This law firm is about to garnish my wages for a supposed debt from 2000. I found out about this from my employer one day prior to the effective garnishment period. My company was served on a Wednesday, and is supposed to start garnishing wages within 5 days.

I contacted the county court system's Civil Dept. in an effort to see how this was possible. I was told that I had a failure to appear for my court date, which was obviously stated on my summons. Problem is I was never served. The county court system told me my next step was to file a "motion to quash." Meaning basically I was never served, so I was unaware of this court date. Upon review of the official summons and Affidavit of Service, I noticed a few sketchy items.

An employee of Linville Associates, the company that served me, attested while "being duly sworn" that he delivered and explained the "contents thereof" for my summons to my mother at a specific address with her physical description. I guess to leave her in charge of passing on the message. 2 Problems, the address was not where she lives, there was no description of her. Meaning they obviously never served us. Yet this document was then notarized and processed through the county as legitimate. That is fraud.

Without any contact or notification, I am now to have my wages garnished from a settlement I knew nothing about. I contacted the law firm, and they had nothing to say except for "they never got any returned mail." I am now persuing anything I can to figure out what is going on. Looking for help.

This just happened to me. I have never recieved a summons, nor I have I received notification of a garnishment. The only way I found out was that there is about $8,000 missing from my savings account.

i am in the same boat as you sued me never got a summons found out about it when i tried to buy a house. i am in the process of investigating it. would like to know what happen to you please email me at cgolston1 at hotmail. chris
