 In the Spring of 2011 I applied for and received a Walmart and Lowes Credit Card which was offered by GE Capital Retail Bank. Once I was approved I was offered and enrolled in credit card insurance or GE Capital's Debt Relief Insurance. When I applied for and received the live of credit for both retail establishments I was only a part-time employee working anywhere between 12-32 hours per week based on the current payroll allocation.  

 In May of 2011 I unfortunately lost my job through no fault of my own and was able to continue to make monthly payments until November 2011 when my unemployment ran out. I filed a claim for benefits under this optional Debt Relief Program that was offered to me, since I lost my job through no fault of my own.

 I completed all the required forms that GE Capital Retail Bank Card Security sent to me and also provided them with proof of my unemployment status and copies of payments as well as copy's of my paycheck stubs from my previous employer. 

 In mid November I received a letter denying me benefits because I was quote: "Working on a part-time basis. The agreement requires that you be gainfully employed on a full time basis (30 or more hours per week) in a non seasonal occupation when the loss of employment occurs in order to qualify for benefits."

 I disputed this with GE Capital and I was told "you should have read the fine print". GE Capital Retail Bank did not ask, nor did they know that I was a part-time wage earner; until I filed for benefits under the policy that was offered. As a part-time wage earner I was good enough to apply for and receive credit with two different retail establishments. I was also good good enough to be charged, and pay the monthly fee's for the added protection in the even that I lost my job though no fault of my own.

I continued this dispute with the Better Business Bureau, and GE Capital Retail Bank stated that as a honored card holder of Walmart that they would refund my all of my payments for their debt relief program to my credit card, however they still continued to charge me for the program, but deny me the use of its benefits. When I spoke to Walmart they stated that they have nothing to do with this and to settle my dispute with GE Capital Retail Bank. I called GE Capital Retail Bank, and they told me that they have nothing to do with the card security program; when I talked to the card security center they told me, oh well sorry.  

Since then GE Capital has turned me over to third party collections. I feel that this is possible borderline fraud, and misrepresentation by GE Capital Retail Bank.

 Anyone one have input on where I should prceed next? I am thinking about filing complaints with the Attorney Generals office where I live and in Georgia.

Thank you for your input,  it would seem that you may work for or have a vested interest in GE Capital Retail Bank or their card security program, if you do not then please accept my apology under the assumption that you may have.

If I did not qualify for the insurance benefits, why did the agent I spoke to on the phone in October of 2011 say that my qualifying event was loss of employment due to no fault of my own which is an acceptable qualifying event under their terms and why did she mail me out a claim form to fill out if I did not qualify according to the terms of the agreement?  I would think that if I did not qualify to file a claim then GE Capital Retail Bank should not have mailed me an application and should not have told me that i had a qualifiying event.  It would appear to me that there was an apparent mistake on behalf GE Capital Retail Bank/card security program. I should have been told in October of 2011 that I do not have a qualifying event based only on part-time employment. That never happened, again GE Capital allowed me to file for a claim under the terms of agreement of their insurance policy.

GE Capital Retail Bank stated in a letter to me that I elected to recieve communications electronically I do not believe this to be accurate. Since the inception of the account I have been receiving statements via regular usps. I asked for the terms of agreement on 2 different occassions, it was not until after GE Capital Retail Bank denied my claim and after GE Capital Retail Bank received a BBB complaint that they sent me the terms of agreement in duplicate and highlighted.

I was also told that the card security program is a different entity from GE Capital Retail Bank,  and that they have no vested business interest with them, it has recently occurred to me that, that was a false statement made to me. It would appear that GE Captial Retail Bank/Card Security Program are an all in one business, maybe in different cubicles but one in the same.

You also mentioned that all the phone calls are recorded,  I asked to listen to the recording of my conversation with the agent in October of 2011 when I called to obtain information on filing a claim and I was told that I could not as I do not have permission to listen internal communications. 

Also there are individuals in todays business that work 32 plus hours a week, but are still only considered part time by their employer. If these indivuduals have this insurance policy; is GE Capital Retail Bank going to deny them benefits under the prgram that they paid for because when the person(s) fills out the claim form and they indicate that they worked only Part-time when asked what type of employment (which according to GE Capital Retail Bank is an automatic denial)even though they have proof that they worked atleast 32 hours per week, will GE Capital Retail Bank hold up their end of the agreement to the person(s) who are struggling due to job loss, and economic hardship; or will they be told "to bad" pay the bill or we will turn it over to collections.

Which GE Capital Retail Bank did do with me, and those Collection Agencies now face a Federal Complaint for FDCPA violations, and harrassment (Calling me on 2 different phones every 30 minutes, more than 20 calls in 2 days); So in the end this will be heard and brought to the attention of the appropriate indvidual(s).

 had I known that at the time of card application, and approval I would not have chosen an insurance policy that was offered to me with certain conditions and limitations by GE Capital Retail Bank.
- In effect when they refunded you the premiums they took it back to "square one".  That is, it is now like you never even signed up for it in the first place.  You now would need to contact them to actually cancel the program.

I somehow think you knew you were not really covered, or you might have issues.  Because if you truly thought you had this insurance that "kicks in" when you loose your job?  Why in the world would you not put the claim in immediately? 

Perhaps you read some "fine print" that said you had to wait until unemployment ran out?  If so how did you miss the "fine print" on the number of hours you had to work.  Perhaps you suffered from selective reading?  Or were you really just trying to be nice to some huge corporation by not making them pay for an additional 6 months?

I would just like to say that there are 3 ways to sign up for the card security program. These include online, through the mail, and over the phone with a customer service representative. Online you are provided with the full terms of the program. Through the mail you receive a response with the terms, and on the phone you are read a script that the representative is required to read word for word. Here is a quotation from that script.  It is so long that it takes approximately three minutes to read through completely. I will quote the part that pertains to you.

"In order to qualify for the unemployment and leave of absence benefits, you must me working full-time, at a year round job and cant be self employed." If this entire script is not read verbatim, it is no longer a valid sale. GECRB listens to every single sale made, since it is recorded, to verify that it meets the requirements.  If any portion of this is not read, a letter is sent out to you advising you that they were unable to add the program to your account with all of the information, and to respond if you would still like to enroll in the program. You are sent the full terms and conditions in the mail afterwards as well. You are provided with a phone number at the time of the sale for further questions. As GECRB has no control over the postal service, it would be your responsibility to contact them if you did not receive the information.

Thank you for submitting your opinion, which is just that.

The terms of service from GE Capital Security were not provided to me until after a complaint was filed with the BBB which was resolved to my benefit.

I do not believe that I ever stated that I did not read the terms of service, that was an assumption on your part and we all know what the definition of assume is; had I known that at the time of card application, and approval I would not have chosen an insurance policy that was offered to me with certain conditions and limitations by GE Capital Retail Bank. The credit card agreement  that was given to me by GE Capital Retail Bank itself does not contain any language pertaining to card security. GE Capital Retail Bank contends that the card security program is a seperate enitity from them and therefore has it's own rules and language regarding terms of use.

As far as your off the wall comment regarding filing a class action lawsuit...grow up.

I am just a consumer exercising my rights to inform people about my experience with GE Capital Retail Bank, so they do not have to experience a situation like this one. Your reply was noted as well as your condescending attitude towards my post and me as an idividual.

but you accuse them of borderline fraud and mis-representation...right so far?

Have you read it yet...and what does it say?

You state they did not ask or know you were a part timer and YOU didn't read the contract...sounds like a match made in heaven.

Good luck with your BBB complaint and the threat to file a complaint with the Georgia AG, it's going exactly NOWHERE.

Why not file the ever popular "class action lawsuit" against them?
