On Oct. 27, 2004 my husband signed papers to purchase a house at 3428 Hope Drive in Upper Milford, Pa.,from Fannie Mae, with the contingency that the septic pass inspection. The septic was inspected at our expense and failed inspection.

The agent, John Gross with Caldwell Bankers Heritage,(who has since left and gone to another realty company, but still has the commission) for Fannie Mae contacted them and they agreed to repair the septic.

Our first settlement date was Dec. 20, 2004. The septic was not repaired by the settlement date and settlement was postponed to March 2005.

In December of 2004 we noticed a leak in the livingroom ceiling,(while looking through the windows). My husband offered to patch the roof or tarp it to prevent further damage. The sellers agent told us to submit an estimate, which we did immediately. Nothing was done to repair or tarp the roof until March of 2005 when it was finally tarped. The tarp had blown off and the roof was exposed for at least three monthe this summer.

The septic still has not been repaired to date. Needless to say the March, May, and June 2005 settlement dates were not met.

We have had to update our sales agreement due to the time span. Our interest rate has changed to a much higher rate.

At this time, August 23, 2005, the septic still has not been started.

The property has gone to seed since no one has lived there for over a year. They mowed only the front yard and the back yard is about three feet high or more. It is an acre lot and looks like hell from the neighbors view. This is not a fair impression for the neighbors since we are helpless to do any improvements on the house or property.

Our wedding plans for June 2005 were drastically complicated by our not having a place for friends and relatives from out of town to stay.(They were unable to attend due to this fact)

We are renting storage units to accomodate alot of our belongings.

If they do not meet the September 20, 2005 settlement date the septic repair will probably have to wait until the spring due to weather. They have known about this repair for nine (9) months, and still have not started work on it.

They are purposely letting our house deteriate.

It has been almost a year, since we signed the first agreement. How long do we have to wait. We do not want to get out of the agreement, but I feel as if they want us to get disgusted and back out, so they can resell it. It won't work ! We'll fight all the way to court.
