If you are considering buying a timeshare do NOT buy from Festiva Resorts. My husband and I own a timeshare that we bought from Equivest in 2000. In 2007, Festiva purchased Equivest and has since been trying to convert all the Equivest owners over to Festiva. They have been using misleading information and using scare tactics to get over $3000 from each Equivest owner to convert to Festiva.

Basically, they are trying to charge us $3000 to buy what we already own. The sales rep we dealt with made several claims which we found out were false. We have had issues dealing with Festiva to make reservations and get our maintenance fees paid. I have heard nothing good about this company and recently read an account where the Attorney General in Missouri took Festiva to court and Festiva was found guilty of misleading consumers. Numerous complaints have been filed with the Attorney General in North Carolina (where Festiva's home offices are located) regarding the fraudulent activities of Festiva. This company cannot be trusted.

There is a group on Yahoo made up of Equivest/Peppertree owners and if you are an owner of an Equivest/Peppertree timeshare and wish to exchange ideas, share experiences, or get information then join us at

http://groups.yahoo.com/group/Equivest-PeppertreeOwners/. We hope to join together to file a complaint against Festiva.

All they ask you to do is look at it, sure they wanna sell you something that's what sales ppl do. Some folks just want something for nothing, I truely wonder if the ppl complaining have done ANYTHING good for anyone else but themselves? Also another thing to remember is if a negative comment is made it takes ten positive comments to make the one negative comment null and void. No one who gets what they expect goes online and yells about it, and mostly folks who get more than they expected never go on blog sites and tells everyone, Its the people who always have something negative to say that get on and wanna threaten BBB(which is a raquet started by al capone by the way. Did you know wolf gang puck has an f and also a 4 star hotel in manhatten right in New York both have f's with the bbb because they dont pay to be a member while the terror group hamas has an a because they paid $ for it * if you dont believe me check it out on abcnews.com), but any way its vacation people its supposed to be stress free, but it does cost money dont go in and ACT interested if you aren't, my name is Parrish, and I know one thing, if you go into the presentation and maintain the same "no" answer the entire time theyre gonna get you out of there in the 120 minutes, back to your vacation and your money you saved and to your nice accomodations. We are the best company when it comes to giving you a value and being able to spend time with you're family. I dont even work there any longer so I dont even know why Im writing this but, they are good to the employees, good to the family members/customers, and Im notsure if you noticed but the owner Mr. Don Clayton, has his own cell phone number in this blog, how many ceo's on this site have done that ? call the number and deal with your issue or stop complaining about stuff and take a flipping vacation

In response to the statement that you sent my attorney a letter. My attorney has received nothing from you. Period!
Also, in response to my complaint to the N.C. Attorney General, you supplied them with a document that you claimed we signed. Those are not our signitures on that document. I don't know who signed our names on it but it certainly wasn't my wife and I.
I ahve instructed my attorney to forward that document to the District Attorney in Charleston to investigate. You people do nothing but tell lies and avoid complaints

This is for the Representative from Festiva. Both myself and my attorney have tried repeatedly to contact your company, both by phone and certified mail, and NO ONE has ever replied to either one of us. If you truly want to resolve this you have my attorney's information. Please have your legal department contact him.

As someone who has been ripped off by Festiva I urge everyone to file a complaint with the North Carolina Attorney General. The address is:

State of North Carolina

Dept. of Justice

Attn. Consumer Protection

9001 Mail Service Center

Raleigh, N.C. 27699-9001

Festiva is based in North Carolina.

If you purchased Festiva in South Carolina as we did, please also file a complaint with the following:

Executive Secretary of Compliance Dept.

Real Estate Commission and Appraisal Board

Kingstree Building, Suite 201

110 Centerview Drive

Columbia, South Carolina 29210

If we all have any hope it's going to be by bombarding these agencies with complaints.

Don't believe it

Don't believe it when Don Clayton, CEO of Festive says to contact him. Been there done that. All you get is a run around and no one ever gets back to you, let alone Mr. Clayton. I have had to obtain an attorney. Festiva is a total ripoff. All that you'll accomplish by trying to call them is to run up your phone bill.

I have been trying to join the Yahoo Group referred to in this report, but so far have not been approved/allowed access.  Who can I contact to move this along?  I have also filed a separate report/complaint regarding the misleading practices of Festiva Resorts management and would like to give it more exposure if possible.

Thanks for your help.

My husband and I are very trusting. Festiva has broken that trust on several levels. Adding insult to injury, the man they sent to pressure us into changing over to points actually came to our home and sat at our kitchen table and lied to our face. He said if we didn't do it that night, we would eventually have no choice and it would cost us a lot more. Needless to say they took another $3,000.00 of our money. I have never filed a complaint because I didn't know how, or where, to complain. I live in Virginia and would love to know if there are other people in my state that have had bad experiences with Festiva. How can we hook up?

Buyer Beware of Festiva/Timeshares

#14UPDATE EX-employee responds

Mon, August 11, 2008

If you are considering buying TIMESHARE do NOT purchase with Festiva Resorts. As a former employee I know that they hire and retain sales people who have criminal records. Many of them have drug and alcohol problems. They LIE, PRESSURE YOU, and MANIPULATE. When they approach the consumer they tell you it is a vacation club....it is simply TIMESHARE using a points system. Points do not work well. They are difficult to use, lose value each and every year, and will not put you in a great vacation destination in prime season. When going to a Festiva property they take you to the "model" which is always so much nicer than the units available when you return to vacation. YOU HAVE 5 DAYS to CANCEL if you have purchased a timeshare. USE IT and send them notice by certified mail. Contact your credit card company and reverse the charge.
