The problem with misapplying your payment from one loan to another was probably just an honest mistake. The guy in accounts recievable department has nothing to gain by misapplying your funds. I work in the industry and have had to reconstruct people's credit in similar situations. You need to first get a copy of your transaction history for both loans from Fairbanks. Then get copies of all your cancelled checks to FairBanks. From that you should be able to reconstruct your payment history and find any errors that you/they or both of you made. Then it's just a matter of figuring out how to correct those errors. Good Luck.

Since B of A sold its portfolio to Fairbanks, as of April 1, 2002 ALL EquiCredit and NationsCredit loans will be serviced through the Fairbanks office in Jacksonville; same building and same staff as the EC and NC folks. Currently the State of Florida is reviewing many complaints against the gang of three. A website is up and running that is devoted entirely to the Fairbanks story; of which YOU are about to become a part. You might want to check out conti-fairbanks.com or, citi-fairbanks.com for MUCH more info on how to fight back. Several class-actions are being prepared. They deal with "mortgage-fraud." All of the previous complaints have been related to "predatory-lending practices." Good Luck. Jack
