I was 4 months behind on my mortgage a total of $2,112.00 ( $528.00 per month) and agreed to a forbearence agreement which cost me so far around $5,500.00 with legal fees being around $4,000.00. AS of April 2003 I'v been in constant contact with someone at FAIRBANKS CAPITAL CORP. one person tells us we are paid up to date and another tells you that there is a difference of about $2,300.00 in legal fees that is still outstanding.

I am trying so hard to make myself credit worthy and just when I thought I would refinance I'm again kicked in the face. It seems that FAIRBANKS CAPITAL CORP has my mortgage listed as being in foreclosure which I just filed a dispute with all 3 credit reporting agencies! My house is valued at about $58,000.00 and my balance at FAIRBANKS CAPITAL CORP is around $39,000.00

I FEEL AS THOUGH I'M BEING HELD HOSTGAGE AT AN INTEREST RATE OF 12.35% when everybody that I'v spoken to stated that I should be able to get a much better rate if my mortgage wasn't listed as being in forclosurer and also to my surprise everybody that I spoke to also stated how crooked FAIRBANKS CAPITAL CORP. was.

Time For You To File Your RESPA Letter ..ONCE A COMPLAINT IS FILED FURTHER FORCLOSURE ACTION ON YOUR PROPERTY IS ILLEGAL

Robert, there are steps towards resolution that you can take. per the Real Estate Settlement Procedures Act (RESPA), you must file a "qualified letter of dispute" regarding the erroneous fee's & resulting foreclosure actions. The URL below will bring you to HUD's info on filing RESPA complaints. http://www.hud.gov/offices/hsg/sfh/res/resp2605.cfm Fax your complaint to: Mr. Greg Harmer, Fairbanks Capital General Counsel Fax# (801) 293-2555, his phone # for follow up is (801) 313-2173, you may want to send him an email to let him know it's there ([email protected]). BE SURE TO PRINT YOUR FAX CONFIRMATION REPORT, be sure to include your supporting documentation. ONCE A COMPLAINT IS FILED FURTHER FORCLOSURE ACTION ON YOUR PROPERTY IS ILLEGAL. Beware though, as usual, they are lax on follow up. Request immediately a Payment History going back to the origination of their servicing of your account. Have your checks out & match up dates that the checks cleared as opposed to when they were posted by Fairbanks. Prove that they have s****.. ALSO... be sure to register a complaint w/ your state Attorney General, with HUD ([email protected]) AND with the Federal Trade Commission ([email protected]). Send copies of your complaints & a plea for help to all your local TV stations, Newspapers & radio stations. BE CERTAIN to address PROPER & TIMELY restoration of your credit reporting as Fairbanks is infamous for not following through on that either. AVOID PHONE CONVERSATIONS WITH THEM. GET EVERYTHING IN WRITING. & let us know how it goes.
