Heartland owns their own title company that they use. That's why you sign an affiliated business disclosure at loan application. They probably didn't set out to steal your money, they are just run so backwards it was overlooked. I believe the name of their title company is Clear Title (ironic I know), and they are based in Ohio, I believe in either Columbus or Cleveland. I'd hunt down their number if I were you and call and start demanding.

Did a local title agency do your closing or did Heartland do it themselves? Who was the check from that you received when you refinanced? Many mortgage companies will go through a title agency. Here is what happens. Say you borrowed $100,000 from Heartland. Heartland sends the title agency the $100,000. The title agency then, from that $100,000, gives you money, pays off your present mortgage, pays your insurance and taxes, pays the appraiser (if you didn't already) and takes their fees. Find out if that is the case and you will probably have to deal with the title agency. Fax them a copy of your closing statement and demand proof of where the money went. In addition, contact your county public records office and have them do a search for the satisfaction of your old loan. It may have been filed, but Heartland doesn't want to do the work.
