In Tuesday, July 28, I found a NEW dodge ram (actually 3 of them) from Huntington Beach Dodge in Huntington Beach, CA with a MSRP of $36,555.00 and an "Internet Sales Price" of $20,305.00 I printed out the web pages from "cars.com" where I found it, and also from their own web site, www.hbdodge.com

I made printouts of the sites, as I wanted to make sure they honored their price...

I immediately called the dealership and spoke with a salesman named Dan Powers. He said the price sounded low, but would go check to verify the price and that the truck was still there, and call me back. 10-15 minutes later, he called back and verified that the information WAS correct and the vehicle was still there.

He then told me that I needed to "Get down here immediately!, How many dodge rams do you think are $20,305.00 and still on the lot? for that price it won't be here long".

I didn't make it down that day, as I had some family matters to take care of. I did more research Wednesday, 7-29-2009

Thursday, July 30, 2009, I spoke with Dan Powers again via telephone after work. He verified again that the truck was still there, then told me that the Cash for Clunkers program was officially OVER at Midnight eastern time, so I needed to hurry.

After Dinner, my wife and I drove to the dealership. We test drove the truck and fell in love with it. We went in and started the paperwork... The odd thing was instead of the cash for clunkers paperwork, which our old truck qualified for with the difference in MPG being good enough for the $4500.00 voucher, he filled out a "Used trade in appraisal report", and was asking what options it had etc. My wife then interjected and said "If this is for the cash for clunkers, why do you need to know things like what kind of stereo it has... You have to have it crushed after it's turned in" He responded with "Oh yeah, I guess you are right".

After filling the rest of the paperwork out, he went and sat with his sales manager and talked for almost an hour... About half way thru their meeting, another person joined them and sat down at the computer next to them and for the next 20-30 minutes was typing (Without my paperwork in front of him) while talking to the salesman and the sales manager.

The Salesman and the sales manager FINALLY come out of the office and sit us down... The sales manager, "Scottie" tells us "I am Embarrassed... Cars.com misprinted the price on our ad. the actual price is not $20,305.00, but $26,805.00"

(Which coincidentally is exactly 6500.00 more... and equals the $4500.00 cash for clunkers voucher plus the $2000.00 customer cash rebate from chrysler added up!)

He then proceeded to tell me that they couldn't sell it for the $20,305.00 price, and they "Would take it up with Cars.com"

He then took 2 papers he had just printed out, and showed me the cars.com ad, with the price I saw, and another from their web site showing the price at $26,805.00

They had "misplaced" my printouts and told me I must have misread the one from their web site...

We then proceeded out the door of the dealership and went home.

Upon arriving back home, I grabbed printouts I had made (Printed multiple copies just in case!) and sure enough, the one from their website DID say $20,305.00, which was the SAME as the cars.com ad.

I *WILL* be filing reports with the California state attorney generals office, the DMV, the Better Business Bureau and Chrysler headquarters.

California law ALLOWS bait and switch...

Well, It appears there is really nothing I can do except word of mouth...
California Supreme court ruled that Dealerships are "protected from major errors with vehicle prices in advertisements", so basically they have legalized the bait and switch...
What is legal is sitting in front of their dealership, on PUBLIC property, and having a sign to state the basic facts that they rip people off!

they threaten criminal prosecution...

received a letter from the dealerships attorney.  he claims that going to *any* media source and providing the FACTS of what happened is "criminal extortion"...
They said their "Offer" to rectify this is to give me the vehicle for the advertised price, CASH ONLY and no Cash for clunkers trade in... (Which in and of itself is a violation of the cash for clunkers bill!)
they have said they will not even ATTEMPT to finance me as I was promised...
I told them that if that was what they were going to try and rectify the situation with, that I would see them in court... and with probably 80% of the population either having been screwed by a dealer, or knowing someone that had, that a Jury trial would get me more than the truck at the advertised price WITH the guaranteed financing and cash for clunkers trade...

Hi Robert, I had seen the disclaimer, so that was why I had asked the salesman to verify pricing etc... They also took my info to run a credit report before I came down, and verified afterwards that the price was the 20305... They said that included my cash for clunkers along with their discount and several other factory incentives I qualified for... What I think was part of their motivation, was my trade... Rather than fill out the CFC paperwork, they filled out a used trade appraisal report... Like someone in the dealership wanted it, or they thought they could make money off of it... the other 2K missing appears to be the Chrysler customer cash back that you get when you finance with Chrysler... Even though they said I qualified, I bet they went to a different finance company to get a little more "kickback" from the sale... Unfortunately, I wasn't as stupid as they thought... We walked even after they told me they would "work a deal with the financing to make up for the increased price"... funny thing is, I think they have pulled that on plenty of people, as that very truck is still sitting on their lot... and from Craigslist, I have received a LOT of comments about being taken advantage of in plenty of different ways at this dealership...

Typical Car Dealers

I keep copies of either Friday or Saturday's paper with the car ads. Many of the car dealer raised the sale prices of their vehicles up by $4,500 THEN lowered them IF you qualified for a cash for clucker gov voucher. ancira had a charger in the paper prior to the program on sale for $17,995 or $16,995 through dodge finance. Once the program kicked in, the vehicle was "on sale" for $22,495 with $4,500 OFF with the cash for clunkers program. The f***king dealer RAISED their prices by $4,500. On the cheaper vehicles, they were selling them at or over MSRP with BS add ons, like tint, pin stripes, paint protection and whatever else. Amazing they blew through a billon dollars in SIX days. The program was SUPPOSE to have lasted until November. congress has voted to add 2 billon dollars more to the program. the pres and the congress rewarding all their buddies in the car industry. As for that Ram. They were selling them for $20,000 here BEFORE the cash for clunkers program. Once the program went into effect, the sales price went to $25,000. Not only are the dealers making an extra $4,500 but an extra $500 for good measure. Hell, why not, let the government pay for it. A chicken in every pot and a new car in every garage.

Fine Print...

Most of the time with ANY dealer the price on a vehicle they advertise is the FINAL price after any rebates. They want to display the lowest possible price to get you in the dealership. There is usually fine print somewhere that states this. This is sort of the financing deals that are always "On Approved Credit". In looking at the Truck on cars.com it does have this on the ad. ----------- Seller's Notes: *****ALL DISCOUNTED PRICES ARE AFTER ALL REBATES AND FACTORY INCENTIVES. NOT ALL CUSTOMERS WILL QUALIFY FOR EVERY REBATE AND OR INCENTIVE. NOT ALL CUSTOMERS WILL QUALIFY FOR *CARS* REBATE. SEE DEALER FOR DETAILS***** ------------ Granted I have no idea when this was put on the site, and I am not saying that it was there when you saw it. But if they have proof of this you probably don't have much of a case. As to writing all of those places to help you - The BBB is pro business so they will be useless - The Attorney General will just take a note of it but won't do anything unless they have a lot of other reports. - The DMV will also probably just take a report but not do anything. - Chrysler Corporation will probably defer back to the dealer as a "dealer issue".
