This is a report against a self parking facility located in Atlanta Georgia on 09/18/2013.  Upon entering a parking lot, off a main thoroghfare with heavy traffic, I discovered this was a self parking facility.  I followed instructions going to a koisk and waited in line to get a ticket from the only Koisk on the property.  In a hurry, not to keep others waiting, I found the area I wanted, namely, Hotel Overnight Parking.  I was staying at the Hilton located next door to this lot.  I accepted the fee, and finished.  Later it was brought to my attention that there was other information listed on the Kiosk screen and a display located at the entrance to the Lot.  Unless the car was stopped at the entrance and one studied the lengthly billboard before entering, the display went unnoticed.  Nothing at the Kiosk suggested that one take time and digest the lengthy law.  For me, I got overnight HOTEL parking expecting to receive overnight Hotel parking.  The fraud has to do with timing.  The Lot has as it expiration time. 15 min before check out time.  If you check out of the hotel at the perscribed time, and go to get your car, you will find your car booted with an additiona $75.00 fine or you will loose your car.  The car was a rental, and I had appointments in the afternoon, so I had to pay the ransom they refer to as a violation.  Not being in Atlanta for many years, I was not familiar with self parking, but the fact is that if they had an attendant, I would have had to pay for an additional hour, at an hourly rate.  The absence of an attendant should make it more convenient for the customer, not less convenient with over zealous booters.  Lastly, my signature was forged on one of the forms.  The fact that tons of complaints against EPS, Empire Parking Facitily, for this very scam indicates that something is very wrong, and tourist to the city of Atlanta have to pay the price.  The fraud is with the use of the words HOTEL overnight Parking.  There is no connection to the HOTEL or HOTELS involved, and the owner should be aware that the expiration time for an Overnight HOTEL parking is 15 min prior to check out time.  This should also have been made clear to the customer after pulling into a parking lot and receiving a time ticket.  By not providing a attendant, Empire can claim 75.00 fines no matter the extended time.  There should have also been a grace period listed as with any HOTEL, sometimes you have to wait in line to check out.    The Overnight Hotel Parking, (same terms used) at the Hilton Hotel means just that.  It allows you to spend the night, and check out following hotel regulations, and then recovering your car.  The Hilton Hotel Corp was made aware of this scam and indicated that they would write a strong letter protesting the use of Hotel in their advertising.  In fact Hilton offered to pay the 75.00 dollars, however, I refused, as this fraudulent scam is not their fault.

A false representation of matter of fact--whether by words or contact by false or misleanding allegations, or by concealment of what should have been disclosed---that deceives and is intended to decieve another so that the individual will act upon it to her/his legal injury.   Because of the above, I stopped payment of the 75.00 and my bank honored it and credited my account regardless of the fact that EPS claims that this was not a fradulent charge, and all transactions are recorded on tape.  Empire Parking Services is NOT customer friendly.  They use the law as a weapon to set a trap for visitors, and it should be stopped.
