My husband saw the Eye Noir and Skin Noir advertisement on the internet and decided to order what he thought was the "Trial Size" for me to try out. I remember him saying "Try these out but don't enjoy them too much because I didn't sign up for the monthly delivery of them, not at $90 a month."So I tried them out and they seemed ok but not really spectacular, just ok. We get the credit card statement and there are 2 charges on for $85.95 and one for $89.95.

I called the first number for Eye Noir and the woman on the other end of the phone asked for my name and address and said that she was having technical difficulties and was going to connect me to another person. The second person was also having technical difficulties but some how managed to find my name. I asked about the larger charges and I was told that my husband had ordered the "Trial Products" at $4.95 and $5.95 plus shipping and when he didn't cancel after 2 weeks he was charged the full retail price. I asked how he was suppose to cancel the trail products and she said by calling them and cancelling, but since he didn't we would be charged. I said that he wasn't aware of this and she said that if I wanted to go to their website, she would show me wher it is on their website and that it is a legal and binding contract and we would be expected to pay.

After a little more of this back and forth conversation, I told her I wanted to cancel and future shipments and that I wanted to return the product. She said that she had already cancelled my contract but that I couldn't return the products. She did offer a discount of 30% on what I had already received. But I didn't want 30% I wanted to know why it seemed that my husband had paid $4.95 for a trial size only to find out that this was the only size and then to be charged $85.95 on top of the first charge. She said that he agreed to this charge and that it was a full and legal contract on their website.

At this point my husband took the phone and started to raise his voice at the woman, told her that we weren't going to pay these bogus charges and that he was going to call the credit card company to dispute the charges and that they had questionable business practices. She remained calm and said that it was all legal and that we would be paying the charges and that we should have the credit card company call them so that she could play back the recorded conversation. He handed the phone back to me and she very calmly said "Thank you for calling, I look forward to talking to your credit card company and have a nice day."

Anyway, the next call was to the credit card company and they took care of the charges. And they seemed to be familiar with the company and the complaints over these type of charges. The credit card company did tell me that I should have requested a cancellation number, but I didn't so they will have to get in touch with the company. And they cancelled the card and issued a new one just in case the Eye Noir company tries to charge anything else to it.

I did go to their website and the only place that had the cancellation policy was by clicking on "Rush my trial" and then by going to the bottom of the web page and clicking on "Terms and Conditions" then scrolling down to #8 where it states that you have to call within 2 weeks to cancel. But they do not provide the phone number under #8. No, you have to click on Contact Us also at the bottom of the web page to get their phone number.

After writing the report on Eye Noir, I checked my email and I received 4 emails from Eye Noir / Skin Noir. 2 of them letting me know that my reoccurring monthly subscription had been cancelled. And 2 emails informing me that my credit card would be credited the amounts that I had disputed.
