The manufacturer of the product provides the warranty not the wholesaler or Retailer. So get an atorney to file you as a crediter of the banrupt company or as so many of us have had to, fix it yourself. Sorry but only leagle action will get you any where and as I doubt that you are owed hundreds of thousands it will be cheaper to just fix it and quit yelling at the wrong people

OK, I am working with a representative from iFloor. He is working to resolve this issue with ALLOC floors and has even filed the report the warranty claim issue. ALLOC FLOORING/BEAULIEU has responded they will do NOTHING to resolve the flooring problems I am experiencing!!! They have listed their reasons as follows (and in exactly the manner I am posting them):
"1. These "defects" should have been seen at the time of installation and removed by the installer
2. We do not consider the "defects" as outlined in this claim form of 9/18/2009 to be warranty issues, and as such should be the responsibility on I Floors under the I Floor Defective Claim Policy. (see attached document).
3. Alloc Inc. no longer does business with I Floors since they have filed for bankruptcy.
We cannot credit any claims through I Floors until their account is rectified. (see attached document)"
To address my issues, I state the following:
RE: 1. The "defects" I claimed under the warranty were as follows: Wax defects, delamination and Gloss (we went this way because we were not sure exactly what is going on because the floors do not come clean, no matter what products we have used) and the other claim of Surface Defects is because the finish is coming off. One area is over 11 inches by 7 inches. I included photos of this.
RE: 2. You can NOT report a defect when the sheets of laminate are removed from the box if this defect happened within the LAST 60 days! The finish is wearing off and has gone from a mahogany finish to an almost an oak color. THE FINISH IS GONE ON THIS AREA!!!
RE: 3. Yes, as my ORIGINAL post states, the OLD iFloor has filed for Bankruptcy. The NEW iFloor does NOT carry ALLOC flooring. The NEW iFloor filed my warranty claim to "make good" on the ALLOC filing process. ALLOC requires the warranty claim be filed by the "dealer" who sold the floor. iFloor (old) actually purchased the flooring through ALLOC. Their address shows on the iFloor invoice! I have the paperword showing that the pickup at the ALLOC warehouse located in Racine, WI.
SO, does anyone with a legal background know how I can go after ALLOC? The "new" iFloor performed the service of filing the claim even though the "old" iFloor is who I purchased from? The "old" iFloor purchased directly from ALLOC, the floors were shipped from ALLOC INC located at 3441 S Memorial Dr Racine, WI 53405 and BILLED TO: Smooth Corporation 17616 West Valley HWY Tukwila, WA 98188. The Articles shipped area rads PLT FLOORING, OCEAN FREIGHT FUEL SURCHARGE TERM FEE DELIVERY ADV-DAYLIGHT 73190357-0 ISUF BL#73190357-0 LA#692964
Hawaiian Express Service, is the shipper. I have the Vessel and Voyage NO and the container number as well as the weight and the cube. I have the date shipped and the delivery ticket signer.
I can not figure out what to do next other than to take the legal route against ALLOC FLOORS since they seem to be a non-performing vendor who refuses to take responsibility for their defective floors. I told iFloor party who I am dealing with that a rebuttal can be discussed once my floors have been replaced under ALLOC'S 10 YEAR warranty.
