This complaint has been researched to determine the source of the problem. We indicate that the consumer did sign a Merchant Application with a corresponding Merchant Agreement that disclosed all fees. However, our records indicate that we have also refunded the annual fee outlined in the agreement to satisfy the merchant's complaint. The consumer has stated that he cancelled his contract but the account was never closed and he continues to be debited $24.50. IMS has not received a request for termination. In fact, the account remains open to this day, and the consumer continues to utilize our services on a monthly basis. Therefore, we do not have any indication that the consumer is otherwise dissatisfied with our service. If he would like to close his account, Article IV, Section 4.01 of his Merchant Agreement does offer provisions for the closure of the account. Furthermore, the consumer states that he never received a copy of the Agreement, however he has both signed a document stating he has, and also completed a telephone conference call with this office to confirm that he was in possession of the document. Innovative Merchant Solutions has done all that it can to help assist the merchant and we are sorry to see that he is not satisfied with our service. We believe that we offer a valuable service to our customers in conjuction with quality customer service.
