Frank Hoffman is the owner of Harbor View Restoration, a company that supposedly performs "cleanup" and/or restoration services for fire, smoke or flood damage. I cannot adequately express in writing how much I regret ever having any contact with this company. They must have used a police scanner to find out about a five-alarm fire that affected my apartment in Union City, NJ, because they showed up at the scene and coerced my tenant into putting me on the phone with them at midnight (while the fire raged) and to hire them to remediate smoke damage. They did a shoddy job, did not correct the work, and then sued me when I didn't pay them. I never signed a contract, but they forged my signature on one. I live out of state and just had to travel up to NJ to face them in court. The burden of proof would have been on me about the forged signature, and to mitigate any future costs, I settled with them for much more than they deserved. They have a history of these types of practices. The Consumer Affairs Division of the NJ Attorney General's office has many complaints against them, and they have an "F" rating with the Better Business Bureau. After I expressed my dissatisfaction with their work, they submitted the same estimate to State Farm which had already been
submitted under a completely different policy and claim number in an effort to get the insurance company to pay them directly. They were unsuccessful, and I have reported them to the Insurance Fraud Prosecution Division of the NJ
Attorney General's Office. I also filed a police report about the forgery. I was inexperienced, but now I know that you should ALWAYS contact your insurance company to file a report before hiring ANYBODY to do a shred of work on your
home. Your adjuster needs to come and assess the damage BEFORE a mitigation company is hired to do any work (unless it's raining in your house, or your front door has been broken down). Be VERY wary of any company that shows up at the scene of a fire or natural disaster, and be on the lookout for smooth talkers.

I have happily posted my Motion for Summary Judgment, which includes my Answer to your Complaint (link below).  The only reason I didn't post it before is because it's 102 pages long.  Just note that the forgery didn't come to light until after I filed my Answer, and I didn't know about your double-submission to State Farm under two separate policies and claim numbers until a week before we went to court.

I'm not making anything up.  I have been in contact with other people who have had bad experiences with you and your company.  Their contact information was on their consumer complaints, which were furnished to me by the Attorney General's Office.  I blacked out (redacted) their contact information when I filed my Answer to protect them.  The people I have talked to are definitely not happy.  I have no desire to harm your company.  I simply want to protect consumers and, to the extent possible, inspire you to conduct your business with integrity and without lawsuits.

If you will recall, my attorney subpoenaed the photos you claim to have taken before you started work at my place, along with the "GPS" reports from the air scrubbing machines you claim to have run for three days in my unit, and you and your attorney did not produce these documents in court.  If those exist, perhaps those should be posted, as well.  If you need me to provide instructions on how to upload things to Picasaweb, just let me know.  I would be more than happy to walk you through it.

As I said In my past postings, I will leave it up to a judge to determine what is considered slander. I also don't understand what you are trying to accomplish with these stories you continue to tell. I will ask you again, why don't you post the answer you wrote to my court summons. If you have nothing to hide this should not be a problem. We both know that answer holds a totally different story. I will also tell you, I am in the process of receiving the paper work for the fraudulent complaint you posted about a case that has been settled and the customer was happy!

I'm sorry, I must have been confused.  There were 14 different docket numbers, and all the Frank Hoffmans had the same street address.  I don't know how I could have mixed up the facts so much, but I really appreciate your setting the record straight.

Believe me, I am more than happy to discontinue this conversation.  Although it should be obvious, let me make it clear that my Internet postings stemmed from good will, not bad.  I simply don't want others to go through what I went through (and what some are still going through).  I am hopeful that the authorities will take it from here, and that I will no longer need to be involved unless called on for my testimony.

Ms. T**** please keep in mind that you can express your ill feelings, however, do include the whole story and get your facts straight. Harbor View completes roughly between 400-500 jobs per year. 

Also please get your facts straight: there have not been 14 cases. According to your public information system there are 6 and 3 were settled out of court.There are other Frank Hoffmans in this world. There are 6 and 3 were settled out of court. So over 2 years and 1000 jobs, there were 3 issues.

Also the reason for the rating from the BBB is because there is one complaint that we did not respond to. Please read the guidelines for ratings. 

We attempted to make right with our differences with you, however, you felt different. We stayed in constant contact and repeated our visits. We even gave information to your insurance company regarding items that could not be cleaned, you were reimbursed for those items. That is a clear example of someone being greedy. 

Repeated complaints on the internet from the same IP address in Missouri is intentionally try to slander. Going from site to site with wrong information is slander. 

We are not looking for further issues unless you continue on with your ill willed devices. And continuing will only result in coming back to New York.

Of all of the numerous government agencies to which I have reported Mr. Hoffman and his company, all were extremely helpful.  The FBI, in particular, affirmed that posting negative reviews on the Internet is not slander. When you put your company on the Internet, you open yourself up to public criticism.

Public information available on the court's public access database lists at least 14 cases in which Mr. Hoffman has sued his customers in 2011 and 2012 alone, and he sued 4 of those customers twice! (See documentation posted at the link below.)

Potential consumers are free to draw their own conclusions about Mr. Hoffman and his company based on the information and public documentation available on the Internet. Additionally, Mr. Hoffman's own responses speak volumes! The more he talks, the worse he looks. The way he handles dissatisfied customers, and how he conducts himself on the Internet speaks for itself. I have said nothing on the Internet which was not either true or a matter of my own opinion.

Mrs. Thompson don't complain about the ride to ny, if you are going to continue slandering my company. You know the story your telling is not true. Why don't you attach a copy of your answer to my original complaint filed with the court. Your story changes like the weather. If you think you are going to get away with bashing my company all over the Internet, think again. Next time you decide to fabricate complaints about other jobs i have done, dont do it from the same IP address or from the state you live in. I look foward to seeing you in court again. Like I told you the first time pay now or pay later. Just don't come to court and say I forged this complaint LOL

Thats his story, and hes sticking to it.  From my conversations with other victims of Harbor Views tactics, it would seem that Mr. Hoffman makes his living from going to court.

For a more detailed account of my ordeal, please refer to my August 23, 2012 email to Mr. Hoffman (see slideshow linked at the bottom of this response).  There was never any contract, only a signed Authorization to begin work (see slideshow).  The contract he refers to in his rebuttal has a signature on it, but its not mine, and I never even saw that document until his lawyer emailed it to me on December 26, 2012, six months after the fire (see slideshow).  Compare the signatures for yourself, and I think you will agree that the forgery is obvious.  It also looks like the fax time stamp was lifted from the original Authorization and that 11:06AM was changed to 11:07AM.  But its curious that the time stamp only appears on one page of the contract and not the other.  Hmmmm...

Unfortunately (or perhaps fortunately), the issue of the forgery was never addressed in court because the trial was cut short by the judges schedule, and so I settled with Mr. Hoffman in order to prevent having to spend more money to go back to court (I live out of state).  My payment of a monetary settlement does not equate my agreement with Mr. Hoffmans claims.  I was stuck between a rock and a hard place.  The fact is, my defense was never even presented in court.  Mr. Hoffman seems to know how to work the system (even if he doesnt know how to spell or employ the proper use of grammar).  A quick Google search of [Harbor View Restoration fraud] or [Frank Hoffman fraud] will tell you all you need to know.

Mrs. Thompson Hired Harbor View Restoration to clean the structure and content of 2608 Kennedy Blvd. Union,NJ on June 21, 2012. Harbor View Restoration was not following a police scanner as Mrs. Thompson stated. Harbor View Restoration was working on the building next door were the fire started and was approached by Mrs. Thompson tenant. The tenant explained she/Landlord needed help with the cleanup of the smoke and instructed Harbor View Restoration Rep. to contact her landlord. At that point the Harbor View Restoration Rep. called the number given by the tenant and spoke with the owner Mrs. Tina Thompson. Mrs. Thompson the owner requested a contract be fax (Mrs. Thompson lives out of state) so smoke/cleanup work can commence. Mrs. Thompson signed the contract and faxed it back.

After work was completed Harbor View Restoration provided a bill for service rendered to Mrs. Thompson. Mr. Thompson then sent the Harbor View Restoration invoice to the insurance company for payment. The insurance adjuster then came to Mrs. Thompson condo confirmed work and issued payment based on inspection, before and after photos and contract. Approximately a month later Mrs. Thompson recieved a check from insurance company for said services. Harbor View Restoration was notified by insurance company the check was sent and called Mrs. Thompson for payment. Upon contacting Mrs. Thompson for payment  more then a month after service was completed, Mrs. Thompson started to complain of a smell of smoke in the condo. I Frank Hoffman owner of Harbor View Restoration asked Mrs. Thompson what will it take to resolve this situation. Mrs. Thompson advised me her tenant's lease expired and she would be coming to NJ to check the apartment Aug/2012 . I told Mrs. Thompson even though this date is long after the original cleanup date, I can come down and we will address any issues if they exist. Upon arrival at Mrs. Thompson's building Aug/2012, it was observed that the common area of the building were still covered in smoke and an odor was present. I proceed to the 3 floor to Mrs. Thompson apartment and upon entering the apartment, everything was clean as per contract. There was a slight odor present from the hall area. As a courtesy I agreed to send a crew to re clean/Deodorize Mrs. Thompson apartment and content. Mrs. Thompson was pleased and informed me she would send payment. No payment was every sent and a lawsuit was filed. The court appointed arbitrator and judge had  recommended Harbor View and Mrs. Thompson agree on a settlement. Mrs. Thompson agreed these services were conducted and paid the bill at trial. The settlement is on file in Union County, NJ for verification. Mrs. Thompson under Oath accepted responsibility for bill/paying bill.

After recieving check, I Frank Hoffman was standing in Hallway outside court room. Mrs. Thompson husband approached me and took the picture shown above. When I asked why he did this his reply was "F..k You"

As a result of all this slander and inaccurate information, another suit has been filed for slander. I look forward to posting the results to this new lawsuit.
