In Annie's post, she indicated that her ex husband signed the TITLE over to her. That's fine, but obviously he didn't do anything with the MORTGAGE LENDER. The lender was foreclosing on the home because that is the collateral securing the mortgage note signed by your ex prior to your marriage (probably). You can not include that mortgage note in a bankruptcy because YOU are not the one who is indebted to pay the note. Not much could heve been done unless your EX stepped in and filed BK and included a plan to reaffirm the debt. The other way to have done this properly, would have been your ex to quit claim the house to you and then you secure a new mortgage note with you only on the title and the note. This would have had to happen when the note was in good standing of course. In this case the lender did exactly as company was supposed to do. Foreclose.

Dear Annie, In Claremont, NC. I am so sorry to hear the horror stories as I am a victem myself. However, for future referances. Depending on the type of bankruptcy. #11 is for business owners. #13 is for reconstruction of ones' credit. #7 is for 10 years and perment amnsty. You can roll a 13 over to a 7 as I did and they will have to start the forclosure proceding all over again. Giving you the opportunity to have another forclosure hearing so you may state your case to the local clerk at that time. If I were you I would file a complaint with the Federal Trade Commision they have a web site: I beleive is www.FTC.gov.

Depending on the type of bankruptcy. #11 is for business owners. #13 is for reconstruction of ones' credit. #7 is for 10 years and perment amnsty. You can roll a 13 over to a 7 as I did and they will have to start the forclosure proceding all over again.
