After finding the Nike Foamposite Gym Red shoes on an Internet search, on 6 Apr 19, I sent an email to [email protected] letting them know I was interested in purchasing them. Because I was concerned that someone would sell used shoes as if they are new, I asked to see photos of the insoles and soles of both shoes and the box before buying them.

On 7 Apr 19, Patrick S. (GOAT Support) replied to my email saying, "If the shoes are Brand New, they should look like and appear in the same condition as the ones in the stock photos, unless indicated otherwise. The sellers are also required to indicate the condition of the box. If they are not as described, we will notify you and issue a full refund during authentication.

Please let us know if you have other questions or concerns." On 7 Apr 19, I wrote, "Are you the seller or is there a third party selling these shoes?" Patrick S. replied, "The shoes come from our expansive network of thoroughly vetted sellers that are located all over the United States. I hope this helps! Please let me know if you need anything else!" I replied, "So if the shoes aren't what the seller claims, what does a full refund during authentication look like? A credit back to my credit card or something else? I've seen dozens of sellers selling cleaned up used shoes as new. I've seen dozens of sellers selling shoes so worn that the logo is worn off the insole as new."

Julie O. (GOAT Support) replied, "If the sneaker is not as described, we will issue a full refund back to your original form of payment. Let us know if you have any other concern." I replied, "Can you please ask the third-party seller to provide actual photos of the shoes not stock photos?" On 8 Apr 19, Julie O. replied, "If the shoes are Brand New, they should look like and appear in the same condition as the ones in the stock photos, unless indicated otherwise. The sellers are also required to indicate the condition of the box. Please let us know if you have other questions or concerns." With that assurance, I bought them on 8 Apr 19 for $ 400.

The GOAT order email said, "Your order is being sent to GOAT for authentication by our specialists. Once authenticated, we'll quickly ship it your way." They were delivered on the a.m. on 17 Apr 19. I got home around 6:10 p.m. Upon opening the box I saw that they were not new. They were worn so much that the "Air" imprint on the insoles of both shoes was worn off. Also, there is dried dirt on the outsole of one of them. GOAT claims to have "authenticated" the shoes are what the seller claims.

The GOAT website said they were "NEW" and the box "badly damaged." The s****.>

On 17 Apr 19 at 7:31 pm I sent an email to GOAT describing the email exchanges between me and GOAT Support prior to my purchase. I attached 3 photos of the insoles showing signs of a lot of wear and to prove there is dried dirt on the outsole of one of them. I wrote, "I could be wrong but, in my opinion, these shoes could not have been authenticated by anyone at GOAT. If someone had opened the box and actually looked at the insoles of the shoes they would have immediately known that these shoes are NOT NEW; they are USED.

If someone at GOAT had looked at the outsoles of the shoes they would have seen dried dirt and knew that they shoes had been worn. They would have known these shoes are NOT NEW." The last GOAT rep offered store credit. Store credit does no good when GOAT has no shoes I want in my size (17). I want a full refund back to my original form of payment because these shoes are not as described.

I don't want a "store credit" because I don't want to do business with a company that claims to "authenticate" shoes as new before they go out in the mail when, in fact, my guess is that no one looked at the shoes to see that they were not in NEW condition. I'm fully prepared to take legal action to get a full refund back to my original form of payment because these shoes are not as described.
