Dear GMAC MANAGER:

My loan had switched hands twice since 9/1/06. My loan has been through 1st National Lending Services to whom I have made all payments to April since October. Due to incorrect address being passed from Loan Institution to Loan Institution, I was not informed by mail or other that I had switched FROM 1st National. Sheldon from 1st National will verify that ALL of my payments were made on time and that the address error continued through no-fault of my own and unknowingly since the first article of mail from 1st National did arrive to me, but nothing else since September 2006. Sheldon can be reached at 888-560-2280 to verify. I AM JUST NOW RECEIVING MAIL FROM GMAC FOR THE FIRST TIME SINCE APRIL 24th 2007!

During the interim of the transactions and changes, a payment was missed by GMAC. I have now paid up to date, but refuse to pay the late charges due to incorrect information and inability to inform and contact me when one of the payments ended up missing (check was forwarded in the mail, but apparently not received) and then deducted electronically and then put back into my account, deducted electronically, then taken out and then at some point put back in which threw my whole payment schedule off since December apparently. My assumption was that GMAC had taken over 1st National who I had authorized to do automatic withdrawls and these continued every month to March.

I have cancelled 3 checks now and made two payments via automatic withdrawl over the last two months from my checking with your Collections Dept since 4/24/07 when I, FOR THE FIRST TIME WAS INFORMED THERE WAS A PROBLEM and went back to 1st National, then to Heritage (where I could obtain NO information whatsoever due to no information on my account) and I was unable to talk to a live person to get anywhere with Heritage. This whole incident has cost me $75.00 in cancelled checks and day of my vacation getting to the bottom of this and my credit is now threatened.

I WORK IN A/R COLLECTIONS. Since your representatives that I have spoken to at GMAC recently are either deaf or daft or believe that I am, I have been unable to make the points that:

* GMAC was taking deductions out of my account without my permission illegally, my checks were addressed to 1st National and I was never contacted.

* GMAC has been taking deductions from my account and missed a payment and is now making me accountable for it and ruining my perfect credit on TOP OF IT.

* Telling me that they cannot reverse reports to TRW, or CBI or whomever the credit agency is to whom they report, which I know IS NOT TRUE. I HAVE HAD IT DONE FOR MY DAUGHTER.

* GMAC smacks me with an Insurance Policy which is twice the cost of mine. I assume someone is getting a kickback or a commission for putting Balboa in place because I haven't responded in 90 days (see above). WHEN I AM ALREADY INSURED through JULY (see attached).

In case you are not understanding yet. MY ADDRESS WAS WRONG, my telephone number never was and NO ONE HAS EVEN TRIED TO CONTACT ME. Did anyone bother to check my credit to see that this is NOT MY USUAL PATTERN AND I HAVE PERFECT CREDIT BEFORE I WAS TREATED LIKE A CRIMINAL AND FORCED TO ACCEPT A NEW INSURANCE POLICY?

I need for my credit to be restored to perfect again. I need for you to realize I HAVE INSURANCE, I HAVE MADE ALL PAYMENTS AND I AM RESPONSIBLE. As soon as I was informed there was a problem on APRIL 24, I HAVE COME UP WITH NEARLY 4K TO GET THIS STRAIGHTENED OUT. ISN'T IT OBVIOUS I AM NOT TRYING TO GET AWAY WITH ANYTHING? I AM INFURIATED WITH THE WAY I HAVE BEEN TREATED BY YOUR COLLECTION DEPT.

If this situation is not resolved, my credit restored, my late charges removed, the Insurance Policy installation REMOVED by BALBOA Insurance Company effective 10/30/06-10/30/07 and replaced with MY OWN with STATE FARM, I will pursue LEGAL MEANS and I am NOT KIDDING.
