GMAC Mortgage Screwed Over buy GMAC mortgage!!!! Now we are aggressivly fighting this horrible and outrageous company, I see a class action Lawsuit coming!!!! Louisville Kentucky
In 2003 we recieved a phone call from GMAC mortgage that we were behind on our Ecsrow, so we sent them a check to balance out the escrow, thats when the fight began, they said they never recieved it and we had proof that the check cleared, so after months of trying to get this problem rectified, I was watching TV with the family one SUNDAY afternoon and recieved a call from a bill collector saying that we owed GMAC a payment of $6,000.00, and they stated that if we pay it over the phone we would then only have to pay $4,500.00, good common sense told me something wasnt right here, so I basicly told them where they could put the $6000.00 bill.
We continued to fight them on this issue thinking we could get it resolved, but to no prevail, we ended filling chapter 13 to get them off our backs. My wife and I thought finally we were protected by the laws of the chapter 13. Last week we get a call from our chapter 13 attorney that GMAC is trying to get our case dropped so they can come after us for being late 2 months in a row, I guess they werent smart enough to see we have been paying electronically since 2004, and have records of every payment.
We are waiting to here from our attorney on what is going to happen but I am already contacting our local news station and my state represenative, companies like this need to be stopped. they are hurting no one but our working middle class that go to work everyday and try to make a life for them and there families, and I guess I am upset about this whole mess because I cant believe companies are getting away with screwing people over like this in the age of e-mail and internet, sounds like a class action lawsuit to me, I challenge any attorney that may read this to stand up and fight this outrage.....

Tom, we too filed b/r. Chapter 7 though. Be very careful.....you will make payments etc. Then, out of the blue you will get a foreclosure notice b/c the payments you have been making will be going to bankruptcy fees and penalties that they will not share with you at all until its too late. When it comes to them, sleep with one eye opened. My advice inquire steadily before its too late.

WHEN I WRITE A CHECK, MY BANK GETS IT BACK & I HAVE A RECORD IN MY CHECKBOOK FROM WHEN I WROTE IT. IF SOMEONE I WROTE A CHECK TO COMES BACK & DENIES IT LATER, I CAN PROVE THAT I PAID IT, IF THAT DOESNT WORK I WOULD FILE LEGAL ACTION TO PROVE IT, NOT FILE BANKO!! UNLESS YOU PAY EVERYTHING WITH MONEY ORDERS!! IF WE SNIFF REALLY HARD ARE WE GOING TO FIND A ROR ON HOW YOU WERE SCREWED BY THE BANK ON YOUR CHECKING ACCT. I BET WE WILL!!

Well first off I guess the proper english may have thrown you for a loop MR Bill, I myself do not need assistance from any attorney, I have my own ALREADY fighting it but thanks for the help locating one lol you really should read each thread and try to comprehend it before you reply. Also, you may want to read the other threads of victims of this monstrosity, that I might add were victims of the same scam that we were. And oh yeah I almost forgot, the discrepancy in the missed payments were do to GMAC not appropriating the funds in the correct account, but I appreciate you response it will go in my recycle bin along with all the other garbage I get :-) Please dont repsond again you will show us all once again how itelligent you are. P.S. I am sorry if I offended you maybe it was the part of the working middle class.

CALLING ALL ATTORNIES THAT WANT TO WORK FOR TOM FOR FREE..HE IS IN CHAPT13 SO YOU KNOW HOW RELIABLE HE IS. SOMETHING IS MISSING, HOW DID YOU MANAGE TO NOT PROVE THAT YOU PAID THE MONEY IN THE 1ST PLACE..SOMETHING IS MISSING FROM THE STORY!!!
