We all need to send them a message that consumers are not going to take their harrasment anymore. I have just submitted my rip off here, and I suggest everyone here that has a beef against GMAC join in a lawsuit against them. I am sorry that you have lost your house on the account of these BLOOD SUCKING LEACHES proud to call themselves GMAC.

Your story is VERY similar to ours. There are attorneys looking into filing a class action against GMAC Mortage, but they need to hear your story. Google "build a case GMAC Mortgage", and that will take you to my Rip Off Report. Also, I have set up a google group for "disgruntled gmac mortgage customers". Or you can visit buildacase (.) COMpany, and get help that way. DON'T GIVE UP...GMAC will get what's coming to them, if enough people get their stories out.

You ask about where I received the information regarding dropping the bankruptcy. If you go to hudclips.gov, I believe is the website, they have all the handbooks that contain HUD rules and regulations that mortager servicers must follow regarding loss mitigation. In there I found a regulation stating that neither hud or the mortage service can discuss the mortgage or any rememedy if the mortgagee is in bankruptcy. So I then emailed HUD asking them if I dropped the bankruptcy then would I be able to enter into loss mitigation with GMAC in order to keep my home and they said I would. As to why GMAC had dropped the previous foreclosure filed. I had supplied HUD with evidence that GMAC had never entered into loss mitigation with us before filing the foreclosure. Even though I had tried to work with HUD and even sent to them payments in order to bring the mortgage current. GMAC had refused my payments that I sent to them by western union. HUD requires that all mortage servicers on FHA insured mortgages implement loss mitigation on deliquent mortgages in order for homeowners to keep there home and so that FHA isn't required to pay an insurance claim to mortgagors (GMAC). You see if you have a FHA insured mortgage and it goes into foreclosure, the government has to pay a claim to the mortgage company. They don't want to do that if at all possible so that is why they require mortgage servicers on all FHA insured mortgage offer homeowners help in order to save their homes. The problem is HUD doesn't follow their own rules and instead of protecting homeowners, let alone tax payers, they protect big mortgage companies which is not what HUD is suppose to do. IAM VERY SURPRISED THAT HUD GAVE YOU THE SUGGESTION THAT YOU MUST DROP THE BANKRUPTY FIRST I WOULD LIKE TO KNOW WHAT HUD RULES GMAC VIOLATED WITH THE ILLEGAL WHAT KIND OF PROOF YOU PROVIDED TO THEM ? SECOND HOW WAS GMAC FORCED TO STOP THE FORECLOSURE ? THE REASON IAM ASKING THESE QUESTIONS IS TODAY I HAD A CONFRENCE WITH AN ATTORNEY SHE TOLD ME THAT BECAUSE I SOLD MY HOUSE WHILE GMAC WAS ATTEMPTING TO FORECLOSE ON IT AND THAT I NO LONGER OWN THE PROPERTY THAT I CAN NOT CLAIM DAMAGES FROM THEM YOU SEE GMAC DID THE SAME TO ME THEY REFUSED TO ANWSER QUESTIONS ABOUT THE WHO WHAT AND WHY THEY WERE DOING THIS A MULTITUDE OF CERTIFIED LETTERS WERE SENT TO THEM AND WAY TO MANY PHONE CALLES AND FAXS SO AS OF TODAY I HAVE FILED COMP[LAINTS WITH THE FOLLOWING THE STATE ATTORNEY GENERALS OFFICE ,THE FLORIDA INSURANCE COMMISH OFF AND THE FLA BANKING COMMISH I ALSO SENT A COPY OF THE COMPLAINT TO GMAC I WOULD SUGGEST YOU TRY DOING THE SAME I HOPE THIS HELPS THANKS DAN
