Mr. James Redd, Ferndale, PA, GMAC stated if I paid more then 20% down I could pay my own taxes. Very important to me. I provided more then 20% down. Everyone involved, including attorney I hired, knew this. At closing the interest rate was wrong and the contract was wrong. The attorney, Debra Forman esq had been involved with the mortgage with the Horsham office. She told me they would fix the mistake. We closed. The only thing they changed was the interest. I have been struggling to pay over $1000 each month by the 15th, something Mr.Redd knew I could not do. I pay the entire mortgage, with a fee for paying after the 15th every month. I am listed on my credit report as always paying late -- so I pay them money to give me bad credit! They changed my Escrow alright -- they increased it. Then, when I did not send the $35 more, they said I was late. When I called they said I could not pay my own taxes because I paid late once. I don't know what is going on there but it seems to me that they have delibertly set me up so that they get much more money from me and know I could not afford that mortgage. I am going to a HUD office to see what I can do since I have been Unemployed for months and I still pay them. They have lots of my money but I can't refinance because I paid late! I pay 7.2% interest and can't refinance! It is a nightmare. And, I was charged twice for my application fee and GMAC has not returned the overcharge of $325. Be aware: think twice about mortgage from Jim Redd or from GMAC.

Well, they changed their policy at GMAC. You now have to send your payment to reach them by the 30th of the month. For 4 years that was not the case. But, when they learned I contacted a company to refinance, then they reported me paying late 22 months out of 24 months and ruined my credit score. I saw my report several months ago online and that was not what was on the report. I needed to refinance to finish renovating so that I could sell. I had been only temporarily employed for a year so I would have to pay 9 percent interest to refinance. O.K. I said to myself, this will be quick and I get on with my life. No more nightmare of my first house. Well, I went on a site on the Internet that is supposed to help people like me but is actually a predatory lender contact site. Once GMAC got wind I was trying to refinance, then they started to harrass me by phone telling me they would ruin my credit. I paid June as usual -- I had to borrow from friends but each and every month GMAC got their full payment with fee. Now I have a job and I can probably pay them before the 30th but they have sent me a rather oddly worded Intention to Foreclose notice telling me that i am in default because I owe them for June (which is paid) and for July (this was sent on July 4). If they are not trying to harrass me, why send this letter? I could go back to State of PA or the State of NJ or even to the wonderful "Voice of the Consumer" but I am not going to do any of this. I am going to file for Chapter 13 and ask HUD counselors to help me with GMAC. I have worried myself sick over this mortgage, sold my mom's antiques she left me, sold everything I could sell, borrowed, and gone through hell for over a year and they always got their money mailed by the 30th. I learned that they lowered my credit score to 515 and that was one of the reasons I probably had problems getting some of the service jobs for which I applied for. I am 62 and it is no small matter to get a job at my age and that has reduced me to tears as well. I can attest that buying my home and living through the last 3 years has been extremely difficult and that I would caution anyone that is a secretary or lower wage earner not to ever buy a home in NJ. The realtors really work for the seller; the attorney works for everyone but you evidently. The State of NJ does not enforce the code that is violated unless you are rich and can hire an attorney to represent you. The mortgage company makes you look on paper to give you a loan and then when it so moves them, makes things very difficult. This ends my problem with this property and my idea of owning a home. Don't fall for the myth that everyone should take their savings and buy a home. It is really not something that should be done without extensive HUD counseling to understand what can happen to your life.

If you believe that your lawyer did not do what is in your best interest, you can file an ethics complaint with your state's bar association. Lawyers have a duty to act zealously for their clients. If they do not follow the ethical rules, the ethics committee may choose to discipline them by means of fines, suspensions or disbarment.

dear barbra and all else heres the secret phone number to gmac ,s VOICE OF THE CUSTOMER this is as close to the ceo of the company that you can get the number is 1-888-462-2864 this is the place you need to call i know i had to use it again today you see i have been waiting for 5 weeks for gmac to send me some iformation about my account i have called them at least six times each time i was told a different story so today i got mad called the voc and let them have it told the operator that i have filed a complaint with the fla state attorneys office and i filed one with the fla banking commision that seemed to light a fire under their butts because tonight i got a call from them telling me that they had the info and that they will fax it to my in the morning so now lets see ifyou having problems with gmac call them at that number also file complaints with the same people i did in your state if you need any more info read through my story i have several more phone numbers in there and a whole bunch more of information i can pass on LETS KEEP HAMMERING GMAC TILL THEY BREAK

I have been accussed of being late since the first month fairbanks bought my loan. I went to an attorney to try to straighten the mess out but it did no good because when you look at their bogus payment history it makes little or no sense at all, and if you do not have every single cancelled check that you have ever sent to them you do not stand a chance of proving you made your payments . And if you make payments over the phone via western union you are royally screwed they will say they never got the payment and you have nothing to proove you made it. They have told me I had innsuffient funds and did not credit my account on payments I made. Funny how my bank says the check was never presented to my account . And this month when I called to see what I owed they told me I still owed for the months of Dec and Jan and a late fee of 22.00 so I mailed two separate mortgage payments and the late fee I wrote both months that i was paying on the checks and wrote LATE FEE on the check as well so today I called to see if they got my payments and yes they are giving me credit for the payments saying I am not due for feb but they are still saying I owe the 22.00 late fee.. Yeah I know it is only 22.00 but the thing is I am not late. And right now they arealready charging me over ten thousand dollars in other bogus fees I can not get out from under and I know when my chapter 13 ends I will be forclosed on I am sure of that. I was referred to an agent in PA by Bucks County Real Estate and my purpose was to be prequalified to make an offer on a home. I was a first-time home buyer and I tried to buy several homes before buying a home. I had several home inspections and I had a seller cancel. GMAC appears to be saying that because I offered on these homes, I owe more then one application fee. I am not clear as to why. I paid home inspectors and lost over $2000 trying to buy a home. I saw at least 3 false disclosures and when caught, one Seller gave me back my deposit. I was never advised that each time you make an offer on a home that you have to reapply for a mortgage? Is this a standard practice? GMAC is indicating to me that is was o.k. to charge me $675.00 application fees beause they had to do two credit checks. They had to do a credit checks. I did pay a document preparation fee and lots of other fees so I am not sure what is legal and what is spin. I credited my mortgage account $350 and I guess they have decided to foreclose on my home.

GMAC did not address the switch of mortgage terms and since they have acknowledged to me that they know about this switch, they are purposely avoiding this subject with the State of PA. I will readdress this subject by sending invoices and payments to the State and showing them the constant billing that I am a month behind which I am not. GMAC told the State that I owed $137 and it appears that is due to an increase in taxes so that the Escrow needs to be increased. I was told in a letter that I could increase my payment monthly for this increase and I did that as directed. All of that will be submitted to the State of PA and the subject will have to be reviewed again.

I was a PA resident when I obtained my mortgage. I have seen the response but it does not address the problem. It also states that I paid one application fee. I followed up with GMAC in Horsham and the CS person there obviously was told to say nothing. She recorded my questions and that was it. I sent along another letter focusing on my duplicate application fee of $350 and requested a refund with interest. I see nothing else being addressed by GMAC

For Brian, I have made my payments before the end of the month by taking the payment to the Post Office myself and mailing the payment. Many times got Proof of Mailing.

Hi Brian: I have made my payments before the end of the month by taking the payment to the Post Office myself and mailing the payment. Many times got Proof of Mailing. Sometimes used Fed Ex. They have me listed on my credit report as being consistently late and they tell me I am late on every bill I get from them. I know that they post my payment after the last day of the month but I am postmarking before the last day of the month. As I explained before, I was supposed to be paying only my mortgage and not Escrow for taxes. It is because of their "switch" -- which they acknowledge -- that I have to meet the $1110.00 (which includes both a late charge for paying after the 15th and a charge for paying after the first. I tied up my savings into this house -- it was a rehab. That is another issue I know, but it is a very bad situation since I lost my job after 9/11 because I worked for a subcontactor for the Navy. The Navy cancelled our contract when they decided to put their money into ports. In any case, I am 61 and this is my first home. I waited my entire life for my own home. I worked hard and I am a responsible person. Now I need to refinance to get the extra money out of this house so that I can pay bills I cannot pay on Unemployment. I no longer have a career and my savings (401K) was gone after 9/11. On top of this, I found out that my home was sold to me with a false well. I had a home inspector, a survey and still the misrepresentation of my 40 year old, 200 foot well (I am quoting the real estate representative) was not where it was supposed to be. Instead, it is a shared, 70 year old, non-sealed, not to code, needs to be decommissioned well under a hedge. The surveyor did not put this above-ground sewer-pipe constructed well on the survey. I am trying to bring an action against him but that seems to be a problem; I have learned that their is a Department of Consumer Affairs and they say they will protect the consumer but it seems that it takes months and months to hear anything. I am trying to get the money from the surveyor or the real estate people to hook up to the city water so that I can sell this house if I have to. I cannot sell it with the well it has so I have lost my value of the home. I can say truely that buying a home in New Jersey has been probably the worst and most damaging experience of my life. I did not have high blood pressure before I bought this home. Today I do not sleep, I worry every waking moment and there is really no place to turn because I have no job to pay for an attorney. I cannot understand how a consumer can have a mortgage company not accountable for the mortgage agreement that I made before I closed. My title insurance was not given to me and that seems to be a problem. The surveyor did not put out markers I asked for and evidently did not look at the boundary. The real estate agent listed the home in 1999 with a well (I found the listing flyer in the home after purchase) but tried to tell me in 2000 that the home had City water. He then come up with this "well stone and underground well story." The seller had a stroke, was in her 90's but I was not told this. I was asking for information believing that the Seller was answering my questions. Then my own attorney presents a mortgage that is not correct, promises to fix it, does not fix it, and does not get the title insurance, the deed, or even a Power of Attorney. I did not know that she did not have these things. I have no idea why I had an attorney -- I think had I not had an attorney I would have followed my instincts when documents were not in order and not purchased this home. It is hard to know how many bad faith presentations of information there were with the sale of this home by not only the people representing the seller, but the people I paid to help me. Any suggestions you have that I have not tried I would certainly like to hear. surveyor

HELLO LINDA FROM WILLARD OHIO have not come to any answers with this company. they change names still same old actions they can and do charge late fees and report lates even paid on or before due date also report no payments even with proof they have cashed them also they hold checks to say they never got them even with our proof they have money in hand they still try to forclose. working with lawyers but they try to add more fees and lates they haven't got coming to get it even higher. also i am amazed at how they thousand 's of complaint's on this sigt has been reduced to so few. IF NOT INVOLVED WITH THEM DO NOT GET INVOLVED. BUT IF YOU ARE PUSH IT TILL YOU CAN'T PUSH IT ANYMORE. I HAVE BEEN IN MY HOME FOR OVER 2O PLUS YEARS THEY WILL NOT RUN ME OUT!!!!!!!!!

Barbara, I just wanted to let you know that even if you pay your mortgage after the 15th, the lender cannot report you as 30 days late on your credit report. They can charge you a late fee, this does not show up on your credit. As long as GMAC recieves your payment before the anniversery date of the next payment, they cannot report you 30 days late to the credit agency's. Your mortgage history would show up as "1"'s or "c" which means you are current. If you need further assistance contact the people running this site for my number. Good Luck
