My husband is from the East Coast of Florida but has been on the West Coast for over 15 years now. Recently, his mother, who still lives on that side of Flordia received a message on her machine from Michael Bernstein with Graham Noble stating that he needed to contact him right away in regards to his "case". Shortly after that a few people he has not had contact with for over 10 years starting getting calls from this same "investigator" stating that it would be in the best interest to call this company back. At first we thought his may have been a debt collector but then his Mom contacted us this morning and said this same Michael Bernstein left yet another message stating they know where my husband works and if they need to they come to his workplace and escort him out and it could cost him job!

I started to wonder why this company was only contacting people on the other coast when he has 2 cars registered here on the West Coast and it wouldn't be hard to actually find him over here. Seemed to me they were

1. Working off of old information

2. Could not obtain the current information with out leaving some sort of paper trail.

Thus leading me to believe this was a gross case of FRAUD!

So I Googled this company and lo and behold I came across this website and see that same "investigator's " name in numerous other complaints!

My heart goes out those who gave out bank account information and I discovered that this company is currently being sued in the State of Florida.

If anyone out there has information on how to file a complaint against this company please let me know. In the meantime I want them to stop calling his elderly mother and to stop calling people his has not had contact with in over 15 years.

Sounds to much like what some scammers are doing - THAT IS RIGHT SCAMMERS. FAKE DEBT COLLECTORS - All over the internet and news. I have noticed that they have been changing their business name recently - probably because there is so much reported under the old names/scam they are no longer getting anyone to send them money. Read about Fake Debt Collectors Terrorizing Consumers http://abcnews.go.com/Business/story?id=5621205&page=1 They always start their calls exactly how you stated and then change to threats of arrest. They also call everyone they can and tell all about this so -called debt All of which is illegal for even a legitimate Collection agency. If legitimate you can sue them You did not indicate whether they had accents or not. If heavy accents - its definetly a scam. So the first thing you need to do is check out "THE DEBT" and find out whether or not it is the legitimate Collection Agency or the scam collection agency If the legitimate one - go to www.budhibbs.com and read Dealing with Collectors 101 (you have to scroll down to it)

This is a junk debt collector trying to collect on ancient debt that is outside the statute of limitations. They are powerless over you because the debt is so old. This is why they use all these illegal threats...it's the only way bottom feeders can get people to pay. Here is what to do: Send them a letter via Certified Mail + Return Receipt stating: Per the Fair Debt Collection Practices Act, I am requesting that you cease all communications with me about this alleged debt. This letter is being time stamped via Certified Mail and I can confirm receipt. I will pursue each subsequent phone call from your office with a $1,000 per incident penalty for Fair Debt Collection Practices Act violations. Step Two: Next time they call, read the following statement: Pursuant to [your state] state law, this is to inform you that this phone call is being recorded. If you do not consent to being recorded, you need to terminate this call. Pursuant to [your state] state law, continuation of this phone call after officially being informed that it is being recorded implies consent to be recorded. This recording will be used to pursue Fair Debt Collection Practice Act violations in a court of law.

My heart goes out to you, I was also contacted by a person at this company, they went on to say I would be arrested at work and that I would be held liable for all these damages, meanwhile, it wasn't even me that they were looking for, this was a case of mistaken identity. In any case, I filed a report with the Attorney General's Office with the State of New York, you can file a complaint on line and approximately one month later they'll send you information in the mail to get additional details. You can also contact the Federal Trade Commission and file a complaint there as well, if enough people complain about these losers than perhaps they'll be shut down for their unethical practices.
