In November, 2004, I signed up for a year contract with HouseValues, Inc. I have complied with their fees and agreements but they have not completed their part with their services in providing me with viable leads.I have been receiving improper leads which contain invalid phone numbers, email addresses so I am not able to contact these leads. I am beginning to think that these are false or fake leads.

The ones that contain the correct information are not viable candidates, they are not screened properly. I receive leads on buyers that are looking for properties that are below what this area sells for. I first complained to Shelley Alexander in February, 2005 the sales rep. She told me to give it a chance. She told me that I could change a zone, which I did. I still did not see results. I asked for a refund and she told me that I was not entitled to it as per the contract and I would have to pay 50% for cancellation.

I expressed my dissatisfaction since I was complying with the contact but the company was not doing their part.I've emailed [email protected] on 5/15/05, then I emailed Mark Powell, the president of the company on 5/16, 6/15 and 7/24 and recently I have been speaking with Mark Frederick, contract manager. To date, I was told that the only way I could get out of the contract was to pay a cancellation fee of 50%.

I would like to cancel the contract and would like a refund since the beginning of the contract, 11/04 - present, based on their breach of contract. They have not been providing any viable clients and the fact that they are not keeping with their promise of using their service to make me a more successful agent, as they so advertise. This is a second complaint regarding House Values and their breach of contract. I signed an agreement with them that they would provide me with viable leads and to date they have not complied with their contract. I, however; have been told by House Values that I need to stay with a binding agreement even though I am not provided the service that they promote.

Today I got a full refund from housevalues. This was demanded by me and it took a little over 1 month, but I had them in too many lies and tricks. I accepted no less. I cancelled one day after signing up. I have reported them to all of the agencies, the FTC, BBB etc. You are entitled to a full refund if you are not sold EXACTLY what was described to you. Not a convenient variation of the sale, the exact sale. Under the consumer protection laws you have 30 days in which to cancel for a full refund. The contract must say exactly what was told to you by the salesman. Take your complaint to your credit card company. Demand a full refund from housevalues or the guaranteed prospects that were sold, all of them and the exact area sold. Tape all conversations with housevalues. Save all contracts, email and paperwork. File a civil lawsuit in small claims court if they refuse.
