If you're not making head-way with a particular rep, I suggest you hang up, then call back. You will most likely get a different rep. Also, if you're rude to the rep you hung up on, the rest will know. It gets documented. Trust me, the more agression you show, the more agression you'll get. Also, I don't think they are deliberately lying to you. The reps are just incompetent. This is not the only company with that problem. Unforetunately it is widespread. Like I said, hang up and get a different rep.

We tried MANY times to speak to a supervisor. Each time we were denied. My husband talked to a person who call himself Tyrone and asked him to have a supervisor call us. He asked why? My husband said about our account. And he was told that he should call back when he wanted to talk and "Tyrone" hung up on him. Another time we were promised that a supervisor would call us at a specific time and we NEVER got the call. They had many chances to call us back. Our problems did not really start occuring until we tried to pay our checks by phone and we would have been totally current. We were Never given access to a supervisor in spite of our many requests to speak with one.

If it were me that lied to you, it would have had to be a miracle, I have never and will never be a inept phone service rep nor work for a mortgage company...I have a conscience. I have however in the past done a check by phone and had my funds rejected...due to 1 incorrect number given/used on my bank account...of course like you it was my fault even though they had the account number in their system. What you need to know is "posting" to your mortgage payment and "clearing" your bank are two different things! When doing a check by phone make them read back your checking account number this will help prevent future errors!

Wrong again WHUT? The payment would have cleared had it been sent through. I was told by one of the liars at HomEq that my check was "duplicated". Only to get another letter after filing with the BBB that "account not found". NO ONE EVER called us to get any new information from us before sending the check through again. WE WERE TOLD THAT if we give them the check by phone it WOULD be posted on time. If they could not find the "correct" account maybe THEY were at fault. Maybe they gave the bank the wrong information. We all know what liars you are. It was probably you that llied to me in the first place that our check was duplicated.

Do not go through the same day, the amount is "posted" to your account to prevent late fees if any basically as a promise from you you have the money in your account to PAY, the funds must still clear your account...same as a check. Check by phone does not go immediatley into your bank account and take the funds to whomever you are paying, they must CLEAR from your account. It took 14 days for it to come back because like any business they ran it through more than once hoping your "promised payment" would clear! IF it had you would not have late fees and penalties.

On Sep.24 I got the confirmation receipt that HomEq received my Qualified Written Request. According to RESPA laws they are supposed to notify me in writing within 20 business days that they received my QWR. Today is day 28 and have not gotten anything from them. I am going to notify my BK attorney by the end of the week. They can be fined for this. Although the amount may be small, if everyone on this site would send a QWR to HomEq demanding any information on their account we could take them for thousands. Everyone please make sure you send a QWR. You can find a format for it. Just google it. They have broken the law. It has been well over 20 days. They have 60 days to answer my QWR.

Well, I received my return receipt for the Qualified Written Request on Sept. 24. By law they are supposed to respond that they received it within 20 business days. Today it will be 28 days and still no response. According to RESPA laws, they have 20 business to respond to me that they received the letter and 60 business days to answer my demands. I will be calling my BK lawyer by next week. I'm sure they are trying to figure out how they are going to lie their way out of this one.

Everyone reading this site knows that the real reason that we have not been able to correct the problems with HomEq. It is due directly to their LIES!!! They do not want us to correct the problem. There's no money in that. The only way they make a profit is by charging late fees, forced insurance etc. As each of you write letters to the FTC, States Attorneys, etc. be sure you emphasize the fact that they LIE!! The responses I have received all contain the same message. Bad loans. While we know that bad loans are in fact a large part of the problem, the REAL problem is the deceitful lies we are constantly being told. In my complaint I stated that we were sent letters stating that our check had been "dishonored". After I sent a complaint to the BBB I received a response letter from HomEq. This letter stated that my checks did not clear due to "account not found". HUH!!!! First we heard of this. Why did they not state that when they sent us the letter on the first check? All it said was that it was "dishonored". No one ever contacted us after the first check that we sent on June 19. The first contact that was made with us was July 9. And why would it take 14 days for a pay by phone check to come back? They do nothing but LIE!! Then they send the second check through, or so they say. These checks were given 10 day apart. The should have known that the first one didn't go through and since they received no new information from us why would they send the second check through? The pay by phone checks would have gone through the same day we sent them. Why would they lie and say that it took 14 days? I think we all know the answer to that one.
