On or around February 18th 2011, I ordered a scooter from this company.  The scooter was supposed to be BRAND NEW Speedster 150cc Moped.  I placed my order and everything went well, my scooter was shipped out from Venus Texas on a monday.

My scooter was shipped by ESTES EXPRESS, my scooter arrived in Indiana on Thursday, here is were my problems start. The shipping company called me and said that they could not deliver it to my house because they did not have a Lift gate, well after half a day on the phone with them they finally got their own private individual to bring my scooter to my house (I paid extra shipping for liftgate to).

Upon recieving my scooter, the box that was covering the crate was heavily damaged, the crate frame was bent in three places, the box had been opened at the top, so the scooter was totally open to any damage from the top!

When I got my scooter out of the crate I realized it had been damaged quite a bit, I immediately called the shipper, the advised me to contact the seller, so I did all that and Moises from evosales had me send him pictures of everything. I also noticed the manufacture date on the frame and title said 2008

Moises said he would replace EVERYTHING that was damaged, well he send two parts to me in the mail and asked if everything was ok, well the scooter would not even run out of the box and I got a BAD battery. After having to replace a coil, CDI, and spark plug the scooter finally started.

I contacted Moises about the bad battery and he said he would send a new one out to me, without the acid because of USPS rules. When I recieved the replacement battery he sent it without cell covers, after recieving it I called him and didnt get an answer for 4 days, I sent him numerous emails and never got any responses!  Finally once I did reach him he told me to take the caps off my factory battery and put on the replacement, well I took them off the old battery and tried to put them on the new one, well they didnt fit...I tried to put them back on the factory battery and they wouldnt go back in and seal...So now i'm stuck with a 3 year old scooter and NO battery! Simply because this Moises character doesnt want to send me the d**n battery caps for the replacement one he sent, I think he done this on purpose to RIP ME OFF !

Also, the shock absorber on this scooter was no good, I found out that the seals on them deteriorate after sitting for as long as my scooter did (mine was made Jan2008). So I did get Moises to send me another shock, the first one he sent was ENTIRELY to big and wouldnt even fit between the airbox and back tire.  Then he sent a second shock and it did work, so I did get a new coil,CDI,shock and battery (with no acid or caps) from him, but I'm still stuck with a few parts that were damaged in shipment and he wont replace.

Another thing, my engine has so much blow by that it blows out all the oil in the crankcase through the airbox, this is another thing I reported to Moises and he told me to "go get it fixed if its broke", well this bike did come with a 30 day warranty and I should have never accepted the shipment but how did I know all this was gonna happen.

After this experience I WOULD ADVISE THAT NO ONE CONDUCT BUSINESS WITH THIS COMPANY!

After a few weeks I decided to contact the Better Business Bureau because I knew that I had been taken for an $899 dollar ride!

After contacting the BBB now Moises wants to reply to my messages and phone calls. But now he dont want to ship ANY of the damaged parts to me that he promised from the get go.  So I'm stuck with a three year old scooter with no battery and broken body parts,   I pretty much got RIPPED OFF!

I would be glad to get some retributal on this issue or legal assistance, it would be nice to recover some of the money I paid them because they have RIPPED me OFF and I have noticed that I'm not the first one!

For those have bad experiences with EVOSales.com, do the following 2 actions:

1. Call the Texas Attorney General's consumer Protection department

2. File a complaint with the Department of motor vehicles Lemon law. If you have not had repairs completed in 30 days, the lemon law applies.

Put them out of business.  If enough complaints are filed, a pattern of behavior will be exposed.

This is an update to my report written several days ago.  I had issues with the scooter I purchased from EVO sales. After speaking with Moises several hundred times it seems like, we came to a conclusion, although it was not very beneficial to me, I went and paid out of pocket to get my scooter fixed and EVO gave me a labor allowance of $63.** towards my expenses. I had to have a new set of rings and a piston installed on my scooter, their labor allowance barley covered the first hour of labor at $60.00 an hour.

So in the end I got my scooter fixed, but mostly at my expense, it cost me $265.00 total. And they gave me $63 bucks.

And in their company policy it states if you are shipped the "wrong item", which includes the wrong color you are supposed to get a $20.00 refund, well they do not honor this, even though my original order was for a BLUE/WHITE scooter, I recieved a BLUE/SILVER one.

So all and all I still got the short end of the stick on the deal, I purchased a NEW scooter from them, and I spent several weeks dealing with an array of issues with it.

In the future Moises and Rony, you should personally test each and every scooter you sell or shipout, this would prevent problems like this in the future.  This way if a customer has an issue you can tell them, "hey it was tested working perfect before shipment"

For those of you in the past or future that need contact information,  I benefited from this so I'm sure others will that cannot get through to anyone on the 800 number,  here is the Phone number for both of these gentlemen if you need to contact them, Moises 323-620-4789. The owner Rony's number is  323-244-6230.

Rony and Moises,  get upset all you want to but when you advertise free tech support and customers call the 800 number several times and never get an answer from anyone, well the customer has a right to get the help they deserve. And further more before I even purchased my scooter there was problems with the phone lines and I called ten times before Moises even answered the phone and finally called me back on his cell number to talk about business.

Sorry that your shopping experience with http://evosales.com home of the scooter was not good.

Your post is a little confusing, you start by saying that the scooter was damaged in shipping but then move on to talk about mechanical issues. Did you file a claim with the freight company? Shipments are fully insured.

It's not right that you had to pay extra to get the scooter delivered to your door. Our price includes residential delivery with lift gate. Please send us a copy of your receipt from the freight company and we will take it up with them. To the very least, we will get them to refund you any extra charge you may have paid.

The scooter is a 2009 year model that was manufactured in 2008. We advertise and sell it as such.

It's too bad the scooter has multiple problems, but we don't feel that consists of us ripping you off. By your own admission we sent you parts on many occasions. This should indicate that we are trying to resolve your issues.

I'm a little surprised by your claim that we refuse to send you parts. We never refuse to send parts to a customer. If we send a part that does not fit or work, we ask the customer to send us both the broken part and replacement part back so we can make sure we send the correct part the second time around. We even offer shipping reimbursement. Some customers refuse to send us the broken and wrong parts back and we are unable to send any further part in that case. If you comply with our request and send the parts back, then we can send new parts.

You mentioned that there were some labor expenses as well. As per our policy, customers can get up to 7% of the purchase value towards labor. In our response to your complaint against our company with the BBB we requested that you send us a copy of your receipt so we can refund you the labor expenses but we have yet to receive it.

You noticed you are not the first to file a Ripoff.com report against our company. Http://evosales.com has been in business selling scooters online since 2003. We sold thousands of scooters and your complaint is the 3rd one. Even though we feel it's 3 too many, that is not a bad track record.
