" The first time I did not secure the funds was in April. Our safe is time delayed and I shut it before realizing I did not put one of the register till bags (what we put register money in at closing) in the safe. So I secured it in the bag inside of the register. This time she says I forgot to even bag up the money from the register. I denied it because forgetting to bag the money is something I have never done.
The write up form that had final discharge on it was for using my cell phone on 7/1/12. I admitted to doing that but I also told her I was on my break smoking a cigarette at the end of the building. I was using my break time to use it only just like every employee does including the store manager. "
Allow me to help. This is why you were fired. I likely would have fired you after the incident in april, forgetting to put the money in the safe is a big deal. Also, what is your company's cell phone policy? If they don't want you even talking on it on breaks, then you were violating it. It doesnt matter what everyone else is doing.
As for the workman's comp, you will likely need to hire a lawyer to help you get those funds. You are correct that this incident likely fueled their desire to fire you. In most states an employer can terminate you for any reason except for certain federally protected reasons. They couldn't fire you for claiming workman's comp, but they can fire you for whatever else they would like to fire you for. You will have trouble getting legal help in this situation, you admit to not securing funds in the past. You admit to using your cell phone. As for being discriminated against for being gay, in most states this is still legal. Unless alabama is one of the states that has added no discrimination agains sexual orientation, it is fully legal to fire someone for being gay.
