GMAC bought my mortgage, my boyfriend got sick, we were late and i called them and made a repayment plan, in meantime i got a letter from another company saying they bought mortgage.

so i sent the repayment to them,then someone knocked on my door saying GMAC was forclosing and they wanted to buy my house, i said i dont have gmac anymore, so i called the new company who told me they only bought the 2nd (i was assigned a 1st and 2nd at time of purchase) the second company would not refund me.

so i sent gmac my reciept for the payment to the 2nd company and told them of the mix up, so they told me they would go over the repayment plan agian and take care of the forcloser thing, she told me not to worry about filling out the 20 day court paper so i didnt.

then i got a letter with a court date, and i called her back, she said my phone was disconnected (same # for 30 yrs and still the same)she told me to not go to court she would take care of it,

i went today and they called my name, they said they were never contacted by gmac and gave a 60 day extension on the sale, now today they said they want $2000.00 tomorrow for me to keep my house, they also lost the note and want a new one from the court and they have the wrong date for default, any suggestions would be appreciated........they aslo never informed the 2nd company of foreclosure, i did,

i am current with 2nd holder i only have hours to come up with 2,000 dollars

they also didnt credit payments and told me to forget about them why am i so insistant about missing 1,000 worth of payments

DUH!! they are totally incompitent

Will you please turn them into the department of corporations for RESPA guideline violations. They have a web site that you can download the complaint form from. Please fill it out and send it in also tell your attorney to file a civil suit for professional negligence and intentional infliction of emotional distress and tell him this is a tort action and to seek punitive damages. Everything he will need to know can be found in the BAJI(jury instructions) which is spelled out step by step. Example:Tort negligence is the evaluation a companies conduct in which you will have to establish the following elements: DUTY- did GMAC use reasonable care and if that care fell below the standard of conduct which did not protect others against the unreasonable risk of harm. BREACH- failure to conform to the required standard that mortgage companies are held to. Causation- were your injuries as a result of their conduct. This would be negligence per sa! Damages- as a result of their negligence did you suffer emotional distress and actual losses. Please file a civil suit and have your attorney as for a jury trial. There will be a strong likelyhood that those jurors have had past problems with a mortgage company or know some who is in your same situation. WORK THE LEGAL SYSTEM ITS YOUR RIGHT TO BE HEARD!

Everything worked out great at the attorney!!!!!!!!!!! I am going to keep my house!!!!!!!!!!!! I also told him of what is going on with others and that i am going to share my proof with them, and hopefully a class action suit,and guess what he said............HE IS WILLING TO HELP isnt that great...he told me that he chose to study this kind of law because it had personal meaning to him (parents)we talked at great length and he told me not to worry about this he will have it fixed next week with a court hearing which he told me he would turn into many hearings......since i have a degree as Associates in Paralegal he is going to write me a list of things he wants investigated. remember when i told you i had 60 days till i go back to court. the judge said we would revisit in 60 days because of the aggreement i had with GMAC, well today i got a letter from the lawyer who appreared by phone saying the sale date was set for sept 2006 and he was given a new note, (remember the lost one) that is a total and complete lie........the judge would not talk about anything for another 60 days.....boy i am gonna screw this bunch of *&^%$* to the wall........ Hi, Thanks for writing back now that i re-read it i can see where you can get confused, to answer your ??? GMAC bought my loan in Feb. 2006 both notes, then in April he got hurt, i was behind 2 payments but they wanted all these fees for being late, so the woman said i could split them up and she was giving me 30 days to get the first payment to her, then before i could make the first payment i got the letter from the new company, so i thought well i will go ahead and send them the new payment plan money so noone can say i didnt pay. before the next payment came up which was the 2nd one in the plan is when that woman knocked on my door saying i was being foreclosed on. GMAC never notified me of the sale, but the other company did, in fact they sent me a letter saying they were the new servicer.they stated how much the loan was (which was the entire loan)so i figured it was sold again together. when i called the 2nd company and told them of the mistake they said GMAC didnt send you a GOODBYE letter? i told them no the only letter i got was yours. they said well we only bought the 2nd mortgage and it hasnt been paid since november of last year (2005) and i told them yes it has been paid, to date when you bought it. so i got all the reciepts and sent them to them so they would bring me current. the 2nd company thought that i owed them that big check for a back payment so they wouldnt refund me. I NEVER GOT ANYTHING FROM GMAC EXCEPT THROUGH THE COURT. THEY REFUSE TO DO ANYTHING TO HELP ME, THERE IS NO TACKING ANYTHING ON THE END OR ANY OF THE OTHER THINGS I HEARD CAN BE DONE, THE PEOPLE WHO WORK THERE ACT LIKE YOU HAVE TAKEN THE FOOD FROM THEIR MOUTHS PERSONALLY. gmac told me the last time i called them fri if i want my house send an overnight check for 2,000.00 and pay all the fees for the attorney and i can keep my house..........Wed. i have an appointment with an attorney.it seems to me they were right on top of me, the harder i tried to work with them the more they tried to bully me and add more charges, then when i told them that they didnt apply more than 1,000.00 worth of payments to a 250.00 a month 2nd mortgage they said i never paid, then when i proved it to them after a couple of months of arguing and insisting i did then they happend to find them. On fri i called and asked for a payment history to be sent to me for both accounts, so i can verify the payment dates to the dates on the checks. i got the one for the 2nd mortgage and somehow the y credited the acount 4 days before the payment was made,when before they said no ayment was made. so that shows they made forgeries on my account. i have been maintaining contact with the 2nd mortgage holder and i faxed him the payment statement they sent me and he asked me when i sent the check because the dates dont jive, how can they apply a payment 4 days before the check arrives, and i told him that those particular payments were "CALLED IN" on the 14th so i dont know how they creditited them on the 10th. i remember the day i did it and the bank statement shows the date it was called in............

Hello Susan, From reading your report I can tell you are very upset and worried. First things first, Susan take a couple of deep breaths and try to calm down. It is extremely difficult to understand what GMAC is doing to you from what you have written. Please answer a few questions to clarify your situation. Who was your original mortgage company? When did you receive notification from that company that your mortgage note was sold to GMAC? Did the original company also say that your second mortgage had been bought by someone other then GMAC? Did Gmac and the second mortgage company send you notification that your mortgage note had been sold to them, if so, when and to what address did they tell you to mail your payments? When did you become delinquent on your loan? How many payments are you late on the loan? What are the terms of your repayment plan? If GMAC had received the payment you mistakenly sent to the second mortgage company would you have been current on your repayment plan? Did GMAC send you breach letters informing you that they had not received your mortgage payments and if so when? When did you receive notification from GMAC that it had started foreclosure proceeding? How many payments has GMAC failed to credit to your account? Why is GMAC demanding you immediately pay it $2,000? I am asking all these questions so that we the ?stopgmac? yahoo group can offer you some helpful suggestions. We are not lawyers nor do we give legal advice, however, from our own experience we are often able to steer people with similar problems in the right direction.
