I opened my bank account with First Convience in the latter part of 2008. I requested that I only receive a debit card due to previous banking experience with checks and I did not want to get hit with fees. Little did I know that debit cards could be overdrawn too! I had made a purchase and went over by a few dollars and was accessed an overdraft fee so I went into the bank to see what was going on. I explained to them that I was not aware that debit cards could go "over their limit", because as far as I knew if there was not enough money on a card it would decline.

 

They offered me a "No overdraft privelege" which would not permit my card to go over the limit from that point on. I really didn't use the account much, my sons dad wired his child support on it and I would use the money to make purchases but nothing major. Well December of 2010 I went to use my card at Walmart and I was not quite sure how much was left but I was comforted by the fact of my "no overdraft priveledge" so I swiped and it went through. Next I went to redbox and got two rentals.In January my sons dad did his usual deposit and me being in the complete fog I was in (I had not received 1 letter about the overdrafts!!!) I used my card for a couple more purchases.

For some strange reason I felt the need to check the account, which I hardly ever do because of the "NO OVERDRAFT PRIVELEDGE!!!" as consolation, and to my dismay my account was -$218!!! Un beknownst to me I had accrued 5 overdraft fee's (two followed shortly after that). I went to the bank where I had signed the paperwork, called the 800 number, threatened them with the Comptroller of the Currency, but to no avail. They said they showed where I had signed up for the protection in January, but they said that I had a conversation with someone in June to have it removed. Hmmmmmmmmm.....if I didn't want it in January why in the world would I request if off 6 months later. I contacted the original manager who signed me up, he said that he could not remember me and that he would check into it and call me back before 5.

Well he didn't, and the next day I called him 5 times and they said he would call me back after he finished with customers but no call back. I guess he was too busy swindling more unsuspecting victims into this bank robbery. I feel so helpless, I did everything to ensure that this would not happen and they found a way to ripp me off. I asked about not recieving one letter for all of the overdrafts and there reply was that since I had requested e-statements then they just emailed the letters to me. Really??? I don't even check their emails, I count it as junk because this was just a junk account to me. I am livid because I have to pay these people all of this money because if I don't, they will be charging me $2.49 a day until I do....for a whopping 60 days! Talk about no vaseline! This one really hurts!

I don't need to hear anymore about your experience with First Premier...just the fact that you would agree to their terms displays your lack of good sense.

But the real difference between you and I, is I can understand people make mistakes. I do not automatically assume anyone who feels they got ripped off by a bank is stupid, lazy or a failure. Nor do I judge the merit of the report based on spelling errors.

While I do agree this poster may not understand that she did actually sign up for overdraft protection with the debit card, I can state that if she did not sign up for it, she has a case. This is why she needs to ask the bank for documentation. Otherwise, I agree, the report has no merit. But it does no one any good including the bank, to call this poster names. Not everyone is perfect as you Steve so cut them a little slack. Maybe she needs to use First Premier? I understand their terms are great for illiterate sub prime customers.

Your babbling is making absolutely no sense. What does a checkbook register have to do with a credit card?

My deal with First Premier has absolutely nothing to do with anything here. They were simply too incompetent to post a payment that they had recieved 3 days prior to the due date, and subsequently put me in collections for their mistake which I have proven. And, as a result I closed both of my accounts with them. Now I have a credit balance, and they owe me money.

Now, back to the OP's "issue". The ONLY reason this person had problems is the failure to properly manage her account with an ACCURATE checkbook register. There is nothing criminal here. And no civil case either. This person is just stupid and/or lazy and ended up being charged the fees shee agreed to when the account was opened. Just look at this illiterate retard. She cannot even spell the name of the bank that allegedly ripped her off! This person is simple too stupid to live. That is the only "crime" here. And the civil fraud is against the taxpayer because we footed the bill for her schooling.

The bank has done absolutely nothing wrong here, I'm sure.

Your ONLY problem is that you cannot or will not properly manage your account.

What is so hard about 3rd grade math?

Keep an accurate checkbook register and your problems will go away. Guaranteed.

Lazy and stupid is a bad combination.

And for Ronny G, the bank CANNOT face "criminal charges" as you stated over the opt out thing. It is a civil matter, NOT criminal.

First off, the purpose of opting out of overdraft protection with the debit card is NOT so you can go on wild spending sprees and have no worries. You still need to keep track so you know what you have to spend from the account.

The purpose of not opting in (since banks can no longer by LAW automatically opt you in..you HAVE to sign up for it and agree to the terms) is so if you make a mistake or become subject to an unknown or unauthorized hold or charge..you won't suffer a fee or fees.

You are GAMBLING plain and simple..and hedging you bets that the bank will protect you is not different then standing on the train tracks and hoping the reason you don't get run over..is maybe the train will de-rail.

Now..either you signed up for overdraft protection with the debit card or not. Ask the bank to show you where you signed up for this service. If they can not present this evidence, they MUST reverse all charges or face CRIMINAL charges. If they can produce it, then you are stuck paying for the use of this "service", but make sure you tell them you wish to opt out..and SIGN this on PAPER and keep a copy for your personal records.

There is NO reason any debit card charges should have been approved if the account could not cover it if you did not voluntarily sign up for the coverage..no if's, and's or but's.

And for your own sake..keep track of your account balance yourself..if you depend on the bank to do this for you..history has shown they use this to fleece you into the poor house.
