I would also like to thank GEORGE GONZABA, of Gonzaba Autoplex here in San Antonio. He called me to apologize for the way I was treated by Encino Motors! That was very nice of him considering the fact that it wasnt his fault...he had nothing to do with it! He was not trying to solicite my business, he just wanted me to know that he was so shocked at what happened to me and wanted to reassure me that not all used car dealers treat their customers that way!!
He also urged me to continue to persue the odometer fraud charges, because regardless of everything else, they still acted illegaly! he referred me to a family friend of his who is an attorney, and he also made himself and his resuorces available to me to do a history search on the vehicleto have proof of mileage and whatever else I may not know about,at no cost to me!!!
It was very admirable of him to take the time to contact me about an issue which he was in no way involved in! He didnt have to do that....but he did! For that I thank him!!

Well, I had my meeting with Mr.Enlow sunday afternoon and here was his offer!
He offered to give me the Suburban back and let me reassume my original contract, he would swallow the cost of the transmission (of which it only cost them $850, which Mr.Torres was trying to charge me a total of $2300 for), give me the warranty on the transmission, provide at his expense a full 12 month warranty, and apply every dime i have put out...all to the Suburban!
He also promised me that i would never have to deal with Mr.Torres again!!!! He apologized to me profusly for the way Mr.Torres treated me and my mother, and for all the trouble this has caused me! I spoke to my husband and he said it would be best to accept Mr.Enlows offer and be done with all the headache! So I did....however, I told him that I would not accept the offer unless he gave me EVERYTHING in writing this time...so...he provided me with the warranty policy (with his signature), the receipt and warranty for the transmission (with his signature), a receipt and statement showing all my credit which also ended up fixing it to where my August payment will only be half the usual (with his signature), and the ORIGINAL for the contract on the Mazda on which he wrote (this contract is Null and Void) and he signed that too!
So now I am back to where I wanted to be to begin with!
Why was he so nice, you ask?????
Four words.........THE RIP OFF REPORT!!!!!! THE STAFF OF THE RIP OFF REPORT HAS BEEN SO DILIGENTLY WORKING ON MY CASE AND THEY HELPED ME GET RESULTS FASTER THAN I EVER EXPECTED!! THEY REALLY GIVE THESE CROOKS SOMETHING TO WORRY ABOUT....AND MAKE THEM DO THE BACKSTROKE!!
ED...WELL HE IS A GOD SEND AND SHOULD REALLY BE APPLAUDED FOR HIS WORK ON THE BEHALF OF CONSUMERS LIKE ME WHO HAVE BEEN ABUSED AND RIPPED OFF!!! HE HAS GIVEN CONSUMERS A PLACE THAT THEY CAN MAKE THEIR CASE KNOWN TO OTHER CONSUMERS, VENT THEIR FRUSTATIONS ABOUT IT, AND GET RESULTS WITHOUT ALL THE BUREAUCRATIC BULL IT TAKES TO GO THRU GOVERNMENT AGENCIES!

I was contacted this morning by Mr.Enlow. He stated that he had looked over my contract and found that I HAD been over charged! He said he wrote up a new contract with the corrections which will also lower my payments.
We have arranged to meet this afternoon. I will not go alone, as they are closed today and it will only be him and myself there. So I am going to take my parents to witness everything.
This still does not change the fact that the odometer was rolled back which, in my view makes the sale on the Suburban a fraudulent sale, so it should be null and void in my opinion! so at this point I am uncertain if I should persue that, if they are willing to work out something in my favor!
I suppose I will just have to see how this new contract reads and go from there. Another update will follow.

I have filed complaints with the Atty. General Ofc, NHTSA, FTC, BBB, and DOT. I also sent this to every TV station in town and my City Councilman!
If Mr.Enlow would have just stuck to exactly what he said in the beginning, things would have never gotten this bad!
The FBI is also showing some interest when I spoke to one of their agents the other day! They are partly interested in possible Bank Fraud!

When I went back to pick up my car, Mr.Torres called me into the office again. I asked him if I could now get the papers I had been asking him for. He gave me another copy of the contract for the Mazda, and a copy of the payment history on my husbands truck. I then asked him for the buyers guide, and he had put it on the side, as if he wasnt originally going to give it to me, bu did without a problem. I told him I already had the contract, and I didnt ask for that. What I asked for was a copy of the Mileage statement. He said that I dont get a mileage statement. He said the only thing I get in regards to the mileage is the registration and title. I said, "You had me sign a mileage statement when I signed the contract." he said that was in regards to the Suburban, and I didnt need anything regarding the Suburban, because the Suburban was out of the picture. I told him that I felt that i had a right to paperwork that ever had my signature on it!! He then said that the current issue was that I owed them $120 for brake pads that they had just put on my car! I shook my head and thought to myself "Here we go again!" I told him that he had told me from the get go that they were going to take care of the brakes, before I ever bought the car. He said that I should have brought it in when he wanted me to bring it in! I told him sarcasticly "I'm sorry that I cant always do things on your schedule or at your demand!" he said "Well, the only reason you brought it today was because I told you that you HAD to!" I told him that I didnt HAVE to do anything, especially if I am the one who is going to have to pay for it! He then said "Well we can put you into a 94 Ford and all it even!" I told him to forget it, that I wasnt doing anymore contracts with them and that the word "even" coming out of the mouths of anyone at their dealership was worthless! Of course all this time he is holding my keys like his life depends on it while my children are outside in the heat sweating to death, not even allowing me to have them to turn on the a/c for them, and I cant bring them inside because i didnt want them to be subjected to all the arguing! Meanwhile, Mr. Enlow comes in, and he and I start arguing and he says that I owe $90 for the brake pads, which is not waht Mr. Torres told me. I told that everything I had already told Mr. Torres, he then proceeded to tell me that I couldnt afford that car, and then HE said he could put me into a 94 Ford and call it even and I wouldnt owe them anything! I repeated to him what I had said to Mr Torres in regards to that. I told him that he had already burned me once and I wasnt going to go throught that again. He asked how he burned me and I told him that he knows what they did and again I told him that he knows what he told me when I bought the Suburban, my parents know, and his former salesman Don Dubar knows. He then starting yelling and said "You bring Don Dunbar over here, and I'll kick his f**king a*s!" He then yelled "You take that car, and I'll add the cost of the brake job to the end of the note, and you wont get the title til you pay for it! And let me tell you something else, if you are one day late on a car payement, I'll come and repo it!" I told him to draw something up outlining the charges and give me a copy, he said "I dont need to DRAW up anything!" I asked him "How many people have you done this to?" He said angrily "Maybe you should just get a lawyer!" I said "I just filed a complaint with the Atty Generals office!" He asked what I was talking about, I said "David, you and Bobby are charging me for TWO, count them, TWO vehicles!" then he starts to give me a break down on paper of what the numbers shoudl have been, at which point its not adding up!! WOW!!! No kidding!! He comes up with several thousand dollars in over charges! So then his voice gets low and he says, "let me take the papers home with me tonight and give me a call in the morning."
So...thats where it stands at this point! Hopefully something positive will happen to resolve this, because I am going to have to deal with these people for at least the next 2 or so years!

Took the Mazda to them today because the brakes were bad when I bought it and they are fixing them for me (surprise surprise)! Get this.....they gave me the Suburban as a loaner until they are finished with my car!! So I took it to a friend of mine who has a digital camera and had her take pictures, of the odometer, the VIN, and the vehicle itself with plates showing. I did this in the event that they try to undo what they did to the odometer, and it gets investigated. What I am hoping for is that it will be investigated, and the appropriate agency will be able to obtain the odometer reading when the last title was issued, and see what the odometer reads now! If Encino attempts to change it back, at least i will have the photos to prove what they had changed it to.

I went yesterday to make my first payment on the Mazda I now have, and the Suburban is back on their lot!! One of two things must have happened...either its been at the shop all month because he couldnt didnt have the money to pay for the repairs OR someone bought it and returned it!! I also took notice of something else...according to law, from my understanding after doing some research, they are required to post a Buyers Guide on all vehicles on their lot...surprise surprise...they dont have it one a single vehicle!! Also, I told them that I found out that I was supposed to get a copy of the Buyers Guide and a mileage statement when I purchased the Suburban and they failed to provide me with one. When I asked Mr. Torres for copies for my records he out right REFUSED to give me a copy, and went further to say that the deal and paperwork on the Suburban were done and over with, and I had no need for copies!! Now that the Suburban is on their lot again, I wish I could get someone over there to investigate the odometer rollback!! I also wish I had a way to get a report from Carfax.com on it!! If anyone has access to Carfax reports and could lend me a hand with some information about the Suburban so I can have some proff about the miles the VIN # is 1GKER16K7MF526172.

What a mess. So sorry to hear how you were exploited.
It's a shame you didn't know anyone who could advise you about the Suburban. An 11 year old truck with 140,000 miles may not be something to consider when your need is reliable transportation. If you could get a basic new car w/o accessories financed, you'd probably be better off. Just bought a 2003 Corolla CE with a list of $13,996 and am very pleased. Plus, I have a 3/36 basic and 5/60 powertrain wty from Toyota.
Now, what to do. Odometer tampering is a federal crime. Try the US attorney's office if the state attorney general is not taking this case. This is a serious charge and can normally be supported if the prior owner or a maintenance facility can verify the true mileage before the car went to this dealer.
Please contact an atty for advice. try legal aid if you qualify. Perhaps this can be unwound for you.
Hope you now know and other readers learn that any warranty on a car:
1. Needs to be in writing
2. Is only as good as the company issuing it - if they close up shop, you're out in the cold.
Hope it works out. You sound like a very sweet lady who was horribly exploited by some used car sharks.
