In November, 2007 my wife and I moved to Missouri from New Hampshire. Because of the move, and the fact that we would be starting new jobs, we would have had to pay nearly 13 percent interest on a mortgage, but the "good people" at Greenleaf had a quick and easy alternative. They would sell us a house with 30 year fixed rate financing at only 7% interest.

What a wonderful deal. We looked at the houses, picked one that my wife fell in love with, signed the contracts, paid our down payment and moved in. I required that the Contract for Deed be recorded, and after a little wrangling, it was done. Before buying, I did my due dilligence and found that the property I was buying was actually titled to a Thomas Hollis in Bolivar, Mo, and that Greenleaf didn't own the property they were selling. So, again, I required that there be some affidavit from the titled property owner stating that Greenleaf was selling the property on his behalf. Again, after some wrangling, the true owner signed an affidavit that Greenleaf was marketing the property on his behalf. Lo and behold, we are now property "owners."

We have made our payments of over $1800 a month faithfully. They are being reported on our credit bureau files, so all was going according to plan. Then in July, we accidently opened a letter addressed to Thomas Hollis from the mortgage lender. It stated that the note had not been paid, and was in default. We immediately contacted the titled owner with our concerns, and he responded that he would personally see to it that the payments were made in a timely manner. So again, all was well.

Last week we once again received notice that the owner is late on his payment. We have notified him and Greenleaf by certified mail of our intention to sue if they don't keep up their payments. They have not responded. We have filed complaints with the Better Business Bureau, the Attorney General's office, the Nixa Missouri Police Department, and the Missouri Real Estate Commission. On Monday I will meet with our attorney to commence litigation for damages. We are currently negotiating through our attorney with the lender to take over the loan. Our attorney drafted a document which he filed with the recorder's office, so if coreclosure begins, now they have to notify us as well.

In my opinion, this activity by Greenleaf Properties, L.L.C. is unadulterated fraud. I will take whtever steps necessary to see to it that this company is closed, their real estate license revoked, and their principal Scott Dasal is indicted for fraud.

Patrick, I read your complaint and sympathize with your situation. Let me share with you another side to this issue. My wife and I are Investors of Greenleaf and have been since January of 2008. We were approached with a win-win scenario. If we would put up our credit to buy a home, Greenleaf would be able to build it, lease it to a tenant with the hopes of restoring their credit and then ultimately buy the property that they have been living in during this restoration time. Greenleaf promised to pay the investor (me) the monthly payment before its due each month and I would in turn send this to the lender. Greenleaf would have 3 years to get a qualified investor and after this time (or when they had a qualified investor), the property would be deeded over from my wife and me to the homeowner and we would be paid a cash sum for our efforts. What a great idea. We could use our good credit to earn some passive income and at the same time, help someone get the home of his or her dreams. Enter April, 2008, the last month Greenleaf paid us our monthly payments. Greenleaf ran into financial trouble and could no longer make payments each month to the investors. Now, investors were left with two choices. First, they could not make the monthly payment to the lender and in which case lose their good credit and ultimately the home goes into foreclosure. Or.. the investor could continue to make the payments in good faith with no return on their investment. Which path do you think most investors were forced to take? My wife and I are different. We are where we are today because we make all of our payments on time. We are very proud of our good credit scores and have gone to great lengths to keep them high. In September, we took back one of the properties from Greenleaf that was occupied. We notified the tenant that they need to pay us directly and that we would honor the 30 year loan that Greenleaf promised and even help in anyway we could for them to take over the note directly. I am proud to say that a tenant is faithfully making payments directly to us and hopefully soon will be able to own a home because we did the right thing. Now we have a second property located just north of Branson, Missouri that is not occupied. We have paid our mortgage payment faithfully each month and refuse to lose the home to foreclosure. If you or any other person out there are interested in a beautiful 4 bedroom, 2 bath ranch style home with a walkout basement, in ground sprinkler system, located on over 1 acre of land, please feel free to contact me. We would love to work directly with a homebuyer and keep Greenleaf out of it. You see, not everyone associated with Greenleaf has bad intensions. I hope you all can come together to do something about this! I find it very troubling to think that this would happen or that they would lease or SELL a house "contract for deed" when knowing it is in foreclosure. What a scam! There is someone else who is interested in a class action lawsuit against these scammers and they have posted under the rants and raves section in Craigslist...Springfield. Please contact this person and perhaps with many others you can do something about this fraud and scam. Good luck! You ought to set up an email account and post back on here what the address is for victims to contact you. Thanks for posting...maybe someone else will read this and avoid them like the plague.
