After retuning a change of address card which is provided by the company I waited to get my bill at my new address. But it was always being sent through the forwarding process, thus getting to me 20 days after the bill was cut. I called to inform them and they said the process would take about 6-8 weeks and did not want to take that information at that time since I had sent in a card.

Short of getting a bill I coninued to pay my bill on the due date for twice what the monthly minimum was usually even though I had not recieved a bill.

I did not do this in Oct because I was out of the country and had not given that instruction to my bank. I recieved no bill for October 2003 and tried to call always geting disconnected.

I recieved two cards in the mail from them stating they where now going to charge me an additinal penalty because I had not paid my Oct bill.

After finally getting through to them after being on hold for 22 minutes I was told these words "It is not our fault you did not pay your bill just because you "Say" you did not reciev your bill, and since you have an account with this company you are a poor credit risk so anything you say is probably a lie anyway" needles to say I have drafted a letter to both them and my attorney.

They also stated that I was reported late to all credit agencies 11 times in the last 12 months, I explained that a gredit report I have says that is not true.. they hung up.

After doing research I have found out that this company is located off shore and has offices in Panama, and other countries, so when you give info you give it to non us citizens!

FDIC ordered the increase of the rates and the closer of accounts

http://www.fdic.gov/bank/individual/enforcement/11867.html if you type in the following url to your browser it will take you to a Gov web sight where you can read the order that put providian in the cut the throats of our customers roll. it is the reason that Emerge was invented to help the Providian name get through it's deceptive practices. It's a good read and you will find that the FDIC ordered the increase of the rates and the closer of accounts (switched to emerge to pay off) so that the providian bank could comly with the order. Its a good read for sure
