead. It was Friday. Our deadline was Sunday.

I let him know that if he didn't send his men out to complete their task, not only would he not see a penny-he would be backcharged the amount it will cost for me to clean up his mess. He told me that it don't matter the quality of work he turns out, that by law I still have to pay him.

Well if that was true, buildings would be crumbling around us, because hey...everyone has to get paid right? No. He gets NOTHING. In fact, he was given a bill for the 4200.00 bill that I had to pay to clean up his mess.

Ultimately it's my fault for hiring an amateur to do a professional's job. Lesson learned. We were able to salvage the project, we not only met our deadline but we got a high profile reference out of it as well.

So, Mr. Author; please...why don't YOU tell the world who you are so we can all hear your side?
