I rented a 05 Honda Odysee from them in May 2014 to July 2014. Which at that time they came after the vehicle. Since then there Has been absolutely no communication. Mind you its a rent to own contract. If they take the vehicle that's it, you don't owe them after. Well on Thursaday 2/15/018 I received a summons for what they seem to think I owe them. Nothing attached like the original signed contract to indicate a time frame. I think this is insane and I dont owe them anything

You didn't give the car back...per your own words "they came after the vehicle". Since you didn't deny you were delinquent I can figure I hit the nail right on the head.  

However, at your request I did read their website. Your "Don't owe them 1 penny" doesn't appear exactly correct.

It states for new customers the minimum lease is 6 months prior to return, you had it at most 3 months.  This would leave you with about 3 months still owed to end out the agreement.  It also says they can charge you for excess wear and/or milage.  Not to mention that is if you were delinquent you would not only owe the delinquency balance but any costs they incurred for them to come and get it.

But as I said go to court and if they have the signed contract be sure to point out to the judge where it says you don't owe a single penny.

 If you did your reseaech on the company you would clearly see that its a no debt type of contract. I did not stop payments. You can give the vehicle back at any time and not owe them 1 penny.

So you "rented" a car for about 3 months and just out of the blue they came after the vehicle. Now, why would they do that? Was it because you were paying on-time and the full amount..BUZZ..let's try again. Was it because you had FAILED to make your payments..DING..DING..DING..we have a winner.

The fact that you think you were just renting a car, tells us that you really have no clue.  So you better hope they don't have a copy of the signed contract. If they do, the chances of you losing this case is almost 100%. As I can just about guarantee that them "coming after" the car doesn't erase your responsibility for any debt. In fact since this was a RTO situation, it is very possible that they reposessed it, sold it at auction leaving you responsible for the balance that the loan/lease would have been.

Depending on how much they are suing you for, you may want to consult an attorney. Perhaps the could find you a nice loop-hole.  But what ever you do...DO NOT skip the court date. If you do they will get a default judgement against you and could start futher action such as Wage Garnishment or Attaching your bank account.

Good Luck..you are going to need it.
