Our story is really no diferent from anyone else. We purchased our house almost 9 years ago. The mortgage was hld by WMC mortgage company.

After several years it was sold to Nation Credit. Just last year the "wonderful" Fairbanks Capital Corp. bought ou mortgage and the "problems" started.

The very first month they said that we did not make a payment (it WAS cleared at the bank) they then charged us a 150.00 late fee. When we tried to fight it they threatened to take our house saying that we were behind. We are busy working people and did nt have the time to fight these crooks so wejust paid it.

Several months went by and "suddenly" another payment "vanished". WE were told that our check was returned for NSF. Again, it was cleared by the bank. After showing them proof they tacked on another "late fee" (150.00) and a 15.00 NSF fee (it was NEVER a NSF). Next statement there was a "escrow" applied. After calling FOREVER we finally got ahold of them and was given no explaination for the "escrow" except w were toldto ignore it and we were "current". Next few months went fine.

I broke my foot and was on disability. Called Fairbanks and explained that we were waiting for an insurance check and we may get beind on the mortgage. We were assured all was well and to "catch up" including late fees soon. We got behind two months and sent payments and late fees.

Did not hear from them and money was not clearing bank. The phone calls began. Left messages daily (always got VM) and NEVER returned calls. Which brings us to two days ago.

Two days ago getting ready for work, the local Sheriff serves us papers and states that we are in forecloser, we have three days to pay or they will advertise our house for auction and sell it in 30 days.

Call Fairbanks customer service line and a transferred to a "special" department. They are NOW available. WE are told that our money that we sent was on is way back because they cannot accept it because instead of 2 house payments and late fees (about 2200.00) we now owe them 10,877.70! Whe asked where THIS number is coming from,we are told "fees". They are not sure what these "fees" consist of but will call me when they "research" it.

I told them when they get it to fax it to me. They said they can only give it to me over the phone because it is an "internal document". They are refusing to tell me what these fees are!

They have said however, if we pay them 5000.00 and sign a "forebarence agreement" to pay double our usual monthly payment that they will stop the foreclosure. I have contacted HUD, Attorney Generals Office, OCI, BBB, FTC, Legal council etc. and am told what they are doing is illegal but because my house is in foreclosure there is not much that I can do.

It is looking like we WILL loose our house. We have no other options that we are aware of. To those of you who were just purchased by Fairbanks you BETTER refinance now! You will loose your house. Maybe not today bt yo will someday soon. There is NO ONE looking out for us the consumer.

I might add, FTC,HUD,OCI and The Attorney General's office ALL have complants on file for Fairbanks. Not doing much good

I wanted to let everyone know that I called customer service and requested yet another payment history. This time I actually got one and in 24 hours! I guess they do not mind giving it to me now as we are in foreclosure. The amazing thing is, all of our payments were made! We WERE NOT behind at all. We had been actually paying ahead. It is all right here in the payment history report! They, on the other hand do not care. THEY still say that we owe them! You may want to try to get a payment history. Doubt if you will get it unless you are in foreclosure! Good luck! "Still hanging in there"

Rip-offReport.com is working with officials to help Fairbanks victims. The FTC is the most important complaint that you can file and they WILL get involved with Fairbanks very soon. As for now, contact HUD again, on their website they have a section "Help for Homeowners" it contains a list of lenders that are willing to "help" homeowners that are having financial difficulties. Believe it or not, Fairbanks is on that list. Contact HUD and explain what happened with Fairbanks when you where injured and unable to work. As a last resort, you can file Chapter 13 Bankrupcy to save your home. This will ruin your credit, but then again so will a foreclosure. You should call a banckrupcy lawyer today!!!!
