my bank said they could not open my old account so i could get a refund.

I got an email from phonebusters to call them. the guy told me to close my account right away so i did and opened another account at the same bank.
I also faxed them a complete statement of what happenedm and a copy of my bank statement that they debited $219 from.
I contacted my bank today and they said i could get my old account opened again.
so i guess i learned an hard lesson. i just wish i wasn't in debt worse because i depended on the so called credit cards to be sent to me.

Don't give up! You can get your money back! It takes alot of work, and patients, but if you have it then you can get your money back!!!
This is what I did starting on Friday Sept. 6th and got a response today...Sept. 10th!
First I filed a claim with my bank (even though the money was taken out in June)Second I filed complaints with FTC (www.ftc.com), BBB of Greater Maryland (www.bbb.com), FBI (www.fbi.com), News media, Attorney Gernerals office (www.naag.org), Phone Busters (www.phonebusters.com or call 1-888-495-8501), www.consumer.gov, www.ripoffreport.com
Contacted their funding bank Pacific Mechantile 1-800-498-3063, and United Capturdyne (the processing company that debits you account for them) 1-800-476-4828, and called every number that I have found for First Capital and harrassed the customer service people to have someone call me a good numbers to call and get a hold of them at is: 1-866-898-8999, 1-899-484-1271, 1800-787-1583.
Third After I did all of this...I called UNITED CAPTRUDYNE AT 1-800-476-4828. NOW PAY CLOSE ATTENTION TO THIS: When you call they ask for the company who debited you account and then try to give you a 800 #, I promptly told the ladies (Patricia,Robin,Bonnie) what had happend and demanded to talk to their supervisor because this is fraud, and that i couldn't get a hold of first capital consumers, i then was given the run around, i told them that i wanted to talk to a supervisor NOW, and if they didn't let me then i would report them also for being a 2nd party to the scheme!
Imediatly I was connected to Keyanna who is the manager, I told her my situation that first capital had debited my account for 2 credit cards which i never recieved, and i demanded a refund, because it is against the law for them to withdrawl monies from my account with out first rendering services, she told me that she would have first capital contact me and they would take care of this situtation.
I then added that if I was not contacted by them and refunded that i would also report them for having part in this fraud and i would be having my lawyer contact them. She insisted that they have no part in this with them (she is lying, they are the ones that debit your account for first capital, and process all of first capitals finances)
I then said to her oh yes you do, you are the ones who debited my account and you are THIER processing company right? She then said yes we do thier processing and debit accounts for them, but it is all done via wire transfer.
I then told her that if that is so, then they are just as much a part of the scheme as they are, for offering sevices and debiting accounts with out first rendering services or rendering the credit cards at all, and that if she didn't personally talk to first capital consumers i would be having my lawyer contact her personally! Well she assured me that she would personally send my information and request for my FULL refund back into my bank account to them promptly by 3pm that day (yesterday, 9-9-02) to First Capital Consumers. Well this must of set a fire under someones a*s because today 9-10-02 at 12:22pm I had a voice mail message from First Capital Consumers, it stated: "Hello this message is for Mr. Robert Betts, this is First Capital Consumers and we have issued a Full refund to your account please allow 10 days from tomorrow for this to post onto your account, again this is First Capital Consumers and we have issued you a FULL refund to you account!" The number on my caller Id says: Toronto,On 1-416-488-1269.
The MAN who left the message did not state his name nor a number that I could reach him at, and I called this number back to confirm the message and no one answered..so lets hope that it DOES get back into my account!
I will post an update when the refund is posted to my bank account! I hope that this can help you, and others that may read this! Please do not close your bank account out because if you do happen to be able to get a refund, they will need to refund it back into the same account it came from. BUT in the mean time keep a low balance in it like $10 and monitor it closely to see if you get a refund or if they try to swendle you out of more money, OPEN a new account and remember DO NOT GIVE OUT YOUR BANK INFO OR PERSONAL INFO TO ANYBODY OVER THE PHONE!!!
